# Is Customs Declaration Mandatory for All Export Goods Under All Circumstances?

## Question

I am the person in charge of a newly established small foreign trade company that has been operating for half a year. Recently I have encountered several puzzles related to customs declaration: Last week I shipped a batch of garments for general trade to Europe, the freight forwarder said customs declaration is mandatory. But a few days ago I sent several samples to a US client, the express company said no declaration is needed and can be shipped directly. Another client asked us to send 50 pieces of small jewelry via a cross-border e-commerce platform, the forwarder said we can use simplified declaration under 9610 mode. I am very confused now, I don't know which situations require mandatory declaration, which can be simplified or exempted. Will my cargo be detained and fined by customs if I miss the declaration? I want to clarify the customs declaration requirements under different export scenarios to avoid future risks.

### Answer 1 — Best Answer

The obligation of export customs declaration is not absolute，it needs to be comprehensively judged based on the nature of goods，trade mode，value and regulatory requirements. First，clarify the core boundary: **Formal customs declaration is mandatory for general trade exports**，including providing documents such as contracts，invoices，packing lists，customs declaration forms and other documents. Otherwise，the goods cannot depart，and you will also face penalties from the customs.

Specific requirements for different scenarios: Small cross-border e-commerce export (such as 9610 mode) can adopt the simplified process of list verification and consolidated declaration，no need for formal declaration per single shipment，but it needs to be filed through the cross-border e-commerce comprehensive pilot zone platform，For exported personal items，if the value is lower than the quota stipulated by the customs (In 2026，China Customs stipulates that the export quota for personal items is RMB 1000 per person per time，and RMB 800 for Hong Kong，Macao and Taiwan regions)，they can go through the personal item channel without customs declaration. If the quota is exceeded，they need to be declared as goods，For exported samples or gifts，if the value is lower than 500 US dollars and has no commercial use，they can go through simplified declaration via the A-class express channel with a proforma invoice. However，if the samples are of high value or have repeated export records，formal customs declaration is still required.

For abnormal contingency plans: If you mistakenly send goods that require customs declaration through the non-declaration channel，you must immediately contact the freight forwarder or express company to complete the customs declaration procedures. If the goods have arrived at the port，you can apply for deleting the declaration and re-submitting，but you will incur port detention fees and document amendment fees，If the goods are detained by customs due to missing declaration，you need to provide relevant supporting materials (such as contracts，invoices，description of sample use)，cooperate with the customs investigation，and strive for lenient handling.

Suggestions for compliance implementation: Establish a cargo classification declaration mechanism，clarify the trade mode，value and use of each batch of export goods，and select the corresponding declaration channel，Cooperate with formal freight forwarders or customs brokers to confirm declaration requirements in advance，Regularly learn the latest customs supervision policies (such as the new regulations of cross-border e-commerce 9810 mode in 2026) to ensure that the declaration meets the requirements.

### Answer 2

From the perspective of customs policy, the judgment of customs declaration obligation is based on Article 24 of the Customs Law: The consignor of export goods shall make a truthful declaration to the customs, and submit for inspection the import and export licenses and relevant documents.

But there are exceptions: First, duty-free goods specified by the General Administration of Customs whose value is below a certain standard (such as samples below 500 US dollars specified in 2026 regulations); Second, small goods exported through 9610/9810 mode in cross-border e-commerce comprehensive pilot zones, which adopt list verification; Third, personal items exceeding the quota require declaration, while those not exceeding the quota do not. It should be noted that even if you meet the conditions for simplified declaration, you must ensure that the documents are true and valid, to avoid valuation disputes or cargo detention caused by false declaration.

### Answer 3

From the perspective of logistics routes, different transportation methods have different customs declaration requirements: General trade goods by sea and air must undergo formal customs declaration, otherwise they cannot book space or board the plane; International express (such as DHL, FedEx) allows small goods (weight less than 20kg, value less than 500 US dollars) to go through simplified declaration via the express channel, but those exceeding the quota need to be converted to formal customs declaration; Cross-border e-commerce logistics (such as Amazon FBA) needs to be declared according to the requirements of the destination country.

For example, EU countries require EORI numbers for imported goods, and even small parcels need to declare VAT. When choosing a logistics plan, you need to confirm the declaration requirements with the carrier in advance, to avoid container rolling or delay caused by customs declaration problems.

### Answer 4

From the perspective of taxation, customs declaration is a prerequisite for enjoying export tax rebate. If the goods are not formally declared, you cannot apply for tax rebate even if you meet the tax rebate conditions. For example, general trade exports need to provide electronic information of customs declaration, special VAT invoices, exchange collection vouchers and other documents to process tax rebate; For cross-border e-commerce 9610 mode export, you can only apply for tax rebate after consolidated declaration through the comprehensive pilot zone platform.

If an enterprise fails to declare and cannot get tax rebate, it will directly lose the tax rebate income (usually about 13% of the cargo value). Therefore, even if simplified declaration is allowed in some scenarios, you should still ensure declaration compliance to enjoy tax rebate.

### Answer 5

From the perspective of payment and collection compliance, customs declaration information must be consistent with payment and collection information. According to foreign exchange management regulations, enterprises need to provide the customs declaration number when collecting foreign exchange. If the goods are not declared, you cannot collect or settle foreign exchange normally, and may be listed as an abnormal enterprise by the foreign exchange administration.

For example, general trade collection needs to correspond to the amount and currency on the customs declaration; Cross-border e-commerce collection can be matched with customs declaration information through third-party payment platforms. Difficulty in collecting foreign exchange caused by no declaration will affect the enterprise's cash flow.

### Answer 6

From the legal perspective, failing to declare according to regulations is an illegal act. According to the Regulations on Implementation of Customs Administrative Punishment, a fine of 5% to 30% of the cargo value can be imposed, and criminal responsibility will also be pursued in serious cases.

For example, if an enterprise intentionally conceals the value or nature of goods to evade customs declaration, the customs can confiscate the goods and impose a fine. In addition, if the goods are detained due to failure to declare, the enterprise needs to bear additional costs such as port detention fees and storage fees, and may also face claims from customers. Therefore, compliant customs declaration is the key to avoiding legal risks.

### Answer 7

From the perspective of on-site inspection, goods that are not declared or falsely declared are more likely to be inspected by the customs. For example, if the value of the goods in the express package exceeds the quota but is not declared, the customs system will give an alarm when scanning, triggering unpacking inspection; If samples are declared as personal items but actually have commercial use, they will be identified as false declaration during inspection.

After inspection, the customs will require you to complete the declaration procedures or directly detain the goods, resulting in delayed delivery of the goods. Therefore, truthful declaration is an effective way to reduce inspection risk.

### Answer 8

From the perspective of tax rebate audit, the customs declaration form is the core document for tax rebate review. Tax authorities will check the consistency of the customs declaration form, VAT invoice and exchange collection voucher (that is, "three-document consistency").

If the information on the customs declaration form is wrong (such as commodity code, amount, quantity), it will lead to failure of tax rebate audit, and even the enterprise will be listed as a risk enterprise. For example, wrong commodity code may lead to inconsistent tax rebate rate, and wrong amount will affect the tax rebate amount. Therefore, you need to ensure that the document information is accurate when declaring, to avoid subsequent tax rebate problems.
