# How has China's textile and apparel industry swept the Brazilian market?

## Question

We are a medium-sized textile export enterprise in Shaoxing, specializing in polyester fabrics and garments. Recently, we want to focus on developing the Brazilian market, but we've heard that customs clearance in South America is particularly complex, with high tariffs, and Brazilian customers have very conservative payment methods. We would like to ask for advice on how to systematically lay out our plans from product compliance, logistics and customs clearance to client negotiations in order to truly capture this market. Currently, our biggest concerns are: 1. What special restrictions does Brazil impose on textile imports? 2. How can we control logistics costs and customs clearance efficiency? 3. How can we convince Brazilian clients to accept our payment terms?

## Answers

### Answer 1 — Best Answer

Brazil's import regulations for textiles and clothing are indeed stringent. You need to pay special attention to three compliance red lines。

1. The HS code must be accurate. For example，cotton knit T-shirts are classified as 6109.10，and synthetic fiber dresses are 6204.43. Misreporting will trigger customs inspections。

2. INMETRO certification is mandatory，especially for children's clothing and intimate apparel. Products without certificates will be directly returned at the port。

3. Brazil imposes anti-dumping duties on certain Chinese textile categories，such as polyester fabric with a tariff rate as high as 94%. You must check the latest CAMEX announcements before quoting prices。

We recommend obtaining an "Import License (LI)" before shipping. Although the process is cumbersome (requiring application through the SISCOMEX system)，it can avoid the risk of customs clearance failure upon arrival. Additionally，all documents must display the CNPJ tax number，and the product names，weights，and amounts on the bill of lading，invoice，and packing list must match exactly. Brazil's customs inspection rate for "document-cargo mismatches" exceeds 30%.

### Answer 2

For logistics to Brazil, we recommend shipping by full container to Santos Port, which offers the best cost-performance ratio. Currently, the shipping time from Shanghai to Santos Port is approximately 35-40 days, with freight rates ranging from USD 2,500 to 3,500 per 40HQ container. For Incoterms, we strongly recommend CIF, as Brazilian buyers face complex import procedures, and maintaining control of the goods ensures greater security for you. Regarding customs clearance, it is essential to send all documents (bill of lading, invoice, packing list, and certificate of origin) to the Brazilian agent for pre-declaration 7 days before the vessel arrives at the port. Delays will result in expensive port demurrage fees. For documentation, the invoice must include the NCM tax code (similar to HS code), CNPJ tax number, and IE state tax number, otherwise customs clearance will be impossible. Additionally, Brazilian customs conduct frequent inspections of textile products, so we recommend allowing 10-15 days for customs clearance. If the client urgently needs the goods, air freight can be considered, but the customs clearance fees at São Paulo Airport are extremely high, making it suitable only for high-value samples.

### Answer 3

When negotiating with Brazilian clients, you need to focus on two key points: trust and flexibility. Firstly, Brazilians place great importance on relationships. For your first cooperation, don’t rush to discuss large orders. Instead, start with small trial orders, accompanied by video factory inspections and third-party quality inspection reports to establish credibility. Regarding payment methods, they prefer L/C at sight, but have strict requirements for issuing banks. It’s best to specify major international banks (such as HSBC or Citibank) to avoid accepting letters of credit from small local Brazilian banks. During price negotiations, leave a 3-5% discount margin, but don’t give in easily. You can bundle in clauses like "volume-based rebates" or "annual cooperation bonuses." Regarding communication timing, Brazilians often reply to emails slowly, so you need to proactively follow up. WhatsApp is more effective than email for communication. Finally, be sure to add "force majeure clauses" and "exchange rate fluctuation adjustment mechanisms" to the contract to protect your interests.
