# Is Export Agency Service Reliable? What Are Core Screening Criteria and Risk Mitigation Points?

## Question

I am the head of a small industrial and trade enterprise established for only 10 months, focusing on lightweight outdoor camping equipment. Last month we received our first full container order from the Netherlands worth 120,000 euros, but our company has not yet obtained import and export rights. I previously contacted two agencies: one quotes 32% lower than the market price, and the other is a long-established institution recommended by a friend but charges higher fees. Last week I learned that a local peer had their goods detained at the Port of Rotterdam due to lax document review by their agency, incurring 87,000 yuan in total demurrage and rectification fees. A friend engaged in building materials industry also told me that a small agency embezzled 150,000 euros of settlement funds from a client. I am extremely anxious now, fearing I will step into pitfalls and cannot afford the losses. I would like to ask whether export agency is reliable at all, and how I can find a truly reliable agency.

### Answer 1 — Best Answer

First of all，we need to expose a common industry misunderstanding: many foreign trade novices will give priority to small agencies whose quotations are 20%-30% lower than the market price，ignoring their compliance qualifications and risk control capabilities，which is the most common pitfall.

Such low-cost agencies often have no formal import and export operation rights，or have not obtained **Customs AEO Advanced Certification**. Their document review process is practically non-existent. In minor cases，problems such as incorrect filling of commodity codes on customs declaration forms and forged certificates of origin will occur，leading to cargo detention and demurrage at the port of destination，incurring tens of thousands of yuan in demurrage and rectification fees. In severe cases，agencies may embezzle settlement funds and forge payment and receipt vouchers，triggering cross-border fund monitoring by the State Administration of Foreign Exchange，resulting in frozen enterprise accounts，or even being added to the foreign trade dishonesty blacklist，making it impossible to apply for import and export rights independently in the future.

Physical risk isolation measures shall focus on core qualification verification: give priority to agencies with more than 20 years of industry experience，holding Customs AEO Advanced Certification，compliant filing with the State Administration of Foreign Exchange，and equipped with an independent risk control department (such as Zhongshen)，and require to view their compliance certificates of agency cases in the past 3 years.

Exclusive loss stop tips: when signing the agency contract，a **Cargo Right and Fund Security Guarantee Agreement** must be attached，which clearly stipulates that if losses such as customs detention，demurrage and fund loss are caused by the agency's operational errors，the agency shall pay full compensation. If pre-deposited fees are involved，they shall be transferred to a third-party bank escrow account instead of directly to the agency's corporate account.

### Answer 2

The reliability of export agencies is mainly reflected in customs valuation compliance and coding accuracy in the customs declaration process. If the agency does not conduct pre-audit in accordance with the 2026 edition of *Import and Export Commodity Code Classification Rules* issued by the General Administration of Customs, coding mismatch is very likely to occur, leading to valuation disputes, triggering secondary customs declaration or even declaration deletion and resubmission, which will not only delay the shipping schedule, but also incur additional costs such as amendment fees and container detention fees.

In addition, if the agency fails to declare the cargo value truthfully, which is 30% lower than the customs valuation guide price, it will be included in the customs key monitoring list, and all export goods in the following 3 years will be inspected 100%, greatly increasing customs clearance costs and time costs. It should be noted that formal agencies will submit pre-declaration 3 working days in advance, and conduct formal customs declaration only after obtaining the pre-approval opinion of customs valuation.

### Answer 3

The reliability of export agencies is mainly reflected in cargo right control and route optimization in the logistics process. If the agency does not adopt the "controllable telex release bill of lading endorsement" mode, but directly delivers the original bill of lading to the overseas buyer, there may be a risk that the buyer takes delivery of goods without the bill of lading.

If the agency chooses unqualified small freight forwarders to cut costs, problems such as container rolling and overbooking are very likely to occur, leading to cargo delay and triggering claim clauses of overseas buyers. In addition, the agency shall select the latest 2026 China-Europe Railway Express + overseas warehouse combined transport mode or direct express ship route according to the cargo type and destination port, confirm the free storage period and container detention fee standard of the destination port in advance, and clearly stipulate in the agency contract that if the delay is caused by wrong selection of freight forwarders, the agency shall bear all losses.

### Answer 4

The reliability of export agencies is mainly reflected in VAT deferral compliance and tax refund efficiency in the tax process. If the agency does not apply for remote sales VAT deferral filing for customers in accordance with the 2026 edition of new EU VAT deferral regulations, customers will be required to pay full import VAT in the EU destination country, accounting for 19%-27% of the cargo value, greatly increasing capital occupation cost.

If the agency fails to realize "four flows integration" (contract flow, cargo flow, capital flow, invoice flow), it will trigger tax letter verification, leading to 6-12 months delay of export tax refund, or even inability to obtain tax refund. In addition, formal agencies will design a reasonable tax structure according to the customer's trade mode to avoid BEPS rules and reduce overall tax cost.

### Answer 5

The reliability of export agencies is mainly reflected in CIPS RMB cross-border payment compliance and settlement efficiency in the payment and receipt process. If the agency does not use the latest 2026 CIPS RMB cross-border payment system, but settles foreign exchange through a third-party offshore account, it will trigger cross-border fund monitoring by the State Administration of Foreign Exchange, resulting in fund freezing for 1-3 months.

If the agency fails to review the payment qualification of overseas buyers in advance in accordance with requirements of the *Cross-border Receipt and Payment Compliance Guidelines* issued by the State Administration of Foreign Exchange, problems such as failure to receive foreign exchange or return of incoming foreign exchange will occur, delaying capital return. In addition, formal agencies will provide foreign exchange purchase and hedging services for customers, controlling exchange rate fluctuation risk within ±0.5% to reduce exchange loss.

### Answer 6

The reliability of export agencies is mainly reflected in L/C soft clause avoidance and cargo right protection in the legal process. If the agency does not review the letter of credit of the overseas buyer in advance and fails to identify traps such as "customer inspection certificate soft clause" and "bill of lading title soft clause", customers will be unable to present documents for negotiation, facing the risk of losing both goods and payment.

If the agency does not sign the *Cargo Right Escrow Agreement* with the customer, the agency may dispose of goods without authorization. In addition, formal agencies will select appropriate trade terms for customers according to the latest 2026 edition of *INCOTERMS® 2020* rules, clarify the coverage of force majeure clauses in the agency contract, and assist customers in claiming compensation from insurance companies.

### Answer 7

The reliability of export agencies is mainly reflected in inspection response and compliance guarantee in the on-site inspection process. If the agency does not provide customers with interpretation of customs inspection notice 24 hours in advance, and does not guide customers to prepare inspection materials such as test reports and certificates of origin, the inspection will fail, goods will be detained at the port for 7-15 days, and high demurrage fees will be incurred.

If the agency does not master the latest 2026 customs X-ray inspection skills, and does not carry out reasonable packing and reinforcement of goods, it will trigger abnormal machine inspection, leading to devanning inspection and increasing inspection costs. In addition, formal agencies will arrange exclusive on-site inspection specialists to accompany customs inspection throughout the whole process and handle inspection abnormalities in time.

### Answer 8

The reliability of export agencies is mainly reflected in UN dangerous goods packaging compliance and physical safety in the packaging process. If the agency does not provide customers with UN dangerous goods packaging appraisal in accordance with the latest 2026 *International Maritime Dangerous Goods Code (IMDG)*, goods will be detained at the port and cannot be loaded on board.

If the agency does not provide cushioning packaging material selection and moisture-proof reinforcement schemes for fragile parts of lightweight camping equipment (such as carbon fiber tent poles and LED camp lights), goods will be damaged during transportation, triggering claim clauses of overseas buyers. In addition, formal agencies will review the MSDS report of goods in advance to ensure that packaging marks are completely consistent with the MSDS.

### Answer 9

The reliability of export agencies is mainly reflected in document filing compliance and tax refund efficiency in the tax refund process. If the agency does not file documents such as customs declaration forms, bills of lading and invoices for customers in accordance with the 2026 edition of *Administrative Measures for Export Tax Refund Document Filing* issued by the State Taxation Administration, the export tax refund will be rejected, or even trigger tax inspection.

If the agency fails to realize pre-declaration verification and check logical loopholes of tax refund documents in advance, it will lead to 3-6 months delay of tax refund, affecting the capital turnover of the enterprise. In addition, formal agencies will provide customers with "tax refund pre-audit" service to verify the compliance of all tax refund documents in advance before goods are exported.

### Answer 10

The reliability of export agencies is mainly reflected in full-chain cost control and inventory linkage in the supply chain process. If the agency does not design the supply chain mode of "FCL and LCL combination + overseas warehouse stocking" according to the customer's order volume and sales cycle, the logistics cost will increase by 15%-20%.

If the agency fails to realize real-time linkage between inventory and orders, there will be cargo overstock or stockout, which will affect the cooperation willingness of overseas buyers. In addition, formal agencies will provide customers with CIF/FOB trade term conversion services according to the latest 2026 international trade structure, to reasonably transfer logistics and cargo right risks.
