# What process nodes, document requirements and compliance rules must be followed for customs declaration by transit trade intermediaries?

## Question

I am a freight forwarder and transit intermediary based in Shanghai, mainly engaged in transit business covering Southeast Asia and Singapore. Last month, I failed in my first transit customs declaration operation -- I did not figure out the difference between transit manifests and ordinary manifests, leading to a batch of electronic components shipped from Shenzhen to Germany via Singapore being detained at Singapore Port for 4 days. I not only compensated the customer nearly 3,000 CNY in demurrage fees, but also almost lost a long-term cooperative key client. Now I have 3 batches of similar transit orders to process, and I am very anxious for fear of making mistakes again. I would like to ask what exclusive documents the intermediary needs to prepare for customs declaration? Which core nodes in the process are most prone to pitfalls? Are there any emergency loss mitigation measures for port demurrage and customs detention? How to ensure fully compliant customs clearance?

### Answer 1 — Best Answer

Intermediaries shall strictly control the pre-document review link for customs declaration，which is the core prerequisite to avoid subsequent customs clearance abnormalities. The exclusive documents to be prepared include **transit trade filing certificate**，manifests confirmed by upstream and downstream parties (with the "transit" attribute clearly marked)，goods ownership transfer certificates，and copies of certificates of origin (if preferential tax rates are involved). During review，focus on verifying that the name，quantity and weight of goods in the manifest are completely consistent with the actual goods，and confirm that the validity period of the transit certificate matches the customs declaration period. It is strictly prohibited to replace transit manifests with ordinary import and export manifests.

Three key connections shall be noted for core process nodes: First，submit pre-declaration to the transit customs **24 hours in advance** to ensure that manifest information is synchronized with customs declaration forms，and avoid order rejection caused by information asymmetry，Second，after goods arrive at the port，complete on-site declaration and document submission within 48 hours to avoid triggering port demurrage warnings，Third，obtain the transit release notice issued by the transit customs in time after customs clearance，as the only valid certificate for subsequent departure of goods. Each node shall be assigned a fixed contact person to ensure zero delay in information transmission.

Emergency plans for abnormal situations shall be formulated in advance: If the declaration is rejected due to inconsistent documents，recheck and submit the revised documents within 2 hours，and apply to the customs for delayed declaration exemption，If there is a risk of customs detention，provide a full set of transit trade transaction vouchers and upstream and downstream contracts as soon as possible to prove that the goods have no intention to enter the transit market. After the final compliance is implemented，all documents shall be retained for at least 5 years for subsequent customs inspection，to ensure full-process compliance without loopholes.

### Answer 2

Intermediaries shall be alert to the valuation pitfall during customs declaration. If the declared price deviates from the reference price of similar goods of the transit customs, it is very easy to trigger valuation disputes or even declaration deletion and re-submission. Consult the transit customs for the valuation benchmark of transit goods in advance, and take the free on board (FOB) price of the goods plus reasonable storage and loading/unloading fees in the transit link as the declared price.

Avoid declaring with domestic purchase prices or destination port selling prices. In case of valuation queries, provide upstream and downstream transaction contracts, payment vouchers and transit link fee invoices in time to prove the rationality of the declared price. If you need to delete and re-submit the declaration, complete it within 3 working days specified by the customs, and submit a situation explanation to the customs at the same time to avoid port demurrage or customs detention caused by exceeding the time limit.

### Answer 3

Intermediaries shall plan logistics paths and goods ownership control details in advance. Confirm the free storage period policy of the transit port before customs declaration. Generally, the free storage period for transit goods in transit ports such as Singapore and Hong Kong is 7-10 days, and customs declaration and departure procedures shall be completed within the free storage period.

If you need to extend the free storage period, submit an application to the shipping company 3 days before the arrival of the goods, and provide the transit trade filing certificate at the same time. The bill of lading shall be marked with "to order" endorsement to ensure that goods ownership is only transferred between upstream and downstream trading parties, and avoid goods ownership disputes caused by improper bill of lading endorsement. In case of container rolling, apply to the customs for delayed declaration at the first time, and coordinate with the shipping company to prioritize the next shipping schedule to reduce logistics delay risks.

### Answer 4

Intermediaries shall pay attention to the tax policies of the transit place during customs declaration. Some countries (such as Singapore) exempt import VAT on transit goods, but VAT deferral filing shall be handled in advance to avoid tax penalties caused by failure to file. If related-party transactions are involved in the transit link, ensure that transaction pricing conforms to the arm's length principle, and avoid triggering tax inspection due to pricing deviating from market benchmarks.

Retain all transit link fee vouchers (such as storage fees, loading and unloading fees) as supporting materials for tax declaration. At the same time, coordinate with upstream and downstream enterprises to simultaneously declare transit trade tax information to ensure the consistency of cross-border tax data and avoid tax risks caused by information asymmetry.

### Answer 5

Intermediaries shall simultaneously ensure the compliance of customs declaration and foreign exchange receipt and payment. The goods amount and trading party information in the customs declaration form shall be completely consistent with the foreign exchange receipt and payment vouchers. If CNY cross-border payment is used, it shall be handled through the CIPS system, and the "CNY cross-border payment" attribute shall be marked in the customs declaration form.

The capital flow of offshore accounts shall correspond to transit trade orders one by one, and it is strictly prohibited to mix transit funds with ordinary import and export funds. In case of foreign exchange receipt and payment inspection by the State Administration of Foreign Exchange, provide customs declaration forms, transit trade contracts and payment vouchers in time to prove the compliance of funds. Understand the foreign exchange control policies of the transit place in advance to avoid abnormal customs clearance caused by delayed fund remittance.

### Answer 6

Intermediaries shall clarify the division of responsibilities in the customs declaration link through legal documents. In transit trade contracts signed with upstream and downstream parties, it shall be clearly marked that the intermediary is only responsible for customs declaration operations and shall not bear responsibilities such as goods quality and ownership disputes. Handle legal certificates of goods ownership transfer in advance to avoid abnormal customs declaration caused by unclear goods ownership.

If customs declaration is delayed due to force majeure (such as transit port strikes, epidemics), submit the force majeure certificate to the customs in time, apply for delayed customs declaration exemption, and notify upstream and downstream enterprises to adjust the shipping schedule at the same time. Retain all legal documents for at least 5 years for evidence collection in subsequent legal disputes.

### Answer 7

Intermediaries shall make preparations for on-site inspection in advance during customs declaration. After goods arrive at the port, check the authenticity of container seals at the first time to ensure that the seal number is completely consistent with the manifest and customs declaration form.

If the seal is found to be damaged, submit a situation explanation to the customs immediately and apply for on-site inspection. In case of unpacking inspection, arrange personnel familiar with the goods to be present for cooperation, and prepare documents such as goods packing lists and product specifications in advance to assist the customs in completing the inspection quickly.

Note that the inspection focus of transit goods is to confirm that the goods have not been used or sold. Avoid opening goods packaging at the transit port. If unpacking is necessary, reseal it after inspection, and obtain a seal certificate issued by the customs.

### Answer 8

If transit goods are dangerous goods or fragile goods, ensure that the packaging meets the compliance requirements of the transit place before customs declaration. Prepare the goods' MSDS report (if they are dangerous goods), and mark the special packaging requirements for transit transportation.

Fragile goods shall use packaging materials with qualified cushioning performance, and the "transit fragile goods" label shall be clearly marked outside the packaging to avoid goods damage caused by improper packaging during customs inspection. Consult the transit customs for packaging specifications for dangerous goods transit in advance.

It is strictly prohibited to use packaging materials that do not meet standards. If customs declaration is rejected due to non-compliant packaging, replace the packaging with qualified ones immediately, and submit the repackaging certificate to the customs.

### Answer 9

Intermediaries shall integrate the customs declaration link into the overall supply chain planning, and optimize customs declaration costs through trade term conversion. If the FOB transit port term is adopted, clarify the division of customs declaration responsibilities of upstream and downstream enterprises to avoid cost waste caused by repeated customs declaration. Establish a cost actuarial model, include customs declaration fees, demurrage fees, insurance premiums and other costs into the overall cost accounting, estimate the cost increase caused by abnormal customs clearance in advance, and reserve 1%-2% of risk reserve.

Establish long-term cooperative relations with customs brokers and logistics enterprises in the transit place to obtain rights and interests such as priority customs clearance and preferential fees, and optimize the overall supply chain efficiency. At the same time, flexibly adjust the customs declaration strategy according to the policy differences of different transit ports to ensure the balance between cost and compliance.
