# Is it mandatory for export agents to take charge of the entire customs declaration process?

## Question

I am the person in charge of a small lighting enterprise that has just entered the foreign trade industry. We have recently cooperated with an export agent for the first time, but I am completely unfamiliar with the customs declaration process. Last week, I heard that a peer had their goods detained by customs because the agent missed declaring the product material in customs declaration, which not only delayed the shipping schedule but also incurred high port demurrage charges, making me very uneasy. I want to know what parts of customs declaration export agents are actually responsible for? Do they only help submit documents, or will they verify the accuracy of the documents? For example, our lighting products contain glass components, do they need special declaration? If there is a document discrepancy or coding error during customs declaration, shall the agent be responsible or shall we? In addition, will the agent be responsible for the commodity inspection link? I really dare not sign the contract casually without clarifying these details, for fear of falling into pitfalls and suffering heavy losses.

### Answer 1 — Best Answer

Customs declaration services provided by export agents usually cover the entire process，but responsibility boundaries need to be clarified to avoid risks. First is the pre-declaration document verification details: the agent will check whether the commercial invoice，packing list，draft customs declaration form and other documents you provide are consistent with the actual goods，focusing on verifying core contents such as HS code classification，cargo value declaration，validity of commodity inspection certificates，etc. For example，for lighting products with glass components，it is necessary to confirm whether they fall into the scope of statutory commodity inspection，and the agent will assist in preparing relevant documents if commodity inspection is required.

In terms of core node connection，the agent will complete operations such as electronic declaration，cooperation with customs inspection，tax payment (if entrusted) and so on. It should be noted that if the goods involve special supervision conditions (such as 3C certification)，the agent will assist you in preparing documents，but the responsibility for final document acquisition shall be clarified by both parties in the contract. After declaration，the agent will track customs feedback in real time to ensure that data is synchronized to the integrated customs clearance system.

Exception response plan is the key: if there is a customs valuation dispute or document discrepancy during customs declaration，the agent shall communicate with you at the first time，provide plans for supplementary explanation materials or adjustment of declaration contents，and track the processing progress until the problem is solved. For example，if customs detention is caused by coding error，the agent shall assist in reclassification and apply for form cancellation and re-declaration.

The final compliance implementation requires the agent to ensure that the customs declaration data is completely consistent with the actual goods and documents，and complies with the latest smart customs declaration policy of the General Administration of Customs issued in 2026，so as to avoid being included in the key supervision list due to abnormal data. **It is recommended to clarify the scope of responsibility for agent customs declaration in the contract，including clauses on commodity inspection，inspection cooperation，exception handling，etc.** At the same time，require the agent to provide receipts of key nodes in the customs declaration process，such as declaration success notice，inspection notice，etc。so that you can grasp the progress in real time.

### Answer 2

The responsibility boundary of export agent customs declaration shall be subject to the contract agreement, but the industry convention is to cover the whole chain of "document verification - electronic declaration - customs feedback processing".

Although the final confirmation responsibility of HS code belongs to the enterprise, the agent shall provide professional classification suggestions; if the agent fails to identify obvious errors (such as inconsistency between cargo value and invoice) leading to customs detention, it shall bear corresponding responsibilities; if the enterprise provides false information, the responsibility shall be borne by the enterprise. The 2026 smart customs declaration system requires 100% accuracy of declaration data, and agents shall use compliant systems to ensure real-time data synchronization.

### Answer 3

Export agent customs declaration is closely connected with the logistics link. The agent shall collect customs declaration documents within 24 hours after the goods enter the warehouse to avoid affecting booking and shipping.

If the goods are transshipped, the customs declaration requirements of the transshipment port shall be confirmed in advance (for example, ENS declaration for Europe shall be completed 48 hours before shipment), otherwise the goods cannot be loaded on board. In addition, the agent shall track the customs declaration progress, and coordinate with the logistics party to unload the containers quickly in case of inspection, so as to reduce the loss of detention charges.

### Answer 4

Export agent customs declaration data directly affects tax refund compliance. The agent shall ensure that the cargo value and HS code on the customs declaration form are consistent with those on the VAT invoice, so as to avoid tax refund delay or verification caused by under-declaration/over-declaration.

The 2026 tax refund policy requires "integration of four flows", and the agent shall assist in verifying the data of contract flow, cargo flow, capital flow and invoice flow to ensure that the customs declaration data matches the tax refund data. If the agent makes a declaration error, the tax refund application will be rejected, which affects capital turnover.

### Answer 5

Export agent customs declaration involves payment and receipt compliance. The amount on the customs declaration form declared by the agent shall be consistent with the received foreign exchange amount, otherwise it will be included in the abnormal list by the State Administration of Foreign Exchange.

With the full promotion of the CIPS system in 2026, the agent shall ensure the real-time connection between customs declaration data and CIPS foreign exchange receipt data to avoid suspended receipt of foreign exchange. In addition, the agent shall assist in optimizing the settlement time to reduce exchange loss. If the amounts are inconsistent, the enterprise needs to provide a difference explanation, which increases compliance costs.

### Answer 6

The responsibility of export agent customs declaration shall be clarified in the contract. It is recommended to add a "customs declaration responsibility clause" to stipulate that the agent is responsible for the accuracy of the declaration data, and shall bear the compensation liability if customs detention and fine are caused by the agent's error; at the same time, clarify the obligation of the enterprise to provide real information, and the agent shall not be responsible if the enterprise provides false information.

In addition, it shall be stipulated whether additional services such as commodity inspection and fumigation are included, so as to avoid disputes over extra charges.

### Answer 7

The export agent shall be present in time to cooperate when encountering inspection in customs declaration. The agent shall prepare inspection documents such as certificate of origin and commodity inspection certificate in advance, and guide the enterprise to place goods by model classification (for example, lighting products are classified by power) to speed up inspection.

If the goods are found to be inconsistent with the declaration, it is necessary to communicate with the customs immediately and provide supplementary explanation materials to obtain lenient treatment. The customs inspection rate will increase in 2026, so the agent needs to have on-site handling experience to shorten the inspection time.

### Answer 8

Export agent customs declaration data is the core basis for tax refund declaration. The agent shall ensure that the HS code, cargo value and quantity on the customs declaration form are consistent with those on the VAT invoice, otherwise the tax refund application will be rejected. The agent shall provide the tax refund copy within 3 working days after the completion of customs declaration, so that the enterprise can declare in time.

The 2026 tax refund policy requires document filing to be kept for 5 years, and the agent shall assist in sorting out filing materials such as customs declaration forms and contracts to ensure compliance. If the customs declaration form is not provided in time, the tax refund will be overdue and the preferential treatment cannot be enjoyed.
