# What core documents and audit details are required for acting as an agent for Indian car exports?

## Question

I am the head of a small and medium-sized enterprise (SME) mainly engaged in auto parts imports. I recently tried to expand into the Indian complete vehicle export agency business but am totally at a loss. Last week, I reached a preliminary agency agreement with a supplier in New Delhi, India for a batch of SUVs, and the supplier promised to provide vehicle documents. However, I heard from peers that Indian documents often have hidden defects. Last year, a friend's cargo was detained at Mumbai Port due to mismatched VIN codes, resulting in over RMB 100,000 in port detention fees. In terms of logistics, the container rejection rate at Indian ports is alarmingly high, and I have no idea how to secure cargo rights. Regarding taxes, I know nothing about VAT deferral and withholding tax issues in cross-border auto trade, and I am afraid of paying unnecessary taxes. I can't sleep well at night for fear of falling into traps, and I want to know where to start when acting as an agent for Indian car exports and how to avoid these risks?

## Answers

### Answer 1 — Best Answer

Acting as an agent for Indian car exports requires risk control starting with pre-document review. First，verify the core documents provided by the supplier，including Certificate of Conformity (COC)，VIN code certification，commercial invoice，packing list and export license，etc. Special attention should be paid to whether the COC meets the environmental and safety standards of the importing country，and the VIN code must be completely consistent with the actual vehicle to avoid customs detention caused by hidden defects in documents. It is recommended to require the supplier to provide scanned copies of all documents before signing the agency agreement，and have a professional team conduct a pre-review before proceeding with the transaction.

Logistics route selection needs to balance efficiency and cargo right control. The container rejection rate at major Indian ports such as Mumbai and Chennai is relatively high. Prioritizing direct shipping routes can reduce risks in transit links，if transit is required，choose reputable shipping companies such as Maersk and Mediterranean Shipping Company (MSC). In terms of cargo right control，it is recommended to use "order bill of lading" instead of "straight bill of lading" to flexibly transfer cargo rights when needed. At the same time，negotiate with the shipping company to extend the free detention period to 14 days to avoid high container detention fees caused by port congestion.

Tax planning can effectively reduce costs. VAT on Indian exported goods can be applied for deferred payment，and it is necessary to file with the Indian tax authorities in advance and ensure that all documents are complete，using the China-India tax treaty，the withholding tax rate on income derived from India by non-resident enterprises can be reduced to 10% (subject to the beneficial owner condition). However，it should be noted that all planning schemes must comply with the BEPS rules to ensure that the transaction has commercial substance.

The customs declaration link requires advance preparation to respond to valuation disputes. Customs often conduct valuation based on the prices of similar goods in the same period. It is recommended to collect the export transaction prices of similar vehicles within 3-6 months in advance as a reference，and prepare supporting materials such as trade contracts and payment receipts. If a dispute occurs，communicate with the customs through a professional customs declaration team，provide sufficient evidence to support the reasonableness of the declared price，and apply for price consultation if necessary.

### Answer 2

Valuation disputes during Indian car export customs declaration can be resolved in the following ways: First, collect export customs declarations, commercial invoices and payment vouchers of similar vehicles in the same period in advance as price reference basis; second, if the customs questions the declared price as too low, provide a detailed cost breakdown, including vehicle purchase price, transportation fees, insurance premiums, etc.; third, if the dispute cannot be resolved through regular communication, apply for customs price consultation or entrust a third-party institution for price assessment. In addition, ensure that the declared price is consistent with the market situation to avoid customs suspicion caused by abnormal prices.

### Answer 3

Logistics route optimization for Indian car exports requires attention: prioritize direct shipping routes to reduce the risk of container rejection during transit; choose shipping companies with stable schedules, such as Maersk and Mediterranean Shipping Company; in terms of cargo right control, use "order bill of lading", which requires endorsement to pick up the goods, to avoid loss of cargo rights.

If port congestion is expected, negotiate with the shipping company in advance to change the port or extend the free detention period to reduce container detention fees and port detention fees. At the same time, closely monitor port dynamics and adjust logistics plans in a timely manner.

### Answer 4

Tax planning schemes for Indian car export agencies: First, VAT deferral: VAT on Indian exported goods can be applied for deferred payment, and an application needs to be submitted to the Indian tax authorities with export documents provided; second, use the China-India tax treaty to reduce the withholding tax rate to 10% (subject to the beneficial owner condition); third, reasonably plan related party transaction pricing to avoid tax investigations caused by transfer pricing issues. However, it is necessary to ensure that all planning complies with local regulations to avoid tax risks.

### Answer 5

Compliant operation of foreign exchange receipts and payments for Indian car exports: SWIFT messages need to accurately fill in transaction codes, amounts and purposes; receipts from offshore accounts need to comply with local regulations to ensure transparent capital flow; using CIPS RMB cross-border payment can improve efficiency and avoid exchange rate risks. When settling foreign exchange, complete documents such as commercial invoices, bills of lading and customs declarations need to be provided to ensure compliance of foreign exchange settlement and account balancing.

### Answer 6

Avoiding legal risks for Indian car export agencies: The agency agreement needs to clarify document responsibilities, require the supplier to guarantee the authenticity and validity of documents, and the supplier shall bear compensation liability for losses caused by document issues; the force majeure clause covers situations such as port congestion and policy changes; the cargo right transfer clause is clear to ensure that cargo rights are obtained after payment. In addition, conduct due diligence on Indian suppliers to understand their reputation and performance ability.

### Answer 7

Supply chain planning for Indian car exports: Establish a real-time inventory sharing mechanism with suppliers to avoid inventory overstock or shortage; develop a cost accounting model to integrate logistics, tax and customs declaration costs; when choosing trade terms, CIF terms mean the supplier is responsible for transportation insurance, reducing logistics risks; FOB terms can control cargo rights but require arranging logistics by oneself. Regularly evaluate supply chain performance and adjust strategies to adapt to market changes.
