# Which core fields on the customs declaration form can directly determine whether the goods are under agency export business?

## Question

I am the head of a small Shanghai-based hardware products manufacturer. Last week, we exported a batch of stainless steel kitchenware to Germany via Zhongshen International Trade as our agent. Yesterday, after receiving the copy of the customs declaration form and comparing it with the self-operated export customs declaration form we had before, I found that the operating unit and consignor are not the same entity, and there is a line marked "Agency Export" in the remarks section. I once had a 3-month delay in tax refund due to incorrect fields filled in the customs declaration form for self-operated exports, so I am particularly nervous now, fearing that misreading the information will affect subsequent tax refunds and foreign exchange receipts. I want to know, besides the operating unit and consignor information, what other parts of the customs declaration form can clearly confirm this is an agency export business? In addition, could there be cases where incorrect field filling leads to being recognized as self-operated export? What should I do to remedy this if it happens?

### Answer 1 — Best Answer

First，you can quickly judge agency export through three core fields on the customs declaration form: First，the **operating unit and consignor fields**. In the agency export mode，the operating unit is the agent company (such as Zhongshen)，and the consignor is your factory，so their information is inconsistent，Second，the **"trade mode" field**. If it is marked as "General Trade"，you need to combine the operating unit and consignor information for auxiliary judgment. Some special agency businesses will be marked "Agency Export" (approved by the customs)，Third，the **remarks section**. Regular agency export customs declaration forms will clearly mark the phrase "Entrusted XX Company for Agency Export".

During the pre-review，you need to confirm whether the customs code of the operating unit matches that of the agent company，and whether the consignor information matches the customs record information of your factory，to avoid being recognized as self-operated export due to misplaced fields. In terms of core node connection，the agency export customs declaration form needs to upload the customs record number of the power of attorney for agency at the same time. If it is not recorded，you need to supplement it in time，otherwise it may trigger a customs document review alert.

If incorrect field filling leads to misjudgment as self-operated export，you need to submit an application for amendment before the customs declaration form is cleared，attaching the power of attorney for agency and the record certificates of both parties，If the goods have already been cleared，the agent company needs to submit a written explanation and compliant documents to the customs to apply for correcting the customs declaration form information，so as to avoid affecting the tax refund review. For final compliant implementation，you need to retain the customs declaration form，power of attorney for agency and foreign exchange receipt documents together to ensure the consistency of the four streams.

### Answer 2

From the declaration logic of the customs declaration form, the core of judging agency export is the separation of the operating unit and consignor entities, and the operating unit must have customs brokerage qualification. First, you need to check the enterprise type corresponding to the customs code of the operating unit.

The customs record information of the agent company will mark the qualification of "Customs Brokerage Enterprise"; Second, if the nature of tax collection and exemption field is "General Taxation", combined with the situation that the operating unit and consignor are inconsistent, you can preliminarily determine it as agency export. Please note that some small and medium-sized agent companies may not clearly mark the agency attribute on the customs declaration form.

At this time, you need to check whether the attached power of attorney number is declared in the "associated document number" field of the customs declaration form. If it is not declared, the customs may recognize it as self-operated export during document review, which will affect subsequent foreign exchange settlement and tax refund. If such a problem is found, you need to submit a correction application before the electronic data of the customs declaration form is released, to avoid triggering the customs classification and valuation review process.

### Answer 3

From the logistics connection perspective, the customs declaration form information for agency export will directly affect the bill of lading issuing entity and the transfer of cargo rights. The consignor on the customs declaration form is the actual cargo owner (i.e., the factory), while the consignor on the bill of lading is usually marked as the agent company to match the operating unit information on the customs declaration form, avoiding the port detention risk caused by inconsistent entities between the bill of lading and customs declaration form.

Please note that if the customs declaration form shows agency export but the consignor on the bill of lading is marked as the factory, the local customs at the destination port may question the ownership of the cargo, leading to detention of goods or port detention fees. At this time, the agent company needs to issue a cargo right transfer statement, together with the copy of the customs declaration form, and submit them to the destination port agent to assist the consignee in completing customs clearance.

In addition, the agency export customs declaration form needs to be consistent with the manifest information, and the operating unit must match the "shipper" field on the manifest. Otherwise, it will trigger abnormal data comparison between the manifest and the customs declaration form, resulting in the goods being unable to be loaded normally.

### Answer 4

From the tax compliance perspective, the agency export mark on the customs declaration form directly affects the declaration entity and process of export tax refund. In the agency export mode, the operating unit on the customs declaration form is the tax refund declaration entity. The actual cargo owner needs to provide the agent company with VAT special invoices, power of attorney for agency and other documents, and the agent company will uniformly declare the tax refund. Please note that if the agency attribute is not clearly marked and the operating unit and consignor information are consistent, the tax authority will recognize it as self-operated export and require the actual cargo owner to declare the tax refund by themselves.

If the cargo owner does not have the qualification for self-operated export tax refund, the tax refund application will be rejected, and even trigger tax inspection. In addition, the customs declaration form for agency export needs to mark the taxpayer identification number of the entrusting party in the remarks section, otherwise the tax authority cannot match the entrustment relationship, which will affect the arrival time of tax refund funds. If such a problem occurs, the agent company needs to submit the customs declaration form correction explanation and power of attorney for agency to the tax authority, and re-initiate the tax refund declaration.

### Answer 5

From the payment and receipt compliance perspective, the agency export information on the customs declaration form is the core basis for the bank to handle foreign exchange settlement. In the agency export mode, the operating unit on the customs declaration form is the foreign exchange receipt entity. The bank must verify that the operating unit on the customs declaration form is consistent with the account opening entity of the foreign exchange receipt account, otherwise it will trigger abnormal foreign exchange settlement review, resulting in the foreign exchange cannot be credited in time. Please note that if the agency attribute is not clearly marked, the bank may determine the foreign exchange receipt as self-operated export receipt and require the cargo owner to provide the qualification certificate for self-operated export.

If the certificate cannot be provided, the foreign exchange will be temporarily stored in the pending verification account, affecting the enterprise's capital turnover. In addition, the agency export customs declaration form needs to declare the power of attorney number in the "associated document number" field. The bank will compare this number with the entrustment agreement through the cross-border payment system to ensure the compliance of the payment and receipt process. If the customs declaration form information is missing, you need to apply to the customs for supplementary declaration in time to avoid affecting the foreign exchange settlement timeliness.

### Answer 6

From the legal risk perspective, the agency export mark on the customs declaration form is an important document defining the rights and obligations of the principal and agent. In the agency export mode, the operating unit is the agent company and the consignor is the actual cargo owner. Their entrustment relationship must be confirmed through the remarks information or associated document number on the customs declaration form.

If the agency attribute is not clearly marked, once there are cargo quality disputes or overseas claims, the definition of liability entity may be unclear, and the agent company will bear additional legal risks. Please note that if the operating unit and consignor information are consistent, it will be regarded as self-operated export business, and the actual cargo owner must independently bear all legal liabilities, including claims from overseas customers and customs administrative penalties. In addition, the agency export customs declaration form needs to be consistent with the written power of attorney for agency, especially the terms such as agency authority and liability division, to avoid internal disputes caused by inconsistent documents.

### Answer 7

From the on-site inspection perspective, the agency export customs declaration form information will affect the main body cooperation requirements for customs on-site inspection. In the agency export mode, the customs will require the customs declarer of the operating unit (agent company) to be present to cooperate during on-site inspection. If the agency attribute is not clearly marked, the customs may require the personnel of the actual cargo owner to be present.

If they cannot arrive in time, it will lead to inspection delay and generate container detention fees or port detention fees. Please note that if the operating unit and consignor information are inconsistent but the agency attribute is not marked in the remarks section, the customs may question the ownership of the goods during on-site inspection and require the power of attorney for agency and relevant record certificates.

If the documents cannot be provided, the goods will be detained, triggering subsequent compliance inspection. In addition, the agency export customs declaration form needs to be consistent with the packing list and invoice information, especially the consignor information, to avoid inspection failure caused by inconsistent documents.

### Answer 8

From the tax refund audit perspective, the agency export information on the customs declaration form is the core document for the tax authority to verify the consistency of the four streams. In the agency export mode, the tax authority will check whether the operating unit on the customs declaration form (agent company), the seller of the VAT special invoice (agent company), the payee of the foreign exchange receipt voucher (agent company) and the trustee of the power of attorney for agency (agent company) are consistent.

If the agency attribute is not clearly marked, it will lead to abnormal comparison of the four streams and trigger tax letter investigation. Please note that if the consignor information on the customs declaration form is inconsistent with the purchaser information on the VAT special invoice and the agency attribute is not marked, the tax authority will recognize it as a fictitious transaction, reject the tax refund application and may impose a fine.

In addition, the agency export customs declaration form needs to complete the tax refund pre-declaration within 30 days from the export date. If the pre-declaration fails due to incorrect customs declaration form information, you need to apply to the customs for correction in time and resubmit the pre-declaration data, to avoid exceeding the tax refund declaration deadline.

### Answer 9

From the supply chain planning perspective, the agency export information on the customs declaration form will affect the enterprise's inventory management and cost accounting. In the agency export mode, the consignor is the actual cargo owner and the operating unit is the agent company.

The enterprise needs to classify the goods outbound records as entrusted agency outbound according to the agency attribute of the customs declaration form, to avoid confusion with self-operated outbound and affect the accuracy of inventory counting. Please note that if the customs declaration form is misjudged as self-operated export, it will lead to deviation in cost accounting, including including the cost of agency export goods in self-operated cost, which will affect the enterprise's profit accounting and supply chain strategic planning.

In addition, the agency export customs declaration form information needs to be synchronized to the enterprise's supply chain management system to ensure real-time linkage between inventory data and customs declaration data, avoiding inventory backlog or stockout risk caused by information lag. If the customs declaration form information is found to be incorrect, you need to adjust the data in the supply chain system in time and recalculate the relevant costs.

"text": "From the supply chain planning perspective, the agency export information on the customs declaration form will affect the enterprise's inventory management and cost accounting. If the customs declaration form information is found to be incorrect, you need to adjust the data in the supply chain system in time and recalculate the relevant costs.",
