# What core customs rules must be followed when filling in the country of origin for goods in entrepot trade?

## Question

I am the person in charge of a small and medium-sized foreign trade enterprise engaged in entrepot trade in Southeast Asia. Recently, a batch of rubber products purchased from Thailand and transshipped via Singapore to the EU was detained by customs because the country of origin was filled in as Singapore, resulting in port detention fees and customer claims. I used to think that the transit country was the country of origin, but now I don't know how to fill it in correctly. I'm worried that there will be problems with subsequent orders, and I want to know what standards should be followed to fill in the country of origin in entrepot trade. Are there special rules for different transit situations? Is there a way to avoid such errors in advance?

## Answers

### Answer 1 — Best Answer

The common mistake when filling in the country of origin in entrepot trade is to directly mark the transit country as the country of origin，ignoring whether the goods have undergone substantial processing in the transit link. Such errors will trigger abnormal customs document review，directly lead to customs detention and port congestion of the goods，resulting in additional costs such as container detention fees and port detention fees，and even trigger customer claims due to delayed delivery.

If the goods are only simply stored，repackaged or reboxed in the transit country without changing the physical form of the goods or increasing their core value (such as the first four digits of the tariff code remaining unchanged)，the country of origin should be marked as the actual production location of the goods. For example，for rubber products purchased from Thailand and transshipped via Singapore，if there is no processing in the Singapore link，the country of origin should be filled in as Thailand.

Physical risk isolation measures include: obtaining the goods' certificate of origin (such as FORM E) in advance，obtaining the non-processing certificate issued by the customs of the transit country，and ensuring that the path marking on the bill of lading is consistent with the country of origin information. These materials can form a complete document chain to prove the compliance of the transit link.

**Exclusive Risk Mitigation Tips**: If a labeling error has occurred，immediately submit the certificate of origin，logistics documents for the transit link and a description of the processing situation to the customs to apply for deleting the declaration and re-declaring. At the same time，communicate with the customer about the delay cause and provide the customs acceptance certificate to reduce claim losses. In addition，it is recommended to adopt pre-declaration verification in subsequent orders，and check the country of origin information with the customs broker in advance to avoid repeated errors.

### Answer 2

Chief Customs Broker: The filling of the country of origin in entrepot trade must strictly follow the "Regulations of the People's Republic of China on the Origin of Import and Export Goods" and relevant customs regulations of the target country. If the goods have not undergone substantial transformation in the transit country (that is, the first four digits of the tariff code have not changed), the country of origin should be marked as the production location of the goods.

When declaring to customs, the certificate of origin, storage or transportation documents for the transit link shall be submitted to prove that there is no processing in the transit link. In case of price review disputes, the authenticity of the country of origin shall be verified through a closed-loop document logic chain (such as purchase contracts, invoices, certificates of origin, transit bills of lading).

### Answer 3

Senior Logistics Expert: The filling of the country of origin in entrepot trade must match the logistics path. If the goods are transshipped or reboxed in the transit country, ensure that the country of origin information on the bill of lading is consistent with the certificate of origin, so as to avoid customs suspicion due to the inconsistency between the path and the marking.

When choosing a transit plan, give priority to ports with clear non-processing certificate services, such as the Port of Singapore, which can provide a non-processing statement for transit goods, which helps to reduce the compliance risk of country of origin labeling. In addition, when endorsing and transferring the bill of lading, confirm that the country of origin information has not been tampered with to ensure the consistency of documents during the transfer of cargo rights.

### Answer 4

Senior Tax Advisor: The labeling of the country of origin in entrepot trade will affect cross-border tax planning. If the target country has tariff preferences for goods from a specific country of origin, correct labeling can enjoy tax rate reductions; conversely, incorrect labeling may lead to overpayment of tariffs or trigger tax investigations.

For example, the EU's tariff preferences for goods originating in ASEAN require a FORM E certificate, and incorrect country of origin labeling will make it impossible to enjoy the preferences. In addition, the country of origin information is related to related party transaction pricing, and the labeling must be consistent with the essence of the transaction to avoid BEPS-related risks.

### Answer 5

Trade Compliance Expert: The labeling of the country of origin in entrepot trade must be consistent with the foreign exchange receipt and payment documents. The country of origin information in the SWIFT message should be synchronized with the customs declaration form and invoice to avoid rejection of foreign exchange settlement or investigation by the foreign exchange supervision department due to inconsistent information.

When using CIPS RMB cross-border payment, the country of origin information must be accurately entered to ensure the logical matching of capital flow and cargo flow. In addition, in offshore account management, incorrect country of origin labeling may trigger the risk of account freezing, and it is necessary to regularly check document information.

### Answer 6

Foreign Trade Legal Expert: The entrepot trade contract must clearly specify the liability clauses for country of origin labeling to avoid losses caused by incorrect labeling by third-party transit merchants. If the letter of credit soft clause involves country of origin requirements, ensure that the document labeling fully complies with the letter of credit regulations to prevent refusal of payment.

In addition, in the customs protection record of intellectual property rights, the country of origin information is an important basis, and incorrect labeling may affect the validity of the record, which needs to be handled carefully.

### Answer 7

On-site Inspection Expert: During on-site customs inspection, the customs will focus on checking whether the country of origin labeling is consistent with the actual situation of the goods. If an incorrect labeling is found, the customs will require the submission of documents such as the certificate of origin and transit processing records.

When responding to the inspection, prepare relevant documents in advance and truthfully explain the situation of the transit link to avoid more severe penalties caused by concealing information. In addition, during the machine inspection, the image characteristics of the goods must match the country of origin labeling, and any differences will trigger manual inspection.

### Answer 8

Export Tax Refund Audit: If entrepot trade involves export tax refund, the country of origin labeling must be consistent with the tax refund documents. During tax investigation, the consistency of the country of origin information with the purchase contract and invoice will be checked, and any contradictions will affect the tax refund progress.

In addition, in the four-flow consistency check, the country of origin information is an important part of the cargo flow, and the labeling must be accurate to avoid tax refund rejection or tax investigation.
