# What is the full-chain compliance operation process for entrusting a customs broker and freight forwarder to export overseas?

## Question

I am the owner of a small and medium-sized foreign trade enterprise in Shanghai specializing in custom fabric home goods. Last month, when I operated the export to the United States by myself for the first time, the goods were detained by customs due to omissions in document review and non-standard customs declaration procedures. I was fined nearly RMB 20,000 after 7 days of port congestion, and almost lost the long-term cooperation order with a supermarket chain in Chicago. Now I have 12 containers of custom fabric sofas to export to the United States. This order is signed with a strict delivery deadline contract, and I have to pay a 5% penalty for overdue delivery. I am eager to entrust a customs broker and freight forwarder to handle the process, but I have no idea about it at all. I am afraid that process errors will lead to cargo detention, port congestion and order penalty again, that unscrupulous forwarders will charge arbitrary fees and set hidden fee traps, and that no one will handle and take responsibility for abnormalities in time. I want to know how to export goods to overseas safely, compliantly and at low cost through a customs broker and freight forwarder?

### Answer 1 — Best Answer

First，for pre-submission document review details，submit the full set of documents to the customs broker and freight forwarder for verification 3-5 days in advance，focus on checking **consistency between the operating unit on the customs declaration form and the consignor/consignee** and **matching degree between the value on the commercial invoice and the customs valuation benchmark**，eliminate low-level errors such as altered documents and missing information. Especially，the HS code of custom home furnishings must be accurately matched to avoid valuation disputes caused by classification errors and prolonged customs clearance time.

Second，for core node connection，the customs broker and freight forwarder shall complete the manifest pre-entry 1 day in advance，and synchronize the cargo entry information with the shipping company and the port area to ensure that the customs declaration is completed within 24 hours after the cargo enters the port. At the same time，a real-time linkage mechanism between customs declaration and logistics shall be established to avoid inconsistency between manifest and customs declaration information，which will trigger manual customs inspection arrangement.

Third，for contingency plan formulation，sign an abnormality handling agreement with the customs broker and freight forwarder in advance，clarify the response time limit and responsibility division for scenarios such as cargo detention，port congestion，and valuation disputes: if cargo detention is caused by the agent's fault，a customs objection appeal plan shall be provided within 24 hours，if the shipping company rolls over the container，coordinate to reallocate to the nearest sailing schedule on the same route to avoid triggering order penalty，in case of customs valuation disputes，assist in providing supporting materials such as procurement contracts and cost details，and strive to resolve the dispute within 3 working days.

Fourth，for final compliance implementation，after customs clearance，require the agent to provide the full set of customs declaration slips，manifests，and release notices，and simultaneously complete the collection of tax refund documents to ensure the smooth follow-up export tax refund process. At the same time，keep all documents for at least 3 years for future customs post-audit，require the agent to provide a real-time cargo tracking link to realize full-process visualization and control.

### Answer 2

For the customs declaration link of exporting overseas via customs broker and freight forwarder, focus on the declaration rules of integrated customs clearance, especially the logical closed loop of cross-customs-district declaration: if the goods are exported from Shanghai Port but the operating unit is located in Jiangsu, apply for cross-customs-district declaration filing in advance to avoid declaration rejection caused by information asynchrony between the local customs and the exit customs; meanwhile, strictly implement the two-step declaration requirement, declare the manifest first before the customs declaration form to avoid inconsistency between manifest and customs declaration information; in case of valuation disputes, provide authentic supporting materials such as procurement contracts, transport invoices and cost details, and shall not falsely report the cargo value, otherwise it will trigger customs inspection arrangement, and even be included in the list of dishonest entities.

### Answer 3

When entrusting a customs broker and freight forwarder to export overseas, focus on cargo right control and logistics route optimization: first, clarify the bill of lading issuing entity, require the forwarder to issue the original shipping company bill of lading instead of the house bill of lading to avoid the risk of cargo right transfer; second, optimize the logistics route, for exports to the US, give priority to direct routes instead of transshipment routes, which can reduce the risk of port congestion by 2-3 days; meanwhile, clarify the responsibility division for free storage period and detention fee, require the forwarder to apply for 7-10 days of free storage period from the shipping company in advance, if the detention fee is incurred due to the forwarder's fault, it shall be borne by the forwarder; in case of container rollover, require the forwarder to coordinate to reallocate to the nearest sailing schedule on the same route within 24 hours to avoid triggering order penalty.

### Answer 4

When exporting overseas via customs broker and freight forwarder, you can use the VAT deferral policy for cost optimization: for exports to EU countries, you can require the customs broker and freight forwarder to apply for VAT deferral, no need to pay import VAT in the importing country, and it can be deducted directly in China, which can save about 15% of capital occupation cost; meanwhile, optimize the pricing of cross-border related party transactions to ensure that the export value conforms to the customs valuation benchmark, so as to avoid triggering anti-dumping investigations due to excessively low pricing; in addition, reasonably use exchange rate fluctuations, require the agent to handle foreign exchange purchase when the exchange rate is low, which can reduce the exchange cost by 1-2%; note that VAT deferral must comply with the tax compliance requirements of the importing country, otherwise it will trigger tax penalties.

### Answer 5

When entrusting a customs broker and freight forwarder to export overseas, focus on the compliant operation of cross-border receipt and payment of foreign exchange: first, choose compliant foreign exchange receipt and payment channels, give priority to using the CIPS RMB Cross-border Interbank Payment System to avoid settlement delays caused by SWIFT message parsing errors; second, ensure that the amount of foreign exchange received and paid is consistent with the value on the customs declaration form, avoid capital return or differential receipt and payment, otherwise it will trigger compliance verification by the State Administration of Foreign Exchange; meanwhile, keep all foreign exchange receipt and payment vouchers for at least 5 years for future post-audit by the State Administration of Foreign Exchange; in case of foreign exchange receipt and payment via offshore accounts, require the agent to assist in handling the compliance filing of offshore accounts to avoid account freezing.

### Answer 6

When entrusting a customs broker and freight forwarder to export overseas, focus on the legal clauses of the agency contract: first, clarify the scope of responsibility of the agent, including the responsibility division of links such as customs declaration, logistics and abnormality handling, to avoid shirking of responsibilities; second, add a force majeure clause as a guarantee, clarify the responsibility division for port congestion and delays caused by force majeure such as epidemics and port strikes; meanwhile, add an intellectual property customs protection filing clause, require the agent to assist in handling the intellectual property filing of the goods to avoid customs detention due to infringement; in addition, clarify the penalty clause, if cargo detention and port congestion are caused by the agent's fault, the agent shall bear the corresponding penalty and losses.

### Answer 7

When entrusting a customs broker and freight forwarder to export overseas, focus on the response to on-site customs inspection: first, require the forwarder to provide interpretation of the inspection notice in advance, and clarify the content and requirements of the inspection; second, ensure that the packaging of the goods is consistent with the customs declaration form, if wooden packaging is involved, ensure that the IPPC mark is clear and identifiable, so as to avoid container unloading inspection caused by inconsistent packaging; in case of abnormal machine inspection, require the agent to coordinate with on-site inspection personnel for manual re-inspection within 24 hours to avoid port congestion; in addition, keep all evidence such as photos and videos of the inspection for subsequent appeal; in case of sampling and appraisal, require the agent to assist in following up the appraisal process to ensure that the appraisal report is obtained within 7 days.

### Answer 8

When exporting overseas via customs broker and freight forwarder, focus on the compliant operation of export tax refund: first, ensure the consistency of the four streams, namely the consistency of contract stream, cargo stream, capital stream and invoice stream, to avoid tax inquiry caused by inconsistency of the four streams; second, conduct pre-declaration verification in advance, require the agent to submit pre-declaration data within 3 days after customs declaration to check tax refund risks; meanwhile, keep all tax refund documents for at least 10 years for future post-audit by tax authorities; in case of cross-month declaration, require the agent to complete the tax refund declaration before the 15th of the following month to avoid overdue; in addition, in case of foreign exchange verification problems, require the agent to assist in handling the supplementary declaration of foreign exchange verification to ensure that the tax refund is received smoothly.

### Answer 9

When entrusting a customs broker and freight forwarder to export overseas, focus on the overall optimization of the supply chain: first, reasonably choose trade terms, for exports to the US, give priority to the FOB trade term to transfer logistics risks to the buyer; second, optimize the inventory linkage strategy, reasonably arrange the production and port entry time of the goods according to the order delivery deadline, to avoid port congestion fees caused by early entry of goods into the port; meanwhile, establish a cost actuarial model, comprehensively consider costs such as customs declaration fees, logistics fees and taxes, and select the optimal customs broker and freight forwarder; in addition, optimize the international trade structure, if the export volume is large, you can require the agent to assist in establishing an overseas warehouse to reduce logistics costs and delivery time; note that the change of trade terms must comply with the contract agreement to avoid triggering legal disputes.
