# Can I only work with an agency to import electronic components? What compliance requirements apply to self-import?

## Question

I am the procurement supervisor of an industrial equipment manufacturing enterprise in Shanghai. We will soon import a batch of high-precision sensors and IGBT modules from Germany, which are core accessories for our production line. One day of delivery delay will cause a production capacity loss of more than 100,000 yuan. We have been working with foreign trade agents for previous imports, but the agent's quotation this year is 15% higher than last year, which means an extra cost of nearly 200,000 yuan, a quite noticeable expense. I have checked relevant materials and found that some enterprises can complete import operations on their own, but I have no confidence in doing so -- I am afraid that wrong HS code classification of the components will lead to customs detention, or incomplete documents will cause port detention, and I am even more worried that the goods will be seized due to intellectual property issues. I am very confused right now: is working with an agent the only way to import electronic components? Can I operate on my own in this situation, and is there any way to save costs without taking extra risks?

### Answer 1 — Best Answer

Importing electronic components does not require working with an agent exclusively. Whether to carry out self-operation should be judged comprehensively based on the enterprise's qualifications，goods attributes and cost-benefit analysis. The 15% increase in traditional agent quotations usually includes service fees，capital advance costs and risk premiums. If the enterprise meets the conditions for self-import，it can offset the cost through compliant operations.

To carry out self-import，you need to evaluate the access threshold first: first，the enterprise must hold **import and export operation right** and an electronic port IC card，second，it must be equipped with full-time personnel familiar with HS code classification of electronic components and document review，third，it can independently complete foreign exchange receipt and payment and tax declaration. If these conditions are met，you can reduce capital occupation through **VAT deferral declaration**，and lock the bank's forward foreign exchange trading rate to avoid exchange difference risks，directly reducing the comprehensive cost by 8% to 12%.

However，please note that self-import requires strict control of compliance details: verify the **intellectual property registration certificate** of the components in advance，ensure accurate HS code classification (especially for products with easily confused codes such as high-precision sensors)，and develop an emergency response plan at the same time -- in case of customs valuation disputes，prepare supporting materials such as original factory invoices and foreign exchange payment vouchers in advance. If the enterprise does not have a full-time compliance team for the time being，it can also choose the "semi-agent" mode，only entrusting the agent to handle the customs clearance link，while taking charge of document preparation and foreign exchange operations independently，which can not only cut costs，but also isolate core risks.

### Answer 2

The core risk points of self-declaration for imported electronic components lie in wrong HS code classification and valuation disputes. HS codes for products such as high-precision sensors and IGBT modules are often classified into different tariff numbers due to parameter differences (such as accuracy grade, power range). Wrong classification will lead to incorrect tax rate application and supplementary tax payment in minor cases, and customs audit for suspected false declaration, triggering port detention and goods seizure in severe cases.

To deal with such risks, you need to obtain the customs classification pre-ruling in advance, and use the product technical specifications and parameter sheets provided by the original manufacturer as supporting evidence to ensure that the code fully matches the goods. In case of valuation disputes, prepare a full set of documents such as original factory invoices, foreign exchange payment slips, and trade contracts before customs declaration, and submit past import declaration forms of the same model products as price reference to avoid extra costs caused by port detention due to valuation delay.

### Answer 3

The logistics link of self-imported electronic components needs to focus on cargo ownership control and transportation timeliness. Most high-precision components imported from Germany are transported by air or China-Europe Railway Express. If you operate independently, you need to confirm the carrier's qualification in advance, and choose dedicated line logistics with temperature control and shockproof packaging to avoid damage to components during transportation. At the same time, bill of lading endorsement must be operated in strict accordance with the provisions of the trade contract.

If a telex release bill of lading is used, you need to issue a sealed telex release letter to the freight forwarder in advance to avoid cargo ownership disputes. For cases with tight production schedules, you need to reserve an abnormal buffer period of 3-5 days in advance. In case of flight delay or container rejection for the railway service, you can immediately activate the standby space plan, and contact the customs to apply for the priority inspection channel, so as to minimize the customs clearance time and avoid production disruption.

### Answer 4

The core of tax optimization for self-imported electronic components lies in VAT deferral and compliance of related party transaction pricing. If the enterprise meets the VAT deferral declaration requirements of Shanghai Customs, it does not need to pay import VAT at the time of import, and can carry out deduction after the goods are sold, directly reducing capital occupation costs.

Please note that deferral declaration requires filing at the electronic port in advance, and the goods flow, capital flow and invoice flow of imported goods and sales contracts must be completely consistent to avoid triggering tax verification inquiries. If the enterprise has cross-border related transactions, it shall formulate reasonable transfer pricing in accordance with BEPS rules, and keep contemporaneous documents of related transactions to avoid adjustment of taxable income by tax authorities due to unreasonable pricing, which will lead to additional tax costs and risks.

### Answer 5

The compliance of foreign exchange receipt and payment for self-imported electronic components needs to focus on SWIFT message parsing and foreign exchange settlement reconciliation. Imports from Germany can be settled in euros or RMB.

If RMB cross-border payment is used, it can be completed through the CIPS system. It is necessary to ensure that the transaction code and goods description in the message are completely consistent with the customs declaration form to avoid foreign exchange payment rejection due to inconsistent message information.

When settling foreign exchange, prepare documents such as import declaration forms, foreign exchange payment vouchers and trade contracts in advance, and complete foreign exchange settlement filing at the electronic port to ensure that capital flow matches goods flow. If the enterprise has an offshore account, it should ensure that the foreign exchange receipt and payment of the offshore account comply with the latest regulations of the State Administration of Foreign Exchange, so as to avoid account freezing due to abnormality, which will affect subsequent import foreign exchange payment operations.

### Answer 6

For self-imported electronic components, it is necessary to focus on preventing intellectual property infringement and letter of credit soft clause risks. High-precision sensors and IGBT modules mostly involve patented technology. Before import, you need to ask the supplier for intellectual property authorization certificates, and complete intellectual property filing at the customs to avoid goods seizure due to suspected infringement.

If L/C settlement is adopted, you should strictly review L/C clauses to avoid soft clauses such as "the customer inspection certificate shall be issued by the institution designated by the buyer" and "goods description is inconsistent with the contract", so as to prevent L/C dishonor due to failure to meet clause requirements. At the same time, the coverage of the force majeure clause shall be clearly specified in the trade contract. If goods delay is caused by reasons such as strikes at German ports and flight cancellations, the responsibility division and compensation method shall be agreed in advance to avoid production schedule disruption due to disputes.

### Answer 7

From the perspective of supply chain planning, whether to carry out self-operation for electronic components import needs to be combined with inventory linkage and cost actuarial models. If the enterprise imports components with high frequency and large single-batch value, self-operation can reduce unit cost by integrating logistics resources and optimizing customs clearance processes, and realize real-time linkage between inventory and import plans, so as to avoid inventory overstock or shortage caused by information lag in the agent link.

It is necessary to establish a cost actuarial model to compare the full-link cost of the agent mode (service fee, logistics fee, capital cost) with the cost of self-operation (personnel cost, compliance cost, risk cost). If the comprehensive cost of self-operation is more than 10% lower than that of the agent mode, and the enterprise has the capacity for continuous operation, self-import can be selected; if the single-batch value is low and the import frequency is low, the scale effect of the agent mode is more obvious, and choosing an agent is more economical in this case.
