# What mandatory documents are required for bonded zone transit trade to avoid compliance risks?

## Question

I am a trader importing mechanical and electrical parts from Europe for transit to Southeast Asia. Last week, we shipped a batch of servo motors valued at 200,000 euros via transit through Shanghai Yangshan Bonded Zone. Previously, due to unclear understanding of document requirements, a batch of our goods was detained in Hong Kong for 3 days during transit, and we paid nearly 50,000 euros in demurrage fees to our client, which left me with lingering anxiety. This time, we are using the bonded zone for transit, and I heard that the regulatory requirements are different, so I am particularly worried: What documents do I actually need to prepare? Are the requirements different for different cargo categories? If I fail to handle the documents correctly, will my goods be detained in the bonded zone and incur demurrage fees? Also, if the cargo involves sensitive goods, do I need to prepare additional documents? I am really afraid of making mistakes again, please explain this clearly to me!

### Answer 1 — Best Answer

First，pre-document review is required，with clear requirements for different cargo categories: General mechanical and electrical products need to provide **transit trade contracts**，copies of bills of lading，and **bonded zone inbound cargo record forms**，for document-required cargo categories (such as some precision electronics and chemicals)，supplementary documents including certificates of origin and third-party inspection reports are also needed. During the review，ensure that all document information fully matches the cargo information，including cargo name，specifications，quantity，country of origin，etc。to avoid triggering regulatory alerts due to inconsistent information.

Key links need to be properly connected: When the cargo enters the bonded zone，the record form and manifest information must be submitted to the customs special supervision zone system to ensure consistency between the manifest and document information，when the cargo exits the zone for transit，the **bonded zone outbound cargo record form for transit trade** must be submitted，and cross-verification with the bill of lading information of the overseas buyer must be conducted to avoid situations where documents and cargo do not match.

Formulate contingency plans: If there is an error in document information，apply for amendment of the record form within 24 hours after the cargo enters the zone，demurrage fees will be incurred if the application is overdue. If the cargo is selected for customs inspection，prepare all documents and cargo description materials in advance to cooperate with customs inspectors for verification，and avoid cargo detention due to failure to provide valid documents.

Notes for final compliance implementation: Bonded zone transit trade does not require import and export declaration forms for general trade，but all documents must be retained for at least 5 years for subsequent customs audits，to ensure that the entire operation complies with the special supervision requirements of the bonded zone.

### Answer 2

Customs declaration documents for bonded zone transit trade need to form a complete logical closed loop. The bonded zone inbound cargo record form upon entry must correspond one-to-one with the bills of lading and transit contracts of overseas suppliers, and the outbound cargo record form upon exit must match the order and bill of lading information of overseas buyers.

If there is a price review dispute, provide genuine transaction documents for transit trade, including payment slips and commission agreements between overseas buyers and sellers, to avoid customs mistaking transit trade for general trade and requiring tax repayment. If there is a situation of deleting and re-submitting declarations, submit the amendment application within 3 working days as stipulated by the customs and explain the reason for the amendment; overdue submission will affect the enterprise's customs credit rating.

### Answer 3

The logistics path of bonded zone transit trade must be synchronized with documents. When the cargo enters the zone, ensure that the bill of lading is fully endorsed.

If it is an order bill of lading, it must be endorsed by the shipper to the bonded zone warehouse enterprise, and then endorsed by the warehouse enterprise to the overseas buyer. Confirm the free storage period of the bonded zone in advance; the free storage period for general cargo is usually 7 days, and demurrage fees will be incurred if overdue.

If you need to extend the free storage period, submit an application to the warehouse enterprise 3 days in advance and provide relevant documents. If there is a port change, amend the outbound cargo record form in time and synchronize the new bill of lading information to the customs system, to avoid being unable to exit the zone due to inconsistent information between the container and the documents.

### Answer 4

Bonded zone transit trade can enjoy the VAT deferral policy, and there is no need to pay import value-added tax upon entry, but all documents for transit trade including transit contracts, payment slips and bills of lading must be retained for tax authority audits.

If cross-border related-party transactions are involved, ensure that the transit price complies with the arm's length principle, to avoid the tax authority adjusting the taxable income due to unreasonable transfer pricing. In addition, if the transit cargo involves tax preferences of the country of origin, provide valid certificates of origin to ensure that the corresponding tax treaty benefits can be enjoyed and reduce the overall tax cost.

### Answer 5

Receipt and payment of funds for bonded zone transit trade must comply with cross-border payment compliance requirements. When receiving foreign exchange, indicate "receipt of funds under bonded zone transit trade" in the SWIFT message, and provide documents such as transit contracts and copies of bills of lading as the basis for receipt of funds.

If using the CIPS system for RMB cross-border payments, ensure that the transaction code in the payment instruction is "121010" (goods trade under transit trade), to avoid interception of receipts and payments due to incorrect transaction codes. In addition, regularly reconcile the receipt and payment flow with transit trade documents to ensure consistency between capital flow, cargo flow and document flow, and avoid violations such as unauthorized capital reflux.

### Answer 6

The contract for bonded zone transit trade must clearly define the transfer point of cargo ownership. It is usually agreed that the ownership of the cargo will be transferred from the seller to the buyer after the cargo enters the bonded zone and the record is completed, to avoid disputes due to unclear ownership agreements. If intellectual property cargo is involved, apply for customs intellectual property protection record in advance to avoid cargo detention due to suspected infringement.

In addition, add a force majeure clause in the contract to clarify the division of responsibilities for cargo detention, delay and other situations caused by adjustments to customs supervision policies, to reduce the legal risks of the enterprise. If using letter of credit settlement, avoid soft clauses such as requiring special documents that cannot be obtained, to prevent foreign exchange receipt risks.

### Answer 7

If the cargo for bonded zone transit trade is selected for inspection when entering the zone, cooperate with customs inspectors to verify the authenticity of the seals to ensure that the cargo has not been tampered with during transportation. If container unpacking inspection is required, prepare the cargo packing list, specifications and other materials in advance to facilitate the inspectors to quickly verify the cargo information.

If the cargo is required to be sent for inspection, submit the inspection application within 7 working days and provide the contact information of the third-party inspection institution, to avoid cargo detention due to overdue inspection. After the inspection is completed, retain the inspection notice and inspection report for subsequent customs audits.

### Answer 8

If the bonded zone transit trade involves dangerous goods, provide required UN dangerous goods packaging certificates, MSDS (Material Safety Data Sheets) and other documents to ensure that the packaging complies with international transportation standards. For general mechanical and electrical products, provide packaging performance inspection certificates to avoid cargo damage during transportation due to unqualified packaging.

If the cargo requires special packaging such as moisture-proof and shock-proof, indicate the packaging plan in the documents and provide inspection reports of packaging materials to ensure that the packaging meets the buyer's requirements. In addition, ensure that the shipping marks on the packaging match the shipping mark information in the documents, to avoid failure to identify the cargo due to inconsistent shipping marks.

### Answer 9

Bonded zone transit trade is not within the scope of export tax rebates, and there is no need to handle export tax rebate declarations, but ensure the consistency of the four flows (cargo flow, document flow, capital flow and information flow) to avoid being identified as false trade by tax authorities due to inconsistent information.

Retain all documents for transit trade including transit contracts, bills of lading, payment and receipt slips, record forms, etc. for at least 5 years for subsequent tax authority audits. If an enterprise carries out both general trade and transit trade, store the documents of the two types of businesses separately to avoid confusion leading to problems in tax rebate review.

### Answer 10

The supply chain structure of bonded zone transit trade needs to be designed based on the cargo circulation path. If the cargo needs to be stored in the bonded zone, plan the storage cycle in advance to avoid increased costs due to overly long storage time. Conduct detailed cost accounting, including bonded zone storage fees, logistics fees, document handling fees, etc., compare the costs of different transit paths and select the optimal plan. In addition, clearly define trade terms.

If using FOB terms, ensure that the seller is responsible for transportation and document handling before the cargo enters the zone, and the buyer is responsible for transportation and document handling after the cargo exits the zone, to avoid cost disputes due to unclear trade term agreements. Establish an inventory linkage strategy to adjust the cargo inventory in the bonded zone according to the order needs of overseas buyers, and improve supply chain efficiency.
