# What core compliance procedures and key tax declaration points should be followed for accounting of agent-exported products?

## Question

I am the financial head of a small electromechanical manufacturing enterprise in Shanghai. This is the first time we have entrusted a foreign trade agency to handle export business. We only dealt with internal accounting before, and have no idea about the accounting logic for agent-exported products at all. The agency helped us ship a batch of goods last week, and today we received a bunch of documents including foreign exchange slips, customs declaration forms and agency agreements. We need to close accounts and file taxes at the end of the month, so I am really anxious. I heard from peers before that if the four flows are inconsistent in agent export accounting, it is very easy to face tax audits. We will not only fail to get the tax refund, but may also be fined. Our profit is already very thin, so we really cannot afford such losses. I would like to ask, under this agency mode, how should I keep accounts compliantly, coordinate with the agency on document management, and avoid those common tax risks?

### Answer 1 — Best Answer

First of all，you need to complete accurate pre-audit of documents，focusing on verifying the consistency of core information of the agency agreement，customs declaration form，foreign exchange slip and special VAT invoice: ensure that the product name and quantity on the customs declaration form fully match those on the VAT invoice，the foreign exchange receipt amount on the foreign exchange slip corresponds to the FOB price on the customs declaration form，and the charging items specified in the agency agreement are consistent with the invoice content，which is the core foundation of **four-flows consistency**.

Key accounting nodes shall be closely connected: First，for the foreign exchange receipt link，when receiving the payment transferred by the agency，you shall attach the **foreign exchange settlement split sheet** issued by the agency，debit "bank deposit" and credit "accounts receivable - agency company"，Second，for the tax refund link，when receiving the tax refund transferred by the agency，you shall attach the **income refund notice** issued by the tax refund authority，debit "bank deposit" and credit "other receivables - export tax refund"，Third，for the agency fee settlement，after obtaining the service invoice issued by the agency，debit "selling expenses - agency service fee" and credit "bank deposit".

Exception response plans shall be preset: If there is inconsistency in document information，you shall immediately require the agency to assist in modification and correction. For example，if there is an error in the customs declaration form information，you shall apply for modification within 10 days after export，If there is a delay in foreign exchange receipt，you shall submit the Detailed Form for Deferred Declaration of Export Foreign Exchange Receipt to the tax authority before declaring tax refund.

For the final compliance implementation，you shall ensure that all accounting vouchers are attached with complete documents，including agency agreement，copy of customs declaration form，foreign exchange slip，VAT invoice，tax refund voucher，etc。which shall be sorted and archived monthly for inspection by the tax authority.

### Answer 2

One of the core prerequisites for agent export accounting is the absolute accuracy of customs declaration information. If the product name, HS code, transaction method and other information on the customs declaration form are inconsistent with the actual goods or VAT invoice, it will not only lead to mismatch between revenue and cost during accounting, but also trigger the tax authority's inspection and early warning. Within 3 working days after the customs declaration is cleared, you shall require the agency to provide the original customs declaration form affixed with the customs inspection seal, check fields such as "domestic source of goods", "consignor and consignee", "production and sales unit" to ensure that they are consistent with the entrusting party information agreed in the agency agreement.

If any error is found in the customs declaration information, you shall immediately apply to the customs for deletion and re-declaration through the agency, so as to avoid invalid accounting vouchers caused by information lag, which will further affect the export tax refund declaration. In addition, you shall import the electronic data of the customs declaration form into the financial accounting system, and automatically match it with the VAT invoice and foreign exchange slip to reduce manual checking errors.

### Answer 3

In agent export business, logistics documents are important auxiliary vouchers for accounting, so you shall focus on the consistency of information between bill of lading, warehouse receipt, packing list and customs declaration form. The consignee and notify party information on the bill of lading shall be consistent with the overseas purchaser agreed in the agency agreement, the weight and volume of goods on the warehouse receipt shall correspond to those on the customs declaration form, and the goods details on the packing list shall match the VAT invoice.

In case of exceptions such as container rolling or port change, you shall require the agency to provide the port change certificate or container rolling notice issued by the logistics service provider, which shall be used as supporting materials for abnormal business during accounting, so as to avoid tax risks caused by inconsistency between goods circulation information and accounting records. In addition, you shall match logistics expense invoices (such as ocean freight, port miscellaneous fees) with the transaction method of the customs declaration form. For FOB transactions, ocean freight shall be separately included in selling expenses and shall not be counted into export revenue.

### Answer 4

For the accounting treatment of agent export business, you shall focus on the application of VAT deferral policy and tax compliance. If the agent-exported goods are eligible for EU VAT deferral, you shall require the agency to provide the VAT deferral application certificate, and list the deferred VAT amount separately during accounting, which shall not be included in export costs. In addition, you shall ensure that the pricing of cross-border related transactions conforms to the arm's length principle.

If there is an associated relationship between the entrusting party and the agency, the agency fee pricing shall refer to the industry average level, so as to avoid being identified as profit transfer by the tax authority due to excessively low or high pricing, which will lead to adjustment of taxable income. At the same time, you shall sort out the revenue, cost and expenses of agent export on a monthly basis, and declare export tax (exemption) refund to the tax authority in time, so as to avoid invalidation of tax refund qualification due to overdue declaration.

### Answer 5

Foreign exchange receipt and payment involved in agent export accounting shall strictly comply with regulatory requirements. If RMB cross-border payment is made through the CIPS system, you shall retain the CIPS message receipt as an accounting voucher to ensure that the foreign exchange receipt amount is consistent with the converted amount of the FOB price on the customs declaration form. If the agency transfers the payment after foreign exchange settlement, you shall require the agency to issue a foreign exchange settlement split sheet, specifying the settlement exchange rate, handling fee and transfer amount.

During accounting, the handling fee shall be included in financial expenses, and the transfer amount shall be included in accounts receivable. In addition, you shall check foreign exchange receipts and payments on a monthly basis to ensure that each foreign exchange receipt corresponds to the corresponding export customs declaration form, so as to avoid foreign exchange receipt without corresponding documents, which will trigger inspection by the State Administration of Foreign Exchange. In case of delayed foreign exchange receipt, you shall timely submit the delayed foreign exchange receipt filing application to the State Administration of Foreign Exchange to avoid being included in the abnormal list.

### Answer 6

The terms in the agency agreement directly affect the compliance of accounting. You shall specify the document delivery time limit of the agency in the agreement, requiring it to provide core documents such as customs declaration form and foreign exchange slip within 5 working days after the customs declaration is cleared, so as to avoid overdue accounting caused by document delay. In addition, you shall specify the time node of goods ownership attribution and transfer in the agreement, to ensure that the revenue recognition time during accounting is consistent with the goods ownership transfer time, and avoid early or delayed revenue recognition.

If the agency loses documents or provides wrong information, you shall agree on its liability for breach of contract in the agreement, to ensure that supplementary vouchers can be obtained in time when accounting exceptions occur. At the same time, the agency agreement shall be retained as an important original voucher, and archived together with accounting vouchers for inspection by the tax authority and the State Administration of Foreign Exchange.

### Answer 7

Agent export accounting shall strictly follow the requirement of four-flows consistency, that is, the information of goods flow, capital flow, invoice flow and contract flow shall be fully matched. You shall focus on verifying whether the issuer of the special VAT invoice is the production and sales unit indicated on the customs declaration form, whether the capital flow is from the overseas purchaser to the agency and then transferred to the entrusting party, whether the goods flow is from the production enterprise to the port and then sent overseas, and whether the contract flow covers the two-layer agreements between the entrusting party and the agency, and between the agency and the overseas purchaser.

During accounting, vouchers corresponding to the four flows (VAT invoice, foreign exchange slip, customs declaration form, agency agreement, overseas procurement contract) shall be sorted into volumes and retained for at least 10 years. If there is inconsistency in the four flows, you shall immediately adjust the accounting vouchers and submit a situation explanation to the tax authority, so as to avoid being identified as false export and then disqualified from tax refund.

### Answer 8

If the information of agent-exported goods is adjusted after on-site customs inspection, you shall adjust the accounting vouchers in time. If the customs modifies information such as product name and quantity on the customs declaration form after inspection, you shall require the agency to provide the customs declaration modification certificate issued by the customs, recheck the VAT invoice and the modified customs declaration information during accounting, and adjust the recorded amount of revenue and cost.

If the goods are deemed unqualified after inspection, you shall require the agency to provide the inspection failure notice issued by the customs, record the cost of the goods into non-operating expenses during accounting, and declare to the tax authority to transfer out the corresponding input tax amount. In addition, inspection-related documents (inspection notice, test report, modification certificate) shall be archived together with accounting vouchers as supporting materials for abnormal business, so as to avoid tax risks caused by inconsistent information.
