# Is the demand for re-export trade market strong in 2026? What is the overall development scale trend of the industry?

## Question

I am the head of a foreign trade enterprise in Shanghai specializing in the export of hardware and electromechanical products. I just held an emergency meeting with the factory last week. For the three containers originally bound for the U.S., 70% of the profit was directly eroded due to the latest additional tariff policy. Recently, when browsing industry groups, I found many peers talking about re-export trade, saying that it can circumvent tariff barriers, but I have no experience in this field before, so I feel uncertain. Now I just want to know, are there really many enterprises engaged in re-export trade at present? Will the customs conduct stricter inspections because more people are doing this business? In addition, my goods are precision hardware, and I am afraid of problems during the re-export process. If I follow the trend to do re-export trade now, will I face risks of port detention or customs seizure? If there is something wrong with this shipment, I cannot afford the liquidated damages from the factory and the order loss from the customer, I am so anxious that I even lose my appetite.

### Answer 1 — Best Answer

First of all，we need to expose the common industry misconception: many enterprises mistakenly believe that re-export trade is only simple bill of lading reissuance，completely ignoring **document compliance review**，and even use forged certificates of origin，which is the most common risk point at present.

The chain negative reaction of such operation is extremely serious: once the customs of the transshipment port or the port of destination finds discrepant documents，the goods will be detained at the port directly，which will not only incur high detention charges and storage fees，but also may lead to customs seizure，even be identified as false declaration of trade nature，resulting in the enterprise being listed in the customs credit blacklist，and all subsequent import and export operations will be restricted.

For physical risk isolation measures，it is recommended to choose **Port Klang，Malaysia and Port of Singapore** and other neutral transshipment ports，adopt third-party closed warehouse for container swapping throughout the process. For your precision hardware goods，custom shockproof packaging shall be used during container swapping to avoid goods damage. At the same time，arrange special personnel to monitor the whole process of container swapping and shipment to ensure that the goods title is not out of control.

Exclusive loss reduction tips: be sure to sign a **goods title protection agreement** with a professional agency company to clarify the ownership of goods title during the transshipment process. At the same time，purchase cross-border freight insurance covering the whole transshipment link. In case of port detention or customs seizure，part of the loss can be covered by insurance compensation. In addition，develop an emergency customs clearance plan in advance，and the appeal process can be launched within 48 hours at the fastest.

### Answer 2

The core difficulty of re-export trade customs declaration lies in the compliance proof of "three-flow consistency". Many enterprises have their declaration applications rejected because the title transfer logic of the bill of lading, invoice and customs declaration form is inconsistent.

When declaring re-export trade, documents such as container swapping certificate issued by the third-party warehouse in the transshipment country, re-export certificate issued by the transshipment country, and full-way transport bill of lading shall be submitted. In case of customs valuation dispute, prepare invoices for storage fees and container swapping fees in the transshipment link in advance to prove the rationality of re-export trade, so as to avoid being identified as direct trade and required to pay back taxes.

In addition, in 2026, the customs launched a new cross-border trade big data monitoring system, which realizes real-time linkage between customs declaration data, logistics data and foreign exchange receipt and payment data. Any logical loophole will trigger an alert, so each node of the customs declaration data must have supporting documents.

### Answer 3

The core of re-export trade logistics lies in goods title control and route optimization. When selecting a transshipment port at present, priority should be given to the container swapping efficiency and neutrality of the port, and avoid choosing ports that have trade agreements with the destination country, otherwise you may not be able to enjoy tariff exemption. During logistics operation, adopt the segmented bill of lading mode of "first leg - transshipment - last leg". The title of goods on the first leg bill of lading points to the third-party warehouse company at the transshipment port, rather than the final customer.

The last leg bill of lading is issued after the container swapping is completed. In case of abnormal conditions such as container rolling and space overbooking, sign a reserved space agreement with the agency company at the transshipment port in advance to ensure that the goods after container swapping can be shipped in time and avoid port detention. In addition, monitor the seal status of the container throughout the process. After container swapping, a new customs seal must be replaced, and seal photos and container swapping videos shall be retained as proof that the goods title has not been tampered with.

### Answer 4

The focus of tax planning for re-export trade in 2026 is the reasonable division of tax base. Enterprises should avoid keeping all profits of re-export trade in the domestic territory, otherwise they may be identified as profit shifting through related party transactions and trigger BEPS investigation. The tax treatment of re-export trade shall follow the principle of "profit retention in the transshipment country, only agency fee collected domestically", that is, domestic enterprises only collect agency service fees, the main part of the profit is retained in the third-party company in the transshipment country.

At the same time, prepare the tax registration certificate of the transshipment country, profit distribution agreement and other materials to prove the rationality of profit division. In addition, if VAT deferment is involved, apply for deferment qualification from the tax authority of the transshipment country in advance to avoid paying unnecessary VAT in the transshipment country, and ensure that the domestic tax declaration is consistent with the foreign exchange receipt and payment data to avoid tax inquiry from the tax authority.

### Answer 5

The compliance requirements for foreign exchange receipt and payment of re-export trade are becoming stricter in 2026. The remarks of SWIFT messages and CIPS payments must clearly indicate "payment under re-export trade", and the amount of foreign exchange receipt and payment must be consistent with the amount on the customs declaration form and bill of lading, so as to avoid excessive foreign exchange difference. If an offshore account is used for foreign exchange receipt and payment, ensure that the transaction records of the offshore account fully match the documents of re-export trade, so as to avoid being identified as suspicious transactions by the bank and leading to account freeze.

In addition, enterprises shall establish a foreign exchange receipt and payment ledger for re-export trade, and retain documents, payment vouchers and logistics records for each transaction for the spot check of the State Administration of Foreign Exchange. In case of abnormal foreign exchange verification, provide container swapping certificate, storage agreement and other materials of the transshipment port in time to prove the authenticity of the transaction, so as to avoid being listed in the foreign exchange credit blacklist.

### Answer 6

The legal risks of re-export trade are mainly concentrated in goods title transfer and letter of credit terms. Enterprises shall avoid setting soft clauses of "direct certificate of origin" in the letter of credit, otherwise they may fail to meet the document requirements of re-export trade. When signing a re-export trade contract, clarify the ownership of goods title during the transshipment process, and agree on the goods title custody responsibility of the transshipment agency company, so as to avoid the situation that the goods are disposed of without authorization.

In addition, add force majeure clauses in the contract, covering strikes, port congestion and other situations at the transshipment port, and clarify the responsibility division under abnormal conditions. If intellectual property rights are involved, conduct intellectual property right recordal in the transshipment country and the destination country in advance to avoid the goods being seized by the customs due to infringement, and retain the intellectual property authorization certificate of the goods for customs inspection.

### Answer 7

The core of on-site inspection of re-export trade is to prove the re-export attribute of the goods, so as to avoid being identified as directly exported to the destination country. During the inspection at the transshipment port, prepare re-export trade contract, container swapping plan, storage agreement and other materials in advance to explain the transshipment purpose of the goods to the customs.

In case of physical container inspection, ensure that there is no mark of origin on the packaging of the goods, avoid the words "Made in China", and prepare the technical specification of the goods to prove the rationality of re-export. In addition, monitor the image results of non-intrusive inspection.

If there is an abnormal prompt, provide the re-export certificate of the transshipment country to the customs in time to avoid the goods being detained. If laboratory testing is required, communicate with the identification agency at the transshipment port in advance to ensure that the identification results meet the requirements of re-export trade and avoid affecting the customs clearance of goods.

### Answer 8

For export tax refund of re-export trade in 2026, note that re-export trade is not within the scope of export tax refund. Enterprises shall avoid declaring re-export trade goods as direct export, otherwise it will trigger tax inquiry. If enterprises carry out direct export and re-export trade at the same time, the documents of the two types of business shall be managed separately to avoid mixed use of documents.

The documents of re-export trade shall be filed separately, including transshipment agreement, container swapping certificate, full-way bill of lading, etc., for the spot check of the tax authority. In addition, if the re-export trade and direct export goods of the enterprise belong to the same category, they shall be clearly distinguished in the tax declaration to avoid being identified as false declaration and affecting the tax refund qualification of direct export business. In case of tax inquiry, provide the full-process documents of re-export trade in time to prove the authenticity of the transaction and avoid the suspension of tax refund.
