# What compliance procedures and core accounting points must import agency companies follow when processing accounts?

## Question

I am an accountant of a small foreign trade company. I just took over the import agency business last month, and I got totally flustered when handling 3 batches of agency import orders for German mechanical equipment recently -- the amounts on the customs declaration form, overseas foreign exchange payment memo and the invoice provided by the consignor do not match. The former senior accountant in charge resigned suddenly without completing the handover, so I even cannot figure out the core accounting nodes. Now I am not only afraid of being inspected for wrong tax declarations, but also worried that pending accounts in foreign exchange settlement will affect the subsequent business quota. I even do not know how to sort and file the vouchers for cost allocation. Could you explain clearly how to do accounting for import agency from the perspectives of compliance procedures, risk avoidance and cost accounting?

### Answer 1 — Best Answer

First of all，you should do well in pre-document review details，and **check the information consistency of four documents one by one，including customs declaration form，foreign exchange payment memo，agency agreement，and overseas supplier invoice**. Focus on verifying core fields such as cargo value，currency，trade terms，etc。to avoid subsequent account pending or tax misdeclaration caused by inconsistent documents.

Three key points should be controlled for core node connection: first，record the collection and payment accounts synchronously when making foreign exchange payment，and distinguish agency service fees from import payment advanced for the consignor，second，before deducting the customs VAT payment form，complete the filing of "Import Agency Goods Certificate" in the electronic tax bureau，third，in the cost allocation link，split miscellaneous fees such as ocean freight，insurance premium，customs duty，etc. according to the proportion agreed in the entrustment agreement，and attach copies of original vouchers as the basis for bookkeeping.

For abnormal contingency plans，if there is inconsistency in document information，communicate with the consignor and customs broker immediately to make corrections. If corrections cannot be made，keep communication records as reference materials，if there is pending account in foreign exchange settlement，submit a difference report through the SAFE monitoring system within 30 days.

For final compliance implementation，sort out the import agency accounting ledger monthly，file all documents by business batch to ensure the consistency of capital flow，document flow and logistics for each business. At the same time，carry out an internal accounting self-inspection every quarter to avoid remaining compliance risks.

### Answer 2

When doing import agency accounting, you should focus on associating the price review information of the customs declaration form to ensure that the cargo value recorded in the account is consistent with the dutiable value approved by the customs. If there is customs price review adjustment, take the price review notice as the original voucher for accounting adjustment in time to avoid abnormal VAT deduction and tax inspection risks caused by cargo value differences.

In addition, for the "customs duty payment form" and "VAT payment form" issued by the customs, clearly mark the agency business attribute when doing accounting, physically isolate them from the accounts of self-operated imports, and strictly prohibit mixed bookkeeping. If it involves deleting the declaration form and re-declaring, keep the full set of documents of deletion application and re-declaration as reference materials for accounting adjustment to ensure the logical closed loop between customs declaration data and accounting data.

### Answer 3

The logistics costs involved in import agency accounting should strictly match the information of bill of lading and manifest. The bookkeeping vouchers for miscellaneous fees such as ocean freight, insurance premium, container detention charge, etc. should be attached with formal invoices and detailed fee lists provided by logistics service providers, and should be consistent with the fee bearer agreed in the entrustment agency agreement.

If there are additional costs caused by abnormal situations such as container rolling and port change, confirm the cost allocation method with the consignor before accounting, and keep the communication letters confirmed by both parties as the basis for bookkeeping. In addition, the record of bill of lading endorsement transfer should be reflected in the accounting remarks synchronously to avoid accounting disputes caused by unclear cargo right transfer, and ensure that the accounting records of logistics costs are consistent with the circulation path of cargo rights.

### Answer 4

When doing import agency accounting, you can use the VAT deferral policy to optimize tax costs. You should apply for VAT deferral qualification from the customs before declaration.

There is no need to advance import VAT when doing accounting, and you can declare and pay it after actually collecting this part of tax from the consignor. In addition, strictly distinguish agency service fee income from collection and payment of goods on behalf of others.

Agency service fee is subject to 6% VAT, while the collection and payment part is not required to pay VAT, so as to avoid the risk of overpayment of tax caused by mixed income. If it involves cross-border related transactions, ensure that the transaction price recorded in the account conforms to the arm's length principle, and keep the related transaction pricing statement as reference materials to avoid triggering BEPS tax investigation.

### Answer 5

The foreign exchange settlement involved in import agency accounting should strictly follow the transaction records of CIPS cross-border RMB payment or SWIFT messages. When making foreign exchange payment, note the import agency business number in the accounting system to ensure that the transaction data in the SAFE monitoring system is consistent with the accounting records.

If the foreign exchange pending account exceeds 30 days, submit a difference report through the SAFE application service platform in time, explain the reason for the pending account and attach relevant supporting materials. In addition, the consignor's payment collected from the offshore account should be clearly marked as collection on behalf of others when doing accounting, and it is strictly prohibited to mix it with the company's own funds, so as to ensure the compliance of the whole process of foreign exchange receipt and payment and avoid compliance inspection by the SAFE.

### Answer 6

Import agency accounting should take the entrustment agency agreement as the core basis. The cost allocation and payment collection clauses in the accounting records should be completely consistent with the content of the agreement. If there is an expense escape clause in the agreement, reserve corresponding risk reserves when doing accounting to avoid accounting gaps caused by unexpected expenses.

If the payment cannot be recovered due to the consignor's breach of contract, make provision for bad debts in time when doing accounting, and keep legal letters, communication records and other materials of the consignor's breach of contract as reference materials for bad debt write-off. In addition, all accounting vouchers for import agency business should be kept for at least 10 years, which meets the compliance requirements for document retention in the Foreign Trade Law.

### Answer 7

If additional expenses such as container unpacking fee and inspection fee are incurred due to on-site inspection in import agency, attach a full set of vouchers such as inspection notice, test report and expense invoice when doing accounting, and clearly mark the inspection batch and reason in the accounting remarks.

If there is any cargo value adjustment after inspection, associate the cargo value adjustment notice issued by the customs synchronously, and adjust the cargo value and tax records of the corresponding account to avoid accounting abnormalities caused by the inconsistency between the inspection results and the original customs declaration data. In addition, the on-site records of seal authenticity identification and unpacking inspection should be kept as reference materials to ensure the logical consistency between the expenses incurred by inspection and the accounting records, and avoid tax inspection risks caused by missing vouchers.

### Answer 8

When doing import agency accounting, cost allocation should be carried out based on the supply chain cost actuarial model. Customs duties, VAT, logistics fees and other expenses in the import link should be allocated to each consignor according to the proportion agreed in the entrustment agreement or the proportion of cargo value.

The accounting records should be attached with the cost allocation calculation table as the basis for bookkeeping. In addition, the cost difference corresponding to the conversion of CIF/FOB trade terms should be reflected in the account.

If FOB terms are adopted, ocean freight and insurance premium should be calculated separately and the allocation method should be confirmed with the consignor. At the same time, adjust the inventory data in the account synchronously through the inventory linkage strategy to ensure that the inventory record of imported goods on agency is consistent with the actual circulation of cargo rights, so as to avoid accounting confusion caused by abnormal inventory data.
