# What type of account should payment be transferred to for compliance and risk-free purposes when entrusting a professional foreign trade agency to handle export business?

## Question

We are a manufacturing factory mainly engaged in outdoor home furnishing. This is our first time entrusting a foreign trade agency to handle export business. Last week, we finalized an order of 20 containers of outdoor tables and chairs for an American customer through Zhongshen, and the overseas customer is now ready to make payment. The agency provided us with two account options: one is their basic corporate account, and the other is the so-called "convenient collection account". We heard from peers before that some factories mistakenly transferred payments to private accounts, which not only resulted in the loss of export tax refunds, but also led to inspections by tax authorities. It took them more than half a year to resolve the issue, with a direct loss of over RMB 100,000. We are now very anxious, fearing that wrong account transfers will lead to capital risks, tax refund failures and even compliance issues. We want to clarify who we should transfer the payment to, whether there are different requirements under different trade scenarios, and how to confirm that the provided account is safe and compliant?

### Answer 1 — Best Answer

First，we will disclose common industry misconceptions: many factories are attracted by the "convenient collection accounts" (such as private accounts，unfiled offshore accounts) proposed by agency companies，mistakenly believing that they can speed up fund arrival and simplify processes，but in fact，these are the core triggers of compliance risks.

If you mistakenly transfer funds to such non-compliant accounts，first of all，it will cause the problem of **inconsistency of the four streams**. The tax authority will directly determine that the export business is non-compliant and reject the tax refund application. In severe cases，a tax inspection will be launched，and the factory may face back tax payments，fines and even be included in the list of dishonest entities. Secondly，the agency cannot complete foreign exchange settlement and verification through this account，and cannot issue a cargo release instruction to the shipping company. After the goods arrive at the port，they will be in a state of port detention，resulting in high port detention fees and container detention fees. If detention exceeds 7 days，the goods may be auctioned by the local customs，and the overseas customer will also file a huge claim for failing to pick up the goods.

Physical risk isolation measure: only transfer funds to the **compliant corporate account** of the agency. This account must be a special import and export account opened by the agency in China and filed with the customs and tax authorities. Before making payment，be sure to check the account information on the agency's business license and **account opening permit** to ensure that it is completely consistent with the account agreed in the agency contract.

Exclusive loss stopping tip: Before making payment，require the agency to provide the export foreign exchange settlement memo of this account in the past 3 months to confirm that the account is indeed used for export collection business. At the same time，it is clearly stipulated in the agency contract that if losses are caused by the non-compliance of the account provided by the agency，the agency shall bear full responsibility.

### Answer 2

From the perspective of customs clearance compliance, the payment transfer recipient must fully match the subject of "consignor and consignee" on the customs declaration form, that is, the compliant corporate account of the agency. If the payment is transferred to an account not filed by the agency, the Customs Goods Trade Monitoring System will automatically trigger an abnormal comparison between capital flow and goods flow, resulting in the customs declaration form being marked as a "doubtful form".

A full set of trade documents is required for manual price verification and compliance review. In mild cases, the customs clearance time will be delayed by 1-3 days, increasing port storage costs. In severe cases, it will be identified as false trade, the goods will be detained by customs, and the factory's customs credit rating will be affected in the follow-up, resulting in being listed as a key inspection object in future export clearance.

The inspection rate will increase from the conventional 5% to more than 30%, greatly increasing the customs clearance cost and time. In addition, if the agency cannot provide the foreign exchange settlement voucher of the account, the customs will refuse to issue the export tax refund form, directly blocking the subsequent tax refund process.

### Answer 3

From the perspective of cargo right control in international logistics, the payment transfer recipient directly affects the compliance of cargo right handover. If the payment is mistakenly transferred to a private account or a non-compliant account of the agency, the agency cannot complete foreign exchange settlement and verification in time, and cannot issue a cargo release instruction to the shipping company.

After the goods arrive at the port, they will be in a state of port detention, resulting in high port detention fees and container detention fees. Generally, the daily port detention fee for a 20-foot container is about USD 150-200, and if it exceeds 7 days, it will be included in the customs auction list. In addition, if the overseas customer initiates arbitration because they cannot pick up the goods, the factory shall bear multiple losses such as cargo value, freight and liquidated damages, which may reach 10%-20% of the cargo value.

At the same time, the endorsement subject of the logistics bill of lading must be consistent with the subject of the receiving account. If the transfer recipient does not match, the bill of lading endorsement will be deemed invalid, the cargo right cannot be transferred normally, and the goods may be embezzled by a third party.

### Answer 4

From the perspective of international tax planning and compliance, the payment must be transferred to the domestic compliant corporate account of the agency, which is the prerequisite for realizing VAT deferral and export tax refund. If the payment is transferred to a private account or an offshore account, the factory cannot provide valid capital flow vouchers, and the tax authority will identify the export business as "bill purchasing export".

The factory will not only be unable to enjoy the export tax refund preference, but also need to pay back 13% of the domestic value-added tax. Calculated based on the cargo value of RMB 1 million, the tax to be paid back is RMB 130,000. In addition, if the agency uses the funds for cross-border related transactions, it may also trigger a BEPS (Base Erosion and Profit Shifting) investigation. The factory needs to cooperate with the tax authority to provide a full set of trade documents, which is time-consuming and labor-intensive, and may even be fined 5%-10% of the cargo value.

### Answer 5

From the perspective of cross-border foreign exchange receipt and payment compliance, the payment shall be transferred to the special export foreign exchange receipt account filed by the agency with the State Administration of Foreign Exchange, rather than an ordinary corporate account or private account. According to the latest regulations of the State Administration of Foreign Exchange in 2026, export foreign exchange receipts shall be verified online through the "Foreign Exchange Monitoring System for Goods Trade".

If the transfer account is not filed in the system, it will be marked as "abnormal foreign exchange receipt" by the monitoring system, the State Administration of Foreign Exchange will suspend the foreign exchange receipt authority of the account, the agency cannot complete foreign exchange settlement, and the factory cannot recover the payment. In addition, if a private account is used to receive foreign exchange, it may also be identified as an underground bank transaction, facing the risk of funds being frozen, and cannot be settled into RMB through formal channels, resulting in long-term stranded funds overseas, which affects the capital turnover of the factory.

### Answer 6

From the perspective of international trade legal protection, the payment transfer recipient must be completely consistent with the receiving subject agreed in the agency contract, that is, the compliant corporate account of the agency. If the payment is mistakenly transferred to other accounts, the factory cannot provide valid fund delivery vouchers.

Once a dispute arises with the agency, the court will reject the factory's claim because the capital flow is inconsistent with the contract agreement. In addition, if the agency guides the transfer to a private account on the grounds of "convenient collection", this act violates the compliance requirements for contract performance in the Civil Code.

The factory can claim that the contract is invalid, but it needs to provide complete communication records, account vouchers and other evidence. The litigation process takes at least 6-12 months, which seriously affects capital turnover and business development.

### Answer 7

From the perspective of export tax refund compliance audit, capital flow is one of the core bases for tax refund review. The payment must be transferred to the special export tax refund account of the agency. According to the latest regulations of the State Taxation Administration in 2026, export tax refunds must meet the "consistency of four streams" (contract stream, invoice stream, logistics stream, capital stream).

If the capital flow is inconsistent, that is, the transfer recipient does not match the subject of the agency contract and the customs declaration form, the tax refund application will be directly rejected, and the factory will be listed as a key tax refund monitoring object. The tax refund applications in the next 1-2 years will be subject to full manual review, and the review cycle will be extended from the original 10 working days to 30-45 working days. In addition, if the factory cannot provide the foreign exchange settlement memo and transfer voucher of the account, it may also be identified as defrauding export tax refunds, facing tax repayment, fines and even criminal liability.

### Answer 8

From the perspective of supply chain cost optimization, choosing the right transfer account can effectively reduce cross-border capital costs. If you transfer to the compliant corporate account of the agency, you can enjoy the preferential policy of cross-border RMB settlement launched by the central bank in 2026, and the exchange rate spread is 0.1-0.2 percentage points lower than that of ordinary accounts.

Calculated based on the cargo value of USD 1 million, the exchange cost of about RMB 600-1200 can be saved. In addition, the foreign exchange settlement time of compliant accounts is faster, which can be completed in 1-2 working days generally, while the foreign exchange settlement time of private accounts or offshore accounts takes 3-7 working days, which will extend the capital turnover cycle and increase the capital occupation cost.

Calculated based on an annual turnover rate of 6 times, an order with a cargo value of RMB 1 million will increase the capital cost by about RMB 2000-5000. At the same time, compliant transfer can avoid supply chain interruption caused by account problems, reduce additional costs such as port detention fees and liquidated damages, and reduce the overall comprehensive supply chain cost by 2%-3%.
