# Can Export Goods Choose Not to Apply for Export Tax Refund? What Compliance Risks and Hidden Costs Shall Be Borne?

## Question

I am the head of a small and micro enterprise in Shanghai focusing on exporting Nordic-style home goods. Recently, for two batches of small-batch wrought iron candle holder orders sent to Amsterdam, the Netherlands, the factory lost the original purchase contract, so we cannot collect the full set of documents required for tax refund. Besides, the tax refund process takes at least 1 month, while the net profit of this batch of goods is less than RMB 8,000, which may not even cover the labor and courier costs after going through the process. But I am very anxious. I heard from peers that some enterprises were subject to tax audits because they directly did not apply for tax refund, not only paying back taxes but also being fined. I am too worried to eat now, and just want to ask: can we choose not to apply for tax refund for exports? What should we do to avoid pitfalls if we do not apply? Will it affect future tax refund eligibility and normal foreign exchange receipt and payment?

### Answer 1 — Best Answer

First of all，we need to clarify a common industry misconception: many enterprises mistakenly believe that "not applying for tax refund = no declaration required"，and directly skip the tax exemption filing process，which is the core cause of compliance risks.

If no compliant operations are carried out，it will trigger a chain of negative reactions: the tax system will mark the export as an "abnormal transaction"，and launch a tax audit within 3 months. In minor cases，13% VAT will be levied retrospectively，and in serious cases，a fine of 0.5 to 5 times the tax amount will be imposed，and the enterprise's tax credit rating will be reduced to D level. The customs will jointly verify the authenticity of the goods，which may lead to targeted inspection of subsequent export goods. The foreign exchange administration will also mark the corresponding foreign exchange receipt and payment as "suspicious"，restricting the enterprise's subsequent foreign exchange purchase and settlement privileges.

Physical risk isolation measures: when an enterprise voluntarily waives tax refund，**it must complete VAT exemption declaration within 30 days after export**，and **retain the full set of transaction documents including customs declaration forms，bills of lading，export contracts and logistics documents for at least 3 years** to ensure full traceability of the whole chain.

Exclusive loss-mitigation tips: if you cannot apply for tax refund due to missing documents，you can entrust a professional foreign trade agency to reissue alternative documents such as proof of contract loss issued by the factory and payment vouchers，or apply for "simplified tax exemption filing" from the tax authority in advance for small-batch orders to reduce operation costs.

### Answer 2

From the perspective of customs declaration compliance, whether to apply for tax refund for export goods does not directly affect customs clearance, but goods without tax exemption declaration will be marked as "tax-related closed loop not completed" in the customs "export goods traceability system", triggering subsequent joint audits. If selected for on-site inspection, the customs will focus on verifying the real value and trade background of the goods.

If violations such as "under-declaration of goods value" or "fake self-operation with actual agency" are found, the goods will be directly detained and transferred to anti-smuggling authorities. Enterprises shall check the "voluntarily waive export tax refund" option in the "tax-related filing module" of the "Single Window" when declaring customs, to ensure that customs declaration data is synchronized with the tax system and avoid early warning caused by data inconsistency.

### Answer 3

From the perspective of international logistics chain, not applying for tax refund itself will not affect cargo transportation, but attention should be paid to the customs clearance connection after the goods arrive at the port. Customs of some destination countries will require the importer to provide the tax refund certificate or tax exemption filing document from the exporting country.

If you cannot provide these documents, it may be identified as unofficial customs clearance, resulting in port detention, container detention charges, storage charges, and even return shipment. Enterprises shall communicate with the destination country agent in advance to confirm the local customs clearance requirements for goods without tax refund, indicate "the exporter has voluntarily waived export tax refund" in the bill of lading remark column, and retain the full logistics POD as evidence for future disputes.

### Answer 4

From the perspective of cross-border tax structure, voluntary waiver of tax refund shall be combined with the overall tax planning of the enterprise. If the enterprise has input VAT credit for domestic sales, waiving tax refund may lead to the input VAT credit cannot be offset, increasing the overall tax burden.

If the enterprise involves cross-border related party transactions, it shall avoid profit shifting through "waiving tax refund", otherwise it will trigger BEPS inspection and face anti-tax avoidance investigation. Enterprises can replace tax refund waiver with the "VAT deferral" model, offset domestic input VAT when paying import VAT in the destination country, avoid the cumbersome process of domestic tax exemption declaration, and reduce the overall tax cost.

### Answer 5

From the perspective of foreign exchange receipt and payment compliance, foreign exchange received corresponding to export goods without tax exemption declaration will be included in the "suspicious transaction monitoring scope" by the foreign exchange administration. The foreign exchange administration will verify the matching degree between the received foreign exchange amount and the declared customs value.

If the discrepancy exceeds 5%, the enterprise will be required to provide proof of transaction authenticity, otherwise the enterprise's subsequent foreign exchange purchase and settlement privileges will be restricted. Enterprises shall complete the "export foreign exchange receipt discrepancy report" in the "Foreign Exchange Monitoring System for Goods Trade" within 15 days after receiving foreign exchange, indicate "voluntarily waive export tax refund", and retain foreign exchange receipt slips, export contracts and other documents to ensure that the foreign exchange receipt and payment data is consistent with the tax and customs data.

### Answer 6

From the perspective of international trade law, voluntary waiver of tax refund shall clearly stipulate relevant responsibilities in the export sales contract. If the contract stipulates that the exporter shall provide tax refund vouchers as a precondition for payment, waiving tax refund may constitute a breach of contract and face claims from the importer.

If the enterprise predicts that it may waive tax refund when signing the contract, it shall add the clause that "the exporter has the right to voluntarily waive export tax refund, and the importer shall not require the provision of tax refund vouchers", and retain written proof of contract modification such as email correspondence and supplementary agreements to avoid subsequent legal disputes. In addition, if the goods involve intellectual property rights, it shall be ensured that waiving tax refund will not affect the validity of intellectual property customs protection recordation.

### Answer 7

From the perspective of export tax refund compliance audit, after the enterprise voluntarily waives tax refund, it shall ensure the complete retention of documents for the consistency of four streams: goods flow, capital flow, invoice flow and contract flow. The tax authority will carry out retrospective audit within 3 years.

If documents are missing or inconsistent, it will be identified as "false tax exemption declaration", and tax will be levied retrospectively plus fines. Enterprises shall establish a "document archive for tax refund waivers", store transaction documents for each tax refund waiver separately, including copies of customs declaration forms, export contracts, payment vouchers, logistics documents, tax exemption declaration receipts, etc., and conduct internal self-inspection once a quarter to timely supplement missing documents and avoid audit risks.

### Answer 8

From the perspective of supply chain planning, voluntary waiver of tax refund shall carry out cost calculation combined with order scale and profit margin. For small-batch, low-profit orders, the operation cost of waiving tax refund such as tax exemption declaration and document retention may be higher than the tax refund revenue. In this case, such orders can be integrated into "centralized customs declaration" to reduce operation costs.

For long-term key clients, it is necessary to evaluate the impact of waiving tax refund on enterprise credit, and avoid affecting long-term cooperation for small profits. Enterprises can establish an "order tax refund decision model", which automatically judges whether to waive tax refund according to parameters such as order value, profit and document completeness, to optimize the overall supply chain cost.
