# What Core Control Nodes Should Be Highlighted in the Full Process of Compliant Export Customs Declaration and Tax Refund?

## Question

I am the head of a small and medium-sized garment manufacturing and foreign trade enterprise based in Shanghai. Last month, I handled the first self-operated export of a batch of women's clothing to Hamburg Port, Germany. I have always commissioned an agency to handle customs declaration and tax refund before, and I wanted to operate it by myself this time to cut costs. However, during customs declaration, the pre-declaration of tax refund was rejected because the goods value on the commercial invoice did not match the declared value on the customs declaration. Now the goods have arrived at the port, and the customer is pressing for the bill of lading every day. I am afraid that another mistake will lead to rejected tax refund or even trigger tax inspection, and I also worry that negligence in the customs declaration process will cause port storage charges. I am really anxious and want to know how to operate compliantly across the whole process from document preparation to tax refund disbursement to avoid making mistakes again?

### Answer 1 — Best Answer

First of all，details of pre-document review: core documents including commercial invoice，packing list，customs declaration form，VAT special invoice and advance exchange collection slip shall be **cross-checked** to ensure that the goods value，quantity，product name and HS code are completely consistent. In particular，the value on the commercial invoice must match the declared value on the customs declaration form and the tax-exclusive amount on the VAT special invoice，so as to avoid pre-declaration rejection caused by document discrepancy.

Connection of core nodes: Pre-declaration for customs clearance shall be completed 3 days before the goods depart from the port. After confirming customs release，the electronic data of the customs declaration form shall be synchronized to the export tax refund declaration system in time，Exchange collection shall be completed within 180 days after the goods are exported. For special cases，an extension can be applied to the tax authority，and the exchange collection certificate shall be uploaded to the foreign exchange monitoring system at the same time.

Contingency plan for abnormalities: If pre-declaration is rejected，documents shall be revised according to the rejection reason from the tax authority and pre-declaration shall be re-submitted within 3 working days，If tax correspondence investigation is triggered，supporting materials including goods purchase and sales contract，transport documents，delivery order，supplier quotation，etc. shall be provided within 5 working days to cooperate with the tax authority's investigation.

Final compliance implementation: After the tax refund declaration is completed，all documents shall be kept for future reference for at least 5 years，to ensure the consistency of goods flow，capital flow，invoice flow and information flow，meet the compliance requirements of the tax authority，and ensure timely and full disbursement of tax refund.

### Answer 2

When conducting export customs declaration, it is necessary to ensure accurate classification of HS code. Wrong HS classification will not only lead to wrong application of tax refund rate, but also may trigger customs valuation disputes or even goods detention.

If facing customs valuation query, supporting materials including goods purchase and sales contract, cost calculation sheet, export customs declaration records of the same category of goods in the past 3 months, supplier quotation, etc. shall be provided within 3 working days to prove the rationality of the declared value, avoid delayed customs clearance caused by valuation dispute that affects the progress of tax refund declaration. At the same time, you need to communicate with the freight forwarder in time to coordinate goods storage, so as to avoid extra costs such as port detention fee and container detention fee.

### Answer 3

For goods exported to the EU, you can apply for the VAT deferral policy, which allows you to apply for tax refund directly in the exporting country without paying import VAT in the importing country, effectively easing capital pressure.

To apply for VAT deferral, you need to confirm that the final destination of the goods is an EU member state, you have completed VAT registration in the importing country, and mark "VAT Deferral" in the remark column of the customs declaration, so as to avoid being unable to enjoy the policy benefit due to missing marking. In addition, you need to submit VAT deferral declaration information to the EU tax authority within 30 days after goods export to ensure compliance.

### Answer 4

Export tax refund must strictly ensure the consistency of goods flow, capital flow, invoice flow and information flow. In case of tax inspection, you need to provide complete document filing materials including goods delivery order, transport documents, exchange collection certificate, purchase and sales contract, copy of customs declaration, etc. Document filing shall be completed within 15 days after tax refund declaration, and the retention period is at least 5 years.

Missing documents or non-standard filing may lead to recovery of tax refund, even trigger tax penalty, and affect your subsequent qualification for export tax refund declaration.

### Answer 5

Export exchange collection must be completed through formal cross-border payment channels. If there is a discrepancy between the collected amount and the declared value on the customs declaration, you need to submit a discrepancy explanation to the State Administration of Foreign Exchange within 10 days after collection, proving that the discrepancy comes from reasonable items such as commission, freight, insurance premium or quality deduction.

Failure to explain the discrepancy in time may trigger an early warning from the foreign exchange monitoring system, affect your subsequent qualification for foreign exchange collection and payment, and then lead to delayed tax refund declaration due to incomplete collection, even trigger tax inspection.

### Answer 6

If the exported goods are subject to on-site customs inspection, you need to ensure that the actual condition of the goods is completely consistent with the content declared on the customs declaration, especially core information such as product name, quantity, HS code and brand.

If discrepancy is found in the inspection, you need to cooperate with the customs to complete re-classification or declaration correction within 2 working days, so as to avoid goods detention at the port caused by failed inspection that generates extra costs such as port detention fee and container detention fee, and affects the time node of tax refund declaration. You need to communicate with the tax authority in time to apply for the qualification of delayed declaration.

### Answer 7

The export contract shall clearly stipulate the division of responsibilities for customs declaration and tax refund. Especially when you entrust an agency for customs declaration, you need to clearly specify the agency's document review responsibility, tax refund declaration time limit, obligation to notify abnormal situations and other clauses in the contract.

If tax refund is delayed or rejected due to the agency's mistake, you can hold the agency liable for breach of contract in accordance with the contract terms. At the same time, you need to retain supporting materials such as contract, communication records and documents as the basis for subsequent rights protection, so as to avoid damage to your own rights and interests caused by unclear responsibility.
