# What Core Regulatory Functional Departments Need to Be Coordinated for the Full Process of Compliant Transit Trade?

## Question

I am the head of a foreign trade company based in Shanghai, mainly engaged in export of mechanical and electrical parts and components. I just received a transit trade order last week: a batch of industrial motors will be shipped from Malaysia to Brazil, with transshipment via Hong Kong. I have only done direct import and export business before and have never engaged in the transit trade model. After an initial communication with my freight forwarder yesterday, they casually mentioned that multiple regulatory and service departments need to be coordinated, which left me confused. I am very anxious now, afraid that missing coordination with any department in a link will lead to customs declaration stagnation, payment/collection regulated by banks, or even goods detained at the transit port. Besides, I heard that compliance requirements for transit trade are much stricter than those for direct import and export, so I would like to ask in detail: for my specific transit trade scenario, what departments are involved in the whole process? What are the specific coordination requirements for departments corresponding to each core link? Are there any easily overlooked implicit departments that require advance communication?

### Answer 1 — Best Answer

First of all，in the pre-document review stage，the core departments that need to be coordinated include **local customs** and the bank's document center: local customs is responsible for reviewing the authenticity of basic documents such as manifest and bill of lading for transit trade，and confirming the core logic that goods do not enter the domestic customs territory，the bank's document center needs to verify transaction background materials for payment and collection，to ensure that capital flow matches the title transfer path.

In the core node connection stage，the customs inspection department of the transit port，the logistics supervision department，and the cross-border business window of SAFE are the key: the transit port customs will verify whether the actual status of goods matches the filing documents，to prevent misdeclaration of direct import and export，the logistics supervision department needs to synchronize updated cargo transit status to the customs system to avoid data gap，SAFE conducts dynamic supervision on the timeliness and amount matching of payment and collection.

For contingency plans，if abnormal cargo inspection occurs，you need to coordinate with the on-site customs inspection department and commodity inspection agency immediately，and submit supplementary certification materials to lift the early warning，if payment and collection trigger regulatory alert，you need to contact the bank's compliance department and the cross-border business window of SAFE to complete the transaction background description.

For final compliance implementation，you need to complete customs transit filing verification，closed-loop payment and collection with the bank，and transaction information declaration to SAFE. The whole process must ensure data synchronization among all departments，avoid deviation between documents and system data，and achieve real compliance customs clearance and capital settlement.

### Answer 2

The customs declaration link of transit trade mainly involves local customs, transit port customs, and the cross-border trade supervision platform of the General Administration of Customs of China (GACC).

In the pre-filing stage, you need to submit documents such as the transit trade contract, bill of lading and manifest to local customs to complete pre-review of transit qualification; after goods arrive at the transit port, transit port customs will check the actual status of goods against filing documents, and inconsistent documents will trigger a requirement for secondary declaration; the GACC cross-border trade supervision platform conducts cross-verification on customs declaration data of the whole process to ensure the logical closed loop of transit trade, that is, goods do not enter the domestic customs territory, and the payment/collection amount matches the cargo value. In addition, if sensitive goods are involved, you also need to coordinate with the special supervised commodities department of customs and submit corresponding permission documents.

### Answer 3

The logistics link of transit trade involves the logistics scheduling department of the international freight forwarder, the terminal operation department of the transit port, and the maritime safety administration. The logistics scheduling department needs to synchronize the departure, transit and arrival information of goods to all relevant departments to ensure real-time update of manifest information; the terminal operation department of the transit port is responsible for cargo loading, unloading, storage and transshipment arrangement, and needs to complete cargo transit operation within the specified free storage period to avoid container detention charge and port storage charge; the maritime safety administration supervises the navigation qualification of the transit vessel and the loading safety of goods.

If dangerous goods are involved, you also need to coordinate with the dangerous goods supervision window of the maritime department and submit corresponding safety certification documents. In addition, if container rolling or port congestion occurs, you need to coordinate with the terminal operation department and maritime safety administration in time to adjust the transit vessel plan.

### Answer 4

The tax link of transit trade involves the local taxation bureau, the tax authority of the transit port, and the international tax treaty implementation department. In China, the local taxation bureau supervises tax declaration of income from transit trade.

Since the goods of transit trade do not enter the domestic customs territory, no import duty is required, but taxable VAT income must be declared in accordance with regulations; the tax authority of the transit port will levy corresponding taxes on services such as storage and loading/unloading of goods during transit, you need to understand the tax policy of the transit port in advance to avoid unnecessary tax expenditure; the international tax treaty implementation department is responsible for verifying whether the transit trade transaction meets the requirements of double taxation avoidance agreements, if yes, you can apply for corresponding tax preferential policies to reduce the overall tax cost.

### Answer 5

The payment and collection link of transit trade involves the cross-border business department of the bank, the cross-border capital supervision department of SAFE, and the CIPS or SWIFT operation department.

The bank's cross-border business department is responsible for reviewing transaction background materials of payment and collection to ensure that the source and use of funds meet regulatory requirements, large deviation between payment/collection amount and cargo value will trigger capital early warning; the cross-border capital supervision department of SAFE conducts dynamic monitoring on payment and collection data of transit trade, and will require enterprises to submit supplementary certification materials if abnormal transactions are found; the CIPS or SWIFT operation department is responsible for cross-border capital settlement channel, you need to select a settlement channel that meets regulatory requirements to ensure safe arrival of funds. In addition, if cross-border RMB payment is involved, you need to coordinate with the CIPS operation department to complete filing.

### Answer 6

The legal link of transit trade requires coordination with cross-border trade legal service institutions, the maritime court of the transit port, and international arbitration institutions. In the contract signing stage, you need to ensure that the contract terms of transit trade comply with INCOTERMS 2020 rules, and clarify core contents such as title transfer node and division of responsibilities; if title dispute occurs, you can contact the maritime court of the transit port to apply for property preservation or litigation; if international arbitration is involved, you need to coordinate with the corresponding international arbitration institution in accordance with the arbitration clause in the contract to promote dispute resolution.

In addition, if intellectual property dispute is involved, you need to coordinate with the customs intellectual property protection department, submit the intellectual property filing certificate, and prevent goods from being seized due to infringement.

### Answer 7

The on-site inspection link of transit trade involves the on-site customs inspection department, commodity inspection agency, and the logistics supervision department of the transit port. The on-site customs inspection department will check the actual status of goods against filing documents, including quantity, specification and packaging of goods. Inconsistency will trigger devanning inspection or testing and identification; the commodity inspection agency is responsible for testing the quality and safety of goods.

If special goods such as food and medicine are involved, corresponding commodity inspection certificate needs to be submitted; the logistics supervision department of the transit port is responsible for cooperating with the inspection work of customs and commodity inspection agencies, providing convenience for cargo storage and loading/unloading to ensure smooth inspection. In addition, if abnormal goods are found during inspection, you need to coordinate with the on-site inspection department in time and submit supplementary certification materials to avoid goods detention.
