# Do goods that have completed export customs declaration and successfully received foreign exchange really not need to go through export tax refund procedures?

## Question

I am the owner of a small and micro enterprise based in Shanghai that mainly exports solid wood home goods. Last month, I shipped 120 sets of custom solid wood dining chairs to Rotterdam, the Netherlands via less than container load (LCL). The customs declaration has been successfully completed and the goods have been loaded onto the vessel. Last week, I received the full euro payment from my customer. I thought the entire order process was completely wrapped up, but yesterday at a foreign trade peer gathering, an experienced seller reminded me that even after receiving the payment, I still need to handle tax refund or tax exemption declaration according to regulations, otherwise tax risks will be triggered. I always took it for granted that only goods eligible for tax refund need to go through the declaration process, and tax-exempt goods do not need any management. Now I am extremely worried—this batch of goods was declared under VAT exemption at that time, and the documents were just stuffed in the corner of the company's file cabinet. Will I be audited by the tax bureau for not completing the relevant procedures? Will it affect my subsequent export customs declaration qualifications? Can I still go through the relevant procedures now?

### Answer 1 — Best Answer

Many small and micro foreign trade enterprises easily fall into the misunderstanding that "export receipt of foreign exchange + completion of customs declaration = no need to handle tax declaration"，especially enterprises that choose VAT exemption declaration，who often mistakenly believe that they do not need to go through any tax refund or tax exemption filing procedures，and just leave them unattended.

If relevant procedures are not handled in accordance with regulations，it will first trigger compliance warnings from the tax authorities. At the mild end，you will be required to make supplementary declarations of the full set of documents and pay overdue late fees. At the severe end，you will be listed as a tax abnormal household，suspended from the tax exemption or tax refund qualification for subsequent export customs declarations，and even affect the enterprise's foreign exchange receipt and payment rights，resulting in the inability to normally settle the payment of subsequent orders.

For goods that have completed export foreign exchange receipt but have not been declared，you need to take risk isolation measures immediately: sort out and archive the full set of documents of this order separately，including customs declaration form，foreign exchange receipt slip，purchase VAT invoice，foreign sales contract，etc。to avoid confusion or loss with documents of other orders.

**It is necessary to complete the supplementary declaration before April 30 of the year following the date of export customs declaration. If the deadline is exceeded，you can submit a "Statement on Delayed Tax Refund Declaration" to the competent tax authority，and provide supporting materials such as goods export and foreign exchange receipt to apply for an extension，at the same time，it is necessary to establish an internal "30-day post-export tax declaration reminder mechanism" for the enterprise，which automatically triggers a declaration reminder after each export order is completed，to avoid omissions at the source.**

### Answer 2

The customs declaration form of export goods is one of the core basis for the tax authorities to review tax refund or tax exemption declarations. If an enterprise fails to handle tax refund or tax exemption declarations, the export goods data in the customs system will be disconnected from the declaration data in the tax system, triggering a joint customs and tax verification warning.

Especially for goods with high tax refund rates, if they are not declared in accordance with regulations, the customs may list this batch of goods as "abnormal export goods", suspend the enterprise's subsequent rapid customs clearance qualification for similar goods, and even require the enterprise to re-submit supporting materials for the authenticity of the trade, such as foreign sales contracts, bills of lading, customer acceptance documents, etc., resulting in delays in the customs clearance time of subsequent orders.

### Answer 3

Logistics documents such as ocean bills of lading and LCL lists for export goods are important supporting materials for tax refund declarations. If an enterprise fails to handle tax refund or tax exemption declarations, if the logistics documents are not filed in time or lost, subsequent supplementary declarations will be rejected by the tax department due to the inability to provide complete logistics trail proof.

In addition, if an enterprise is listed as a tax abnormal household due to undeclared tax refund, logistics enterprises may refuse to handle booking, customs declaration and other services for subsequent goods due to early warning information in the tax system, resulting in goods being unable to be shipped on time, generating additional costs such as warehouse rental and port detention fees, and even affecting the delivery date of customers, triggering order default risks.

### Answer 4

For export enterprises that choose VAT deferred declaration, failing to handle export tax refund or tax exemption declarations will lead to an imbalance in VAT input and output data, triggering transfer pricing audit risks from tax authorities. Especially for enterprises involved in cross-border related party transactions, if they fail to declare tax refund in accordance with regulations, the tax authorities may suspect that the enterprise is transferring profits by giving up tax refund, and require the enterprise to provide pricing basis for related party transactions, profit distribution statements and other materials, and even adjust the enterprise's taxable income amount, requiring the enterprise to pay corporate income tax and late fees.

In addition, voluntarily giving up tax refund does not mean that there is no need to handle tax exemption filing. If no filing is handled, the tax authorities will treat this batch of export goods as domestic sales goods, requiring the enterprise to pay VAT, consumption tax and other taxes.

### Answer 5

Export tax refund or tax exemption declaration is one of the important basis for the State Administration of Foreign Exchange (SAFE) to verify the authenticity of enterprises' foreign exchange receipt and payment. If an enterprise fails to handle the declaration, the foreign exchange receipt data in the foreign exchange system will deviate from the export data in the tax system, triggering foreign exchange receipt and payment warnings from SAFE.

SAFE may require the enterprise to provide supporting materials for the trade background of this batch of goods, such as foreign sales contracts, customs declaration forms, bills of lading, invoices, etc., and even suspend the enterprise's foreign exchange settlement rights, resulting in the inability to normally settle or purchase foreign exchange for subsequent orders. In addition, if an enterprise fails to handle tax refund or tax exemption declarations, it cannot issue the export goods certificate issued by the tax department, which will affect the enterprise's credit rating overseas, leading to delayed payment or refusal of payment by overseas customers.

### Answer 6

If an enterprise fails to handle export tax refund or tax exemption declarations, it will be unable to provide the export goods certificate issued by the tax department when involved in international trade disputes, which will affect the enterprise's ability to produce evidence. Especially when overseas customers raise objections to goods quality or refuse payment, if the enterprise cannot provide supporting materials for tax refund declarations, such as customs declaration forms, foreign exchange receipt slips, etc., it may be recognized by the court or arbitration institution as failing to fulfill the compliance obligations of the trade, and bear liability for breach of contract.

In addition, if an enterprise is listed as a tax abnormal household due to undeclared tax refund, it will affect the enterprise's credit record, making it impossible for the enterprise to apply for bank loans, issue letters of guarantee, etc., affecting subsequent business development.

### Answer 7

On-site inspection records of export goods are one of the important supporting materials for tax refund declarations. If an enterprise fails to handle tax refund or tax exemption declarations, if the on-site inspection records are not filed in time or lost, subsequent supplementary declarations will be rejected by the tax department due to the inability to provide complete inspection certificates.

In addition, if an enterprise is listed as a tax abnormal household due to undeclared tax refund, the customs on-site inspection department will list the enterprise's export goods as key inspection objects, increasing the proportion of unboxing inspections, resulting in delays in customs clearance time, generating additional costs such as port detention fees and container detention fees, and even affecting the delivery date of customers, triggering order default risks.

### Answer 8

For export goods involving special packaging, such as dangerous goods, fragile goods, etc., MSDS reports and packaging inspection certificates are important supporting materials for tax refund declarations. If an enterprise fails to handle tax refund or tax exemption declarations, if these special packaging documents are not filed in time or lost, subsequent supplementary declarations will be rejected by the tax department due to the inability to provide complete packaging compliance certificates.

In addition, if an enterprise is listed as a tax abnormal household due to undeclared tax refund, packaging inspection institutions may refuse to issue packaging inspection certificates for subsequent goods due to early warning information in the tax system, resulting in goods being unable to be shipped on time, generating additional costs such as warehouse rental and port detention fees, and even triggering customs seizure risks.

### Answer 9

The core of export tax refund audit is to verify the "four flows consistency" of goods, invoices, payments and documents. If an enterprise fails to handle tax refund or tax exemption declarations, the audit department will list this batch of goods as a key audit object, requiring the enterprise to provide supporting materials for the four flows consistency, such as purchase contracts, VAT invoices, foreign exchange receipt slips, customs declaration forms, etc. If the enterprise cannot provide complete supporting materials, the audit department will suspect that the enterprise has tax refund violations, require the enterprise to pay back the refunded tax or tax-exempt tax, impose a fine, and even list the enterprise as a tax dishonest person subject to enforcement, affecting the enterprise's normal operation.

In addition, failing to handle tax refund or tax exemption declarations will lead to deviations in the enterprise's financial data, affecting the enterprise's annual audit report, making it impossible for the enterprise to pass the annual industrial and commercial inspection.

### Answer 10

From the perspective of supply chain cost refinement, failing to handle export tax refund or tax exemption declarations will increase the hidden costs of the enterprise. On the one hand, giving up tax refund will directly lose the profit corresponding to the tax refund amount. Calculated at an average tax refund rate of 13%, an export goods of 1 million yuan will lose 130,000 yuan in profit.

On the other hand, tax abnormalities, customs clearance delays and other issues caused by undeclared declarations will lead to additional cost expenditures, such as late fees, port detention fees, warehouse rental, etc., and the cumulative cost may exceed the amount of the tax refund. In addition, undeclared declarations will affect the enterprise's supply chain credit rating, leading logistics enterprises, suppliers and other parties to raise cooperation thresholds, increasing the enterprise's supply chain costs.
