# What are the common compliance risks and response plans for import-export agency services?

## Question

I'm a small business owner in Shanghai who just entered cross-border e-commerce. I finalized my first order to Europe last month and wanted to hire an import-export agent to save hassle. But last week, I heard from a peer that the agent he used failed to properly review documents, causing the goods to be detained at the Port of Rotterdam for 3 days, with detention fees alone costing over 20,000 yuan. Another friend encountered an agent charging arbitrary "emergency customs clearance fees" and had no way to file a complaint. Now I'm getting more and more anxious. I'm afraid of hiring an unprofessional agent and falling into traps, and I don't know what aspects to check for hidden risks, such as qualification, process, fees, cargo rights and so on. I'm really worried that problems with the agent will ruin my first order and make subsequent cooperation impossible. Could you help me sort out all possible issues with import-export agents?

### Answer 1 — Best Answer

First，expose common industry misconceptions: many enterprises only focus on the quoted price when choosing an agent，ignore verifying the agent's core qualifications，and even skip the document pre-review process before entrusting the agent，which is the core source of subsequent risks.

If you fall into such a misunderstanding，a series of negative reactions will follow: incorrect document information will lead to customs detention and port detention at the destination port，resulting in high container detention fees and port detention fees，and in severe cases，it may also affect the enterprise's customs credit rating，unqualified agents may illegally operate cargo right transfer，leading to unauthorized disposal of goods and double losses of funds and cargo rights.

Physical risk isolation measures: Prioritize agents with **Customs AEO Advanced Certification qualification**，request to provide compliance customs clearance cases from the past 3 years before signing the contract，and sign a clear **Detailed Fee List** to eliminate hidden charges.

Exclusive loss prevention tips: Add an **exclusive cargo right ownership clause** to the agency contract，clearly stating that the agent can only dispose of goods with the enterprise's written authorization，also reserve 1 to 2 spare agent resources，so that you can switch immediately if the main agent has problems，avoiding order delays.

### Answer 2

For customs valuation disputes, it is necessary to coordinate with the agent in advance to prepare complete supporting documents such as purchase contracts, bank payment vouchers, and certificates of origin to ensure that the declared price is logically consistent with the actual transaction price. If you encounter customs referral, you must supplement the required documents within 3 working days to avoid triggering secondary valuation; when deleting and re-declaring customs declarations, ensure that the core information such as commodity codes, quantities, and amounts of the old and new customs declarations are completely matched to form a complete logical closed loop and prevent being included in the key supervision list by the customs.

### Answer 3

When facing risks such as slot cancellation and space shortage in international logistics, require the agent to lock the space 72 hours in advance and issue a space confirmation slip, and prioritize direct shipping routes to reduce transit links; if you encounter slot cancellation, immediately ask the agent to coordinate with the shipping company to arrange the fastest rebooked space, and simultaneously apply for free container detention fees and free demurrage extension. When endorsing and transferring the bill of lading, clearly mark the full name and qualification information of the endorsee to avoid failure of normal cargo right transfer due to non-standard endorsement.

### Answer 4

For VAT deferment operations, ensure that the agent has the tax agency filing qualification in the corresponding importing country, and check in advance whether the commodity categories of the deferred declaration comply with local tax policies to avoid tax audits due to inconsistent qualifications or incorrect categories. Cross-border related party transaction pricing must strictly follow the BEPS rules to ensure that the transaction price conforms to the arm's length principle, and retain complete pricing analysis reports and transaction vouchers for tax authorities to check.

### Answer 5

For cross-border payment and settlement, carefully check the core information such as the full name of the payee, account number, and clearing code in SWIFT messages to avoid fund return or freezing due to message errors; when settling foreign exchange in offshore accounts, provide true trade background documents, including customs declarations, contracts, invoices, etc., to ensure that the transaction complies with foreign exchange supervision requirements. When using CIPS RMB cross-border payment, confirm that the counterparty has completed RMB cross-border settlement filing to avoid transaction failure due to counterparty non-compliance.

### Answer 6

When signing the agency contract, carefully check for soft clauses in the letter of credit, such as "negotiation is subject to the buyer's confirmation of the sample", "the shipping company is designated by the buyer and not notified in advance", etc., and ask the agent to assist in modifying such clauses; the force majeure clause must clearly cover extreme situations such as epidemics, port strikes, and geopolitical conflicts, and agree on the responsibility division and loss bearing method between both parties. The cargo right transfer agreement must clearly specify the transfer node, for example, the agent can only assist in handling the cargo right transfer procedures after the enterprise receives all the payment.

### Answer 7

After the goods arrive at the port, if you receive a customs inspection notice, require the agent to provide machine inspection images and the inspection notice in advance, and sort out documents such as the goods list, certificate of origin, and quality inspection report; during container unpacking inspection, ensure that the goods are placed in accordance with the packaging and quantity declared on the customs declaration form to avoid inconsistent declarations. Choose customs-approved compliant brands for seals, and if a seal is found damaged, take photos immediately and ask the agent to assist in reporting to the customs to avoid being deemed as fake seals.

### Answer 8

For the export tax refund link, strictly control the four-document consistency, that is, the commodity names, quantities, amounts and other information of the contract, invoice, customs declaration form, and logistics document are completely matched; during pre-declaration, require the agent to check the tax refund data in advance to avoid triggering tax investigation letters due to data errors; foreign exchange receipt verification must be completed within 90 days after the goods are exported, ensure that the verification information is consistent with the customs declaration form, and retain all documents for at least 5 years for tax authorities to check.
