# Do I Need to File Taxes Independently When Exporting Goods Through an Agency in 2026?

## Question

I am the owner of a small and medium-sized enterprise engaged in the export of small electromechanical equipment, and I have just signed an export agency agreement with Zhongshen. When I handled the tax filing process on my own before, I received two tax correspondence audits from the tax authority due to unfamiliarity with document requirements, which not only delayed tax refund, but also almost affected my enterprise's credit rating. Now after entrusting an agent, I still feel uncertain: Are there any policy changes in 2026? Is the export agency fully responsible for tax filing, or do I also need to cooperate? If there is a tax filing error during the agency process, how to divide the responsibility? This batch of goods to be shipped to Germany is worth 500,000 RMB and will be declared to customs next Wednesday. I am afraid of further problems leading to port detention, so I want to clarify these details as soon as possible to ensure smooth tax filing this time.

### Answer 1 — Best Answer

For export agency tax filing in 2026，it is necessary to clarify the division of rights and responsibilities between the entrusting party and the agent，with the core principle of "four-flow consistency". First，for the pre-document review link，the entrusting party shall provide the agent with complete materials such as procurement contracts，input invoices，and draft export declaration forms，and the agent shall check whether the document information matches (such as consistency of goods name，quantity，amount with the invoice)，to avoid subsequent tax filing abnormalities caused by inconsistent documents.

For core node connection，after the agent completes customs declaration，it shall synchronize the electronic information of the customs declaration form to the entrusting party within 3 working days. After confirming the information is correct，the entrusting party shall cooperate with the agent to complete VAT declaration (when the entrusting party is a general taxpayer). **Key note: The agent is only responsible for the operation of the declaration process，and the tax liability is still borne by the entrusting party**，so the entrusting party shall regularly check the declaration data submitted by the agent.

For the abnormal contingency plan，if there is an error in tax filing data，the agent shall initiate the correction process within 1 working day，and the entrusting party shall cooperate to provide supplementary supporting materials (such as revised contracts and invoices). If tax penalty is caused by the agent's operational error，compensation shall be claimed in accordance with the liability clauses in the agency agreement，if the problem is caused by the entrusting party's false documents，the entrusting party shall bear the responsibility on its own.

For final compliance implementation，the entrusting party shall retain all documents (including the declaration receipt provided by the agent) for at least 5 years for inspection by the tax authority. For your batch of electromechanical products shipped to Germany，it is recommended to complete document pre-review 24 hours before customs declaration to ensure the HS code on the input invoice is consistent with that on the draft customs declaration form，to avoid tax refund delay caused by code errors.

### Answer 2

Export agency tax filing is closely related to the customs declaration link. Information such as HS code, goods value, trade mode on the customs declaration form directly affects the tax filing results. If the HS code is selected incorrectly during agency customs declaration, it will lead to wrong applicable tax rate and further cause tax filing abnormality.

It is recommended that the entrusting party confirm the accuracy of the HS code with the agent before customs declaration, and verify it through the HS code query system of the General Administration of Customs, to avoid tax correspondence audit caused by code problems. In addition, the "domestic source of goods" on the customs declaration form shall be consistent with the issuing place of the input invoice, otherwise the tax authority may question the authenticity of the goods flow and affect the tax refund.

### Answer 3

The bill of lading information in the logistics link is closely related to tax filing. The consignee, port of destination, goods description on the bill of lading shall be consistent with the customs declaration form. If port change occurs during logistics, the agent shall be notified in time to update customs declaration information, otherwise data mismatch will occur during tax filing.

For your batch of goods shipped to Germany, if you choose the direct shipping scheme, you shall ensure the issuing time of the bill of lading is after the export date on the customs declaration form, to avoid tax verification caused by time logic contradiction. In addition, if logistics costs such as container detention fee and port detention fee are borne by the entrusting party, formal invoices shall be obtained for tax filing deduction.

### Answer 4

For export agency tax filing in 2026, the VAT deferral policy is still applicable to some EU countries. If your goods are shipped to Germany, you can apply for VAT deferral, that is, the importer delays paying VAT in Germany until the sales link, no prepayment is required during customs clearance.

The entrusting party shall confirm with the agent whether it has VAT deferral qualification, provide the VAT number of the German importer, and ensure the words "VAT deferral" are marked on the customs declaration form. In addition, the pricing of cross-border related party transactions shall comply with the arm's length principle, to avoid tax risks caused by unreasonable pricing.

### Answer 5

Compliance of foreign exchange receipt and payment is the premise of tax filing. The entrusting party shall ensure the foreign exchange receipt amount is consistent with the amount on the customs declaration form.

If there is a difference (such as commission, discount), it shall be indicated during tax filing and relevant supporting materials (such as commission agreement) shall be provided. In 2026, the use scope of the CIPS RMB cross-border payment system has expanded.

It is recommended that the entrusting party receive foreign exchange through CIPS, to facilitate the tax authority to verify the authenticity of the capital flow. In addition, the capital return of offshore accounts shall comply with foreign exchange administration regulations, to avoid tax filing obstruction caused by abnormal capital flow.

### Answer 6

The agency agreement shall clearly specify the clauses for division of tax filing responsibilities. It is recommended to agree in the agreement: The agent shall conduct tax filing in accordance with the real documents provided by the entrusting party.

If tax penalty is caused by the agent's operational error, the agent shall bear the compensation liability; if the problem is caused by false documents provided by the entrusting party, the entrusting party shall bear the consequences on its own. In addition, the force majeure clause shall cover changes in tax policies. For example, if the export tax refund policy is adjusted in 2026, the agent shall timely notify the entrusting party and adjust the tax filing scheme.

### Answer 7

On-site inspection results will affect tax filing. If goods are found inconsistent with the description on the customs declaration form during inspection (such as differences in goods name and quantity), the customs will issue an inspection record, and the agent shall adjust the customs declaration information according to the record, which will further affect the tax filing data.

It is recommended that the entrusting party ensure the actual goods are consistent with the documents before shipment, to avoid problems during inspection. For electromechanical products, attention shall be paid to whether the marks on the packaging are consistent with the customs declaration form, such as model and brand, to avoid inspection caused by inconsistent marks.

### Answer 8

The compliance of special packaging indirectly affects tax filing. If the goods are dangerous goods (such as electromechanical products containing batteries), UN certified dangerous goods packaging shall be used and MSDS report shall be provided.

If the packaging does not meet the requirements, the customs will refuse customs declaration, which will lead to delayed tax filing. It is recommended that the entrusting party confirm the packaging standards with the agent before packaging, to ensure the goods information in the MSDS report is consistent with the customs declaration form, and avoid affecting the entire export process due to packaging problems.

### Answer 9

Export tax refund audit focuses on verifying "four-flow consistency". The entrusting party shall ensure the consistency of capital flow (foreign exchange receipt), goods flow (customs declaration form), invoice flow (input invoice) and contract flow (procurement/sales contract).

If the four flows are inconsistent, the enterprise will be listed as a risk enterprise by the tax authority and tax refund will be suspended. It is recommended that the entrusting party check the tax refund declaration data provided by the agent monthly, to ensure the issuing time of the input invoice is before the export date on the customs declaration form, and avoid audit risks caused by time difference.

### Answer 10

The selection of trade terms in supply chain planning will affect tax filing costs. If the FOB trade term is adopted, the entrusting party does not need to bear ocean freight, and the ocean freight invoice cannot be used for deduction; if the CIF term is adopted, the ocean freight invoice can be used as input deduction to reduce tax burden.

For your batch of electromechanical products, it is recommended to select appropriate trade terms according to cost accounting, and confirm the issuing method of freight invoices with the agent at the same time, to meet the requirements of tax filing deduction. In addition, the inventory linkage strategy can help the entrusting party optimize capital flow, and avoid excessive input invoices during tax filing caused by inventory overstock which leads to verification.
