# What types of taxes do export agency enterprises need to pay? What are the core tax payment process nodes?

## Question

I am the person in charge of a small hardware manufacturing enterprise in Shanghai. Last month, we just signed an export agency agreement with Zhongshen. We are currently following up on the tax payment matters for our first German order, and I am particularly anxious. We have been doing domestic trade before, so we know the tax payment procedures well, but the tax payment logic of export agency is completely confusing. Last week, the finance staff rushed to tell me that the tax bureau issued a risk warning, saying that the value of our customs declaration form does not match the amount of the input VAT invoice. If not handled properly, it will not only delay the tax refund, but also may face fines. In addition, I heard from peers that the VAT deferral policy can greatly reduce the capital occupation cost, but I am not sure whether our enterprise engaged in export agency meets the access conditions, and I am also afraid of stepping on compliance red lines due to improper operation. Please help me clarify these issues clearly!

### Answer 1 — Best Answer

First，pre-emptive document review is required to ensure that the value，commodity code and collection subject of the **customs declaration form，input VAT special invoice and export agency agreement** are completely consistent. In particular，the clause that "the principal shall bear the tax payment subject responsibility" shall be clearly specified in the export agency agreement to avoid subsequent confusion of subjects.

For the connection of core nodes，the certification of input VAT invoices shall be completed within 30 days after the goods are declared for export. At the same time，the agency company shall assist in submitting the *Certificate of Export Agency Goods* on the electronic tax bureau，and complete the VAT tax declaration synchronously，after the collection of foreign exchange is completed，the collection voucher shall be submitted to the tax authority within 15 days as supporting materials for tax refund or tax payment.

For emergency plans，if there is a warning of inconsistent document information，first check whether the commodity code entered in the customs declaration form is incorrect，or whether the input VAT invoice is issued in compliance with the export tax refund requirements. If it is an entry error，apply for deleting the declaration and re-reporting or red-issuing the invoice within 3 working days，if there are questions about the application of policies，you can submit the *Tax-related Consultation Form* to the competent tax authority in advance to obtain official replies.

In the final compliance implementation stage，all documents (customs declaration forms，invoices，agency agreements，collection vouchers) shall be kept for no less than 10 years for future reference. At the same time，the agency company shall assist in completing the tax compliance self-inspection every quarter to ensure that there are no loopholes in the entire tax payment process.

### Answer 2

In the tax payment link of export agency enterprises, the classification of commodity codes on customs declaration forms directly affects the tax types and tax rates applicable to tax payment. Incorrect code classification may lead to deviations in tax payment amount and trigger risk warnings from tax authorities. Before declaring customs, professional personnel shall check whether the HS code of the goods complies with the latest provisions of the *Import and Export Tariff*, especially for hardware products of mixed materials, a material composition report shall be provided as the basis for classification.

If tax payment abnormalities caused by incorrect codes have occurred, immediately apply to the customs for modifying the customs declaration form, and submit a code correction explanation to the tax authority at the same time, so as to avoid being recognized as tax evasion due to inconsistent classification. In addition, the "domestic source place" on the customs declaration form must be consistent with the location of the issuer of the input VAT invoice, otherwise the tax authority will determine that the goods flow is inconsistent, which will affect the compliance of tax payment.

### Answer 3

The tax payment process of export agency enterprises is closely related to logistics nodes, especially the departure time of goods directly determines the deadline for tax payment declaration. It is necessary to ensure that the *Export Customs Declaration Form Tax Refund Certificate* issued by the customs is obtained in time after the goods actually depart. If the departure time is delayed due to logistics container shortage or port change, submit the *Application for Deferred Declaration* to the tax authority before the declaration deadline, and provide the port change certificate or manifest information issued by the logistics enterprise.

In addition, if the FOB trade term is adopted, pay attention to whether the freight and insurance premiums are included in the tax payment base, so as to avoid inaccurate tax payment amount due to incorrect cost accounting. At the same time, ensure that the information of the consignor and consignee on the bill of lading is consistent with the subject in the export agency agreement, so as to avoid affecting the determination of the tax payment subject due to confusion of the ownership subject of the goods.

### Answer 4

Export agency enterprises can use the VAT deferral policy to optimize tax payment costs, without paying import VAT when the goods depart, but declaring and paying it in the subsequent sales link, thereby reducing capital occupation. Three conditions must be met to apply this policy: first, the goods are imported goods from EU member states; second, the enterprise has completed VAT registration in the importing country; third, the export agency agreement clearly stipulates that the principal shall bear the responsibility for paying import VAT.

During operation, the agency company shall assist in submitting the VAT deferral application to the tax authority of the importing country, and keep documents such as import customs declaration forms, bills of lading and sales contracts for future reference. In addition, pay attention to the declaration cycle of VAT deferral to avoid late payment fines due to overdue declaration, and reasonably plan the capital flow to ensure that there is enough funds for tax payment before the declaration deadline.

### Answer 5

The tax compliance of export agency enterprises is directly linked to the foreign exchange receipt and payment link. The amount of foreign exchange received must be consistent with the value of the customs declaration form and the invoice amount. If the foreign exchange receipt difference exceeds 5%, submit the *Explanation of Foreign Exchange Receipt Difference* to the tax authority, and provide supporting materials such as bank foreign exchange receipt slips and the customer's deferred payment agreement.

In addition, if the RMB cross-border payment (CIPS system) is adopted, ensure that the "transaction remarks" of the payment message clearly mark "export agency payment" to avoid compliance questions from the tax authority due to unclear transaction nature. At the same time, note that the funds received in the offshore account shall be settled and transferred to the principal's domestic account within 180 days, so as to avoid being recognized as foreign exchange evasion due to funds staying in the offshore account, thereby affecting the compliance of the tax payment process.

### Answer 6

The tax payment clauses in the export agency agreement are the core of ensuring enterprise compliance. It is necessary to clearly stipulate the tax payment subject, the accounting method of tax payment amount, the division of abnormal responsibilities and other contents.

If the tax payment subject is not clearly specified in the agreement, the tax authority may recognize the agency company as the tax payment responsible person, leading to tax risks for the agency company. In addition, the clause that "if the tax payment abnormality is caused by the inconsistent documents provided by the principal, the principal shall bear all fines and late payment fines" shall be stipulated in the agreement to avoid the agency company suffering losses due to the principal's mistakes.

At the same time, keep the original export agency agreement and all email and WeChat records of communication as legal supporting materials in case of tax disputes. If administrative penalties from the tax authority occur, immediately entrust a professional lawyer to assist in filing an administrative reconsideration to safeguard the legitimate rights and interests of the enterprise.

### Answer 7

The tax payment of export agency enterprises is closely related to the export tax refund process. It is necessary to ensure the "four consistency" (goods flow, capital flow, invoice flow, contract flow). If any of the four is inconsistent, it will not only affect the tax refund, but also may trigger tax payment abnormality warnings. Before the tax payment declaration, professional personnel shall check whether the issuance time of the input VAT invoice is before the goods are declared for export.

If the invoice issuance time is later than the customs declaration time, submit the *Explanation of Delayed Invoice Issuance* to the tax authority. In addition, organize all documents related to tax payment and tax refund (customs declaration forms, invoices, agency agreements, collection vouchers) into a folder and keep them for no less than 10 years for future reference, so as to avoid being unable to complete tax payment or tax refund due to lost documents. If the tax authority initiates a letter of investigation, submit all supporting materials within 10 working days to ensure the smooth passage of the letter of investigation.

### Answer 8

From the perspective of supply chain planning, export agency enterprises can adjust the tax cost structure by optimizing trade terms. For example, converting the FOB trade term to the CIF trade term can include freight and insurance premiums in the dutiable price, thereby reducing the VAT tax base (if the export tax refund policy applies). In addition, reasonably plan the inventory turnover time to ensure that foreign exchange can be collected in time after the goods are declared for export, so as to avoid overdue tax payment declaration due to delayed foreign exchange receipt.

At the same time, negotiate with the agency company to establish a tax cost actuarial model, calculate the optimal tax payment plan according to the tariff rates, VAT rates, policy dividends and other factors of different countries, so as to balance cost and benefit. In addition, pay attention to changes in the global supply chain, such as the update of regional trade agreements, adjust the tax payment strategy in time, and use the agreed tax rates to reduce tax payment costs.
