# What core compliance nodes and risk control points need to be controlled when domestic freight forwarders export goods abroad?

## Question

I am the person in charge of a domestic freight forwarder focusing on small household appliances. I suffered a heavy loss last month: a batch of smart air fryers worth 800,000 yuan was detained at the Port of Los Angeles for 12 days because the core material composition was missing from the customs declaration form. I not only compensated the customer 22,000 yuan as delay liquidated damages, but also incurred an extra 56,000 yuan of demurrage fees, document amendment fees and warehouse rent. Now a key German client will ship a 20-foot high cube container of ultrasonic humidifiers with a cargo value of nearly 1.2 million yuan. I am afraid of making further mistakes that would damage our reputation, so I would like to know, from the perspective of a freight forwarder, how to refine and consolidate every link of export to overseas markets, covering pre document review, core node connection, and emergency response. The more specific the suggestions are, the better. I have been so anxious recently that I suffer from insomnia every day.

### Answer 1 — Best Answer

First of all，**refined pre-document review** shall be completed: collect and verify the full set of export documents 7-10 days in advance，including customs declaration form，commercial invoice，packing list and certificate of origin. Focus on checking the consistency of the goods' material，HS code and declared value on the customs declaration form with the actual goods. For small household appliances，additional confirmation shall be made on the validity of destination country access certificates such as CE certification and ROHS reports，and their matching degree with corresponding product models. Missing of core declaration elements is strictly prohibited to avoid customs detention caused by document inconsistency.

Seamless connection shall be realized for core nodes: after booking shipping space，synchronously push the document information to the cooperative customs broker and warehouse，and confirm that the seal number，container type，number of pieces，weight and measurement of the goods when entering the warehouse are completely consistent with the booking information. Complete customs declaration pre-entry and compare with manifest information 24 hours before shipment，to ensure real-time synchronization of information between logistics nodes (warehouse-port-shipping company) and customs declaration nodes，and eliminate the risk of manifest inconsistency or container rollover caused by information gap.

**Emergency response plans** shall be laid out in advance: for customs detention in the destination country，reserve supplementary evidence materials such as goods material test reports and brand authorization letters in advance，which can be submitted to the destination country customs within 48 hours. For port congestion，confirm the free storage period of the destination country in advance，and agree with the shipping company to extend the free storage period of the transshipment port to 7-10 days to avoid transshipment demurrage fees. For unexpected container rollover，reserve 1-2 alternative shipping schedules of the same route to ensure that the goods can be rebooked within 24 hours.

Finally，compliance implementation shall be achieved: after the goods arrive at the port，follow up the customs clearance progress synchronously. After confirming that the customer has completed tax payment in the destination country，archive and keep the full set of documents for at least 3 years，which complies with China's foreign trade supervision and destination country compliance requirements，and avoids subsequent tax or customs retrospective risks.

### Answer 2

When exporting abroad, special attention shall be paid to the accurate classification of HS codes in the customs declaration link. Many freight forwarders apply approximate codes for convenience, which may trigger customs valuation disputes or customs detention. The code shall be determined based on the three attributes of the goods: function, material and purpose, relying on the customs commodity code query system.

At the same time, provide the customs broker with detailed technical parameters and physical photos of the goods in advance, to avoid document deletion and re-declaration caused by wrong code classification, which may lead to demurrage fees or shipping schedule delay. In addition, for high-value goods, prepare auxiliary valuation materials such as payment vouchers and procurement contracts in advance to reduce the probability of customs valuation queries and ensure customs clearance efficiency.

### Answer 3

The selection of logistics routes for export abroad shall take both timeliness and cost into account. Direct shipping routes have fast timeliness but tight shipping space, while transshipment routes have lower cost but require attention to the free storage period and connection efficiency of the transshipment port.

Confirm the shipping space availability with the shipping company 15 days in advance. For high value-added goods, direct shipping routes are preferred; for bulk cargo, transshipment routes can be selected, and an agreement shall be reached with the shipping company to extend the free storage period of the transshipment port to 7-10 days to avoid transshipment demurrage fees.

At the same time, clarify the ownership of the goods on the bill of lading, and adopt the "order bill of lading" to facilitate subsequent goods right transfer, so as to avoid delivery delay caused by goods right disputes. In addition, track the GPS positioning of the goods in real time, predict weather or port congestion in advance, and adjust the logistics plan in time.

### Answer 4

When exporting abroad, the VAT deferral policy can be used to reduce capital occupation costs. Many freight forwarders are not familiar with the tax rules of the destination country, and pay high VAT in advance, resulting in tight cash flow. For regions supporting VAT deferral such as the European Union and the United Kingdom, submit a VAT deferral application when declaring customs, so that import VAT does not need to be paid at the time of import, but shall be declared and paid uniformly in the subsequent VAT declaration cycle, which can save the capital occupation cycle of at least 30 days.

At the same time, ensure that the transaction pricing between the freight forwarder and overseas customers complies with the arm's length principle, to avoid BEPS investigation caused by unreasonable related party transaction pricing, which may lead to tax fines. In addition, keep all tax vouchers for subsequent tax audits.

### Answer 5

The cross-border receipt and payment of foreign exchange shall comply with the compliance requirements of the CIPS RMB cross-border payment system. Many freight forwarders use third-party payment institutions for foreign exchange receipt and payment, resulting in account freezing.

Priority shall be given to RMB cross-border receipt and payment through the CIPS system to ensure the authenticity of the transaction background. Keep relevant vouchers for foreign exchange receipt and payment such as customs declaration forms, commercial invoices and contracts, to avoid difficulties in foreign exchange settlement and account reconciliation caused by unclear transaction background.

In addition, for the use of offshore accounts, perform account reconciliation on a monthly basis, and clear abnormal transaction records in time to avoid the restriction of foreign exchange receipt and payment function by the bank due to account abnormalities. At the same time, pay attention to exchange rate fluctuations, and use forward foreign exchange settlement and sale tools to lock the exchange rate and reduce exchange difference risks.

### Answer 6

When exporting abroad, the coverage of force majeure clauses in the transportation contract shall be clearly defined. Many freight forwarders cannot be exempted from liability when encountering port strikes, epidemic port closures and other situations due to vague contract clauses. The specific types of force majeure events, corresponding responsibility division and upper limit of delay compensation shall be clearly agreed in the contract, and the specific conditions for goods right transfer shall also be agreed, so as to avoid the risk of payment collection caused by early transfer of goods right.

In addition, for goods involving brand authorization, require the brand owner to issue an official authorization letter in advance, and clarify the scope of exemption for the freight forwarder in the contract, to avoid legal proceedings caused by brand infringement. At the same time, keep all contracts and authorization documents to facilitate evidence production in subsequent legal disputes.

### Answer 7

Special attention shall be paid to the integrity of the goods seal during on-site port inspection. Many freight forwarders have their goods detained and inspected by the customs due to damaged seals or inconsistent numbers. Check the seal number on site when the goods enter the warehouse, take photos and keep records, and confirm again that the seal has not been pried or damaged before shipment.

For goods with abnormal machine inspection results, prepare detailed packing lists and material descriptions of the goods in advance, and cooperate with the customs for container unpacking inspection, so as to avoid extended inspection time caused by failure to provide valid certificates. In addition, for goods that need to be inspected and identified, contact a qualified third-party testing institution in advance to ensure that the test report meets the requirements of the customs and shorten the inspection and clearance time.

### Answer 8

After exporting abroad, strictly follow the "four flows consistency" requirement for tax refund. Many freight forwarders have their tax refund applications rejected due to unclear capital return paths. Ensure that the goods right subject, amount and goods information on the customs declaration form, special VAT invoice, procurement contract, and foreign exchange receipt and payment vouchers are completely consistent, to avoid tax correspondence investigation caused by inconsistent four flows.

At the same time, complete the pre-declaration of tax refund within 90 days after the goods are exported, and correct the wrong information in the pre-declaration in time to avoid tax refund losses caused by overdue declaration. In addition, archive and keep all tax refund documents for at least 5 years to facilitate the audit and verification of the subsequent tax authorities and ensure the compliance of the tax refund process.
