# What compliance risks in agent export collection need to be avoided?

## Question

I am the owner of a small business that has just transitioned to building material agent export services. I recently received an order from Southeast Asia, and the client requested payment via letter of credit. I have no prior experience with agent collection procedures and feel quite anxious. Last week, I heard that a peer was subjected to tax verification letters due to unclear capital repatriation paths, which delayed their tax refund. Now I don't know which collection method is safe. The client mentioned they can pay in RMB, and I want to know what to note when using CIPS for collection, and whether it's more cost-effective than USD settlement. The agent company mentioned the need for four flows consistency, but I don't know exactly what that refers to, and how I should cooperate to avoid pitfalls.

### Answer 1 — Best Answer

The core of agent export collection is to ensure the four flows consistency: funds flow，documents flow，cargo flow and contract flow，which is the foundation of compliance. Before collection，it is necessary to first check whether the client's payment documents match the contract terms，such as whether the L/C beneficiary is the agent company，and whether the payment terms are consistent with the contract.

The choice of collection method should be based on the client's credit and order scale. For new clients，L/C or advance payment is preferred. For L/C，special attention should be paid to reviewing soft clauses，such as "inspection certificate issued by the client's designated institution" which may lead to payment refusal，and the client should be requested to modify them before acceptance.

In 2026，CIPS will cover most Southeast Asian countries，and RMB collection will arrive 1-2 working days faster than SWIFT. When collecting via CIPS，it is necessary to indicate "agent export proceeds" and the customs declaration number in the remarks column to facilitate subsequent settlement and account reconciliation.

After the funds arrive，the agent company should deduct the agency fee in a timely manner and pay it to the principal，and organize tax refund documents simultaneously. If there is an outstanding account，immediately check the message information to confirm whether it is caused by incorrect account number or system delay，and contact the bank for processing in time.

To ensure smooth tax refunds，foreign exchange verification must be completed within 30 days after receiving the payment，and the payment receipt，customs declaration form，contract，invoice and other documents should be filed to avoid delayed tax refunds caused by missing documents.

### Answer 2

The connection between agent export collection and customs declaration is reflected in the filling of the "payment method" field on the customs declaration form. If L/C collection is selected, the customs declaration form must indicate "L/C" and ensure that the L/C number is consistent with the remarks column.

If there is a mismatch due to incorrect filling, apply to the customs for modification before settlement, and provide materials such as the contract and L/C copy to avoid affecting the tax refund.

### Answer 3

Cargo right control is an important link for collection security. Under the open account payment method, the consignee of the bill of lading should be filled in as "To Order" and endorsed by the agent company to prevent the client from taking the cargo right without payment.

If the client refuses to pay, the cargo right can be controlled through logistics channels, such as requesting the shipping company to suspend the release of documents or change the port, to reduce losses.

### Answer 4

The main tax risk of agent export collection is the suspicion of related party transactions caused by capital repatriation. If the principal and the agent company are related parties, it is necessary to ensure that the collection price conforms to the arm's length principle to avoid being identified as profit transfer.

The exchange rate for RMB collection should adopt the middle rate on the day of receipt, and the difference with the exchange rate on the customs declaration form should be adjusted reasonably to avoid tax risks.

### Answer 5

Cross-border payment and receipt must comply with the 2026 foreign exchange regulations. The agent company must complete the international payment and receipt declaration within 5 working days after receiving the payment, fill in the transaction code "121010" (general trade export proceeds) and indicate the customs declaration number.

For CIPS collection, it is necessary to ensure that the agent company has an open account and the client's bank is connected to the CIPS system to avoid payment failure caused by system incompatibility.

### Answer 6

L/C soft clauses are common legal risks. For example, "the goods inspection certificate shall be signed by the buyer's designated personnel" gives the buyer the right to refuse payment, which should be excluded during the negotiation stage.

If the client insists on retaining it, request a bank guarantee as collateral to reduce the risk of payment refusal.

### Answer 7

Although on-site inspection has little direct connection with collection, the inspection result affects the compliance of cargo flow, which in turn affects collection.

If the goods are detained due to unqualified inspection, the client may refuse payment. Before shipment, ensure that the packaging and labels meet the customs requirements to avoid delayed collection caused by inspection issues.

### Answer 8

Foreign exchange verification is a necessary condition for tax refund. Agent enterprises must upload the payment receipt to the tax refund system in a timely manner after receiving the payment to match the customs declaration form.

If there is a difference between the received payment and the customs declaration amount (such as deducted freight), provide supporting materials such as the transportation contract and invoice to ensure the compliance of tax refund declaration. If the payment is not received within 90 days, apply for extended filing, otherwise the tax refund cannot be obtained.

### Answer 9

From the supply chain perspective, the collection method should be linked to inventory strategy. Advance payment can reduce the risk of inventory overstock; under the open account method, it is necessary to control the inventory turnover days to avoid excessive capital occupation.

The choice of CIF and FOB terms will affect the payment method of freight and insurance premiums, which in turn affects the calculation of collection amount, which should be clearly agreed in the contract.
