# How to standardize the whole process of accounting treatment under the export agency model to ensure tax compliance?

## Question

I am the financial director of a small foreign trade manufacturing enterprise. We just signed an export agency agreement with Zhongshen last month, which is the first time we adopt the agency export model, as we have been engaged in self-operated export before. When we were preparing for accounting treatment at the end of this month, we found it is completely different from the self-operated process: we need to not only coordinate a pile of documents such as customs declaration forms and input VAT invoices provided by the agent, but also handle the fund splitting of foreign exchange receipts and tax refunds. Yesterday we almost triggered a tax warning due to the mismatch between the customs declaration form title and the VAT invoice. We are very anxious now, worrying that wrong account entries will lead to tax inspection, or errors in exchange difference and tax difference calculation will increase enterprise costs, and even more worrying that poor control of details will trigger compliance risks affecting subsequent tax refunds. We would like to ask how to carry out accounting treatment for export agency, and what core details and risk points are easy to be ignored?

### Answer 1 — Best Answer

First of all，pre-audit of documents should be conducted，and **the consistency of the four flows shall be strictly verified**: namely，the subject information，commodity details and amount of contract flow (agency agreement，foreign sales contract)，fund flow (foreign exchange receipt slip，payment voucher)，invoice flow (VAT input invoice，export invoice) and goods flow (customs declaration form，bill of lading) shall be completely matched. In particular，it shall be noted that the marks indicating the operating unit of the customs declaration form is the agency company and the consignor is the entrusting party shall not be wrong.

The connection of core nodes shall be divided into three steps: First，after the foreign exchange is received，the agency company shall immediately split the goods payment for the entrusting party and the agency service fee，which shall be recorded into "Accounts Payable - Entrusting Party" and "Main Business Revenue - Agency Service Fee" respectively in accounting，Second，after the entrusting party issues the input invoice，invoice authentication and tax refund declaration data collection shall be completed simultaneously，**to ensure accurate tax difference calculation**，Third，after the tax refund is received，it shall be transferred to the account of the entrusting party according to the time limit agreed in the agency agreement，and the transfer voucher shall be retained simultaneously.

In terms of exception response plans，if the exchange difference fluctuates excessively，the sharing proportion of exchange difference shall be agreed in the agency agreement in advance，and adjusted through the account of "Financial Expenses - Exchange Gain or Loss" in accounting，If there is a deviation in document matching，contact the agency company for correction within 3 working days to avoid triggering tax correspondence verification.

For final compliance implementation，accounting review shall be completed at the end of each month，all documents shall be sorted and filed for no less than 5 years，**cross-verification of VAT tax declaration and export tax refund declaration shall be completed simultaneously** to ensure consistent data.

### Answer 2

Under the export agency model, the filling information of the customs declaration form directly affects the compliance of accounting treatment. The "operating unit" on the customs declaration form shall be filled with the full name of the agency company, the "consignor" shall be filled with the full name of the entrusting party, and the commodity code, quantity and transaction method shall be completely consistent with the foreign sales contract and VAT invoice.

If there is an error in the customs declaration form information, you shall apply for deleting and re-submitting the declaration before the goods are cleared; if the customs clearance has been completed, you shall apply for modification of the customs declaration form, otherwise the goods flow and invoice flow in accounting will not match, triggering tax inspection. In addition, under the integrated customs clearance model, the electronic data of the customs declaration form will be synchronized to the tax system. The accounting treatment shall take the export date on the electronic customs declaration form as the node for revenue recognition, so as to avoid delayed or advanced revenue recognition that affects VAT declaration and tax refund calculation.

### Answer 3

Accounting treatment under the export agency model shall focus on the impact of tax difference and VAT deferral. If the entrusting party is a manufacturing enterprise, VAT shall be calculated according to the exemption, credit and refund policy. The agency company shall transfer the full amount of goods payment in the foreign exchange receipt to the entrusting party, which shall not be included in the taxable income of the agency company in accounting; if the entrusting party is a foreign trade enterprise, calculation shall be carried out according to the exemption and refund policy, and the agency company shall assist in collecting input invoice and customs declaration form information to ensure accurate tax refund declaration data.

For export business to the EU market adopting VAT deferral, deferred tax obligation shall be recognized in the month of export in accounting, no need to pay the import country's VAT in advance, and tax declaration shall be carried out after the goods are sold. A separate "deferred VAT" account shall be set up for accounting to avoid confusion with domestic VAT and triggering tax risks.

### Answer 4

The foreign exchange receipt and payment link in export agency accounting treatment shall strictly comply with cross-border foreign exchange compliance requirements. The agency company shall handle RMB cross-border payment through the CIPS system or foreign currency receipt through the SWIFT system. When receiving foreign exchange, it shall indicate "agency export receipt + name of entrusting party + foreign sales contract number" in the message remarks to ensure the traceability of fund flow.

Foreign exchange settlement shall be handled according to the instructions of the entrusting party, and funds shall not be intercepted or transferred without authorization. In accounting, the foreign exchange receipt amount shall be converted into RMB according to the exchange rate and recorded into "Bank Deposit - Foreign Currency Account".

When transferring the goods payment to the entrusting party, the exchange settlement slip and transfer voucher shall be issued simultaneously for retention and future reference. In addition, the fund transfer of offshore accounts shall meet the requirements of the State Administration of Foreign Exchange, and capital backflow through offshore accounts is prohibited, so as to avoid being identified as illegal foreign exchange receipt and payment and affecting the enterprise's foreign exchange classification rating.

### Answer 5

Export agency accounting treatment shall meet the tax refund review requirements of four-flow consistency, that is, the information of fund flow, invoice flow, contract flow and goods flow shall be completely matched. The audit focuses on verifying whether the collection of agency service fees conforms to the market fair price, and whether there is a situation of transferring profits by falsely increasing agency service fees; whether the foreign exchange receipt is received within 180 days after export, if it is overdue, delayed foreign exchange receipt filing shall be handled, otherwise the tax refund declaration will be affected.

In addition, document filing shall include agency agreement, foreign sales contract, customs declaration form, bill of lading, foreign exchange receipt slip, input invoice and other materials, with a retention period of no less than 5 years. If documents are lost or damaged, application for reissue or certificate shall be submitted within 10 working days to avoid tax refund being rejected due to incomplete documents.

### Answer 6

The selection of trade terms under the export agency model will directly affect the cost accounting of accounting treatment. If FOB trade terms are adopted, domestic freight and customs declaration fees shall be included in the sales expenses of the entrusting party in accounting, and the agency company shall only account for agency service fees; if CIF trade terms are adopted, the agency company shall collect and pay sea freight and insurance premium on behalf of the entrusting party, which shall be recorded into the account of "Other Payables - Agency Collection and Payment" in accounting, and shall not be included in main business income, so as to avoid overpayment of VAT.

In addition, in terms of inventory linkage strategy, the entrusting party shall timely carry forward the cost of inventory goods according to the export declaration form information provided by the agency company. The agency company does not need to account for the inventory of the entrusting party, but only its own service cost, so as to avoid inconsistency between inventory accounts and actual inventory.

### Answer 7

The bill of lading information under the export agency model shall match the goods right transfer node of accounting treatment. The consignee of the bill of lading shall be filled in according to the agreement of the foreign sales contract.

If it is a straight bill of lading, it shall be ensured that the consignee information is consistent with the payer, so as to avoid mismatch between goods right and fund flow; if it is an order bill of lading, the agency company shall carry out endorsement transfer according to the instructions of the entrusting party, and the endorsement voucher shall be retained for future reference. In accounting, the transfer of goods right shall be confirmed after the endorsement of the bill of lading is completed, and the sales revenue of the entrusting party shall be carried forward correspondingly.

In addition, in case of logistics abnormalities such as container rolling and port change, the export date in accounting shall be adjusted in time to avoid abnormal tax refund declaration caused by inconsistency between the export date and the customs declaration form. At the same time, additional expenses such as detention fee and port change fee shall be included in "Other Payables - Agency Collection and Payment" and charged to the entrusting party according to the actual amount.

### Answer 8

The terms of the export agency agreement directly affect the division of rights and responsibilities of accounting treatment. The agreement shall specify the collection standard and payment method of agency service fees, as well as the sharing proportion of exchange difference and tax difference, so as to avoid unclear rights and responsibilities in accounting; the time limit and responsibility for document provision shall be agreed.

If the entrusting party fails to provide input invoices or customs declaration materials on time, the responsibility for delayed tax refund shall be borne by the entrusting party. In accounting, the agency company shall accrue the corresponding receivable service fees to avoid bad debts. In addition, the agreement shall clarify the ownership of goods.

The agency company is only responsible for handling export procedures on behalf of the entrusting party, and the goods right belongs to the entrusting party. In accounting, the agency company shall not include the goods of the entrusting party into its own inventory, so as to avoid asset accounting errors and legal disputes.
