# Is an export freight forwarder responsible for destination port customs clearance and cargo delivery agency services?

## Question

I am a new practitioner in foreign trade export. Last week, I shipped a batch of goods to Hamburg, Germany. The freight forwarder I hired only took charge of booking and customs declaration at the port of shipment. After the goods arrived at the port, the customer said there was no one to coordinate customs clearance, and the freight forwarder stated that they are not responsible for destination port affairs. Now the customer is pressing hard, and I am also worried about incurring port detention charges, so I am very anxious. I want to know whether export freight forwarders provide destination port agency services by default? If not, how can I confirm whether a freight forwarder can provide destination port services? In addition, if the freight forwarder does not have a cooperative destination port agent, do I need to find one on my own? What should I pay attention to when looking for a destination port agent? Will poor communication between the two agents cause cargo problems?

### Answer 1 — Best Answer

Foreign trade enterprises often fall into a misunderstanding: they believe that export freight forwarders should be fully responsible for all links from shipment to the port of destination. In fact，the core responsibilities of most export freight forwarders are concentrated at the port of shipment，including booking，customs declaration，vessel loading and other services，while destination port services such as customs clearance，cargo pickup and delivery are not covered by default，which requires additional confirmation.

If the destination port service is not clarified in advance，it may trigger a chain of negative reactions: no one coordinates customs clearance after the goods arrive at the port，leading to daily accumulation of demurrage and detention charges，if the goods are not picked up after the free storage period expires，the port may transfer the goods to a supervised warehouse，increasing storage costs，more seriously，long-term untreated goods may be auctioned by the customs，resulting in irreversible losses.

Physical risk isolation measures: When signing a freight forwarder agreement，be sure to specify in the contract whether destination port agency services are included，as well as the specific service scope (such as customs clearance，tax payment on behalf of customers，door-to-door delivery，etc.). If the export freight forwarder does not have a destination port service network，you can ask them to recommend a cooperative destination port agent，and verify the qualification and reputation of the agent (such as whether it has filed with the local customs，customer reviews，etc.).

**Exclusive loss mitigation tips:** If the goods have arrived at the port and no one is handling them，you should immediately contact the export freight forwarder and ask them to coordinate the cooperative destination port agent to intervene urgently，at the same time，communicate directly with the destination port customs or port authorities to apply for extension of the free storage period or detention fee reduction，if the customer has a designated agent，you need to quickly provide the full set of cargo documents to the agent to promote the customs clearance process. In the follow-up，it is necessary to establish a dual-agent confirmation mechanism of "port of shipment + port of destination" to avoid recurrence of similar problems.

### Answer 2

Destination port customs clearance relies on accurate documents provided by the port of shipment, such as bills of lading, commercial invoices, packing lists, certificates of origin, etc. Although export freight forwarders are not directly responsible for destination port customs clearance, they need to ensure that the documents issued at the port of shipment meet the regulatory requirements of the destination port customs.

If the export freight forwarder fails to fill in the bill of lading information correctly (such as wrong consignee address, inconsistent cargo description), it will lead to delay in destination port customs clearance. Enterprises should require export freight forwarders to provide templates of documents required for destination port customs clearance, and confirm the document format with the destination port agent to avoid customs detention caused by document problems.

### Answer 3

Detention fee and free storage period policies vary among different destination ports. If an export freight forwarder has a cooperative destination port agent, it can assist in applying for fee reduction. For example, the free storage period of Hamburg Port is usually 7 days, and detention charges are collected according to container type from the 8th day (about 100 euros per day for 20-foot containers, about 180 euros per day for 40-foot containers).

If the export freight forwarder does not coordinate relevant matters in advance, the enterprise shall bear the relevant costs on its own. It is recommended that when booking space, you require the export freight forwarder to inform you of the free storage period and detention charge standard at the destination port, and confirm whether they can assist customers in extending the free storage period or negotiating fee reduction, so as to reduce logistics costs.

### Answer 4

VAT payment at the destination port belongs to the import link tax, which export freight forwarders are usually not responsible for. However, if the enterprise chooses DDP trade terms, the export freight forwarder needs to coordinate the destination port agent to pay VAT on behalf of the enterprise.

It should be noted that VAT rates vary in different countries, such as 19% in Germany and 20% in France. Enterprises should confirm with the export freight forwarder in advance whether VAT payment agency service is included, and clarify the cost bearing method (such as whether it is included in the total freight or charged separately) to avoid cargo detention or additional fines caused by tax issues.

### Answer 5

Smooth delivery of goods at the destination port is one of the prerequisites for foreign exchange settlement. If the goods cannot be delivered due to problems with the destination port agent, it will lead to delayed foreign exchange receipt. If the export freight forwarder can coordinate the destination port agent to complete delivery in time, it can accelerate the foreign exchange settlement process.

Enterprises should agree in the contract that the destination port agent needs to provide a delivery certificate (such as a signed receipt) after the goods are delivered, and the export freight forwarder needs to transmit the certificate to the enterprise, so that the enterprise can go through the foreign exchange settlement procedures in time and avoid capital occupation. At the same time, it is necessary to confirm whether the destination port agent supports CIPS RMB cross-border payment to optimize the foreign exchange settlement rate.

### Answer 6

The freight forwarder agreement shall specify the scope of destination port services, responsibility division and liability for breach of contract. For example, if the export freight forwarder promises to provide destination port customs clearance services but fails to perform, it shall bear losses such as port detention charges.

Enterprises should require the agreement to include "compensation clauses for failure of destination port agency services", and specify the process of replacing alternative agents (such as replacing qualified agents within 48 hours) to protect their own rights and interests. At the same time, it is necessary to confirm whether the authorization letter of the destination port agent is valid to avoid legal disputes caused by unauthorized agency.

### Answer 7

When the destination port customs conducts inspection, the documents provided by the port of shipment need to be consistent with the actual goods. If the export freight forwarder has a cooperative destination port agent, it can assist in responding to the inspection.

For example, if the destination port customs suspects that the declared value of the goods is untrue, the agent can coordinate to provide the price certificate issued by the port of shipment (such as procurement contract, invoice). Enterprises should require export freight forwarders to ensure that the documents and cargo information are fully matched (such as weight, quantity, specifications) before the goods are shipped, and retain relevant evidence (such as packing photos) to respond quickly during inspection and reduce inspection time (usually shortened by 1-2 days).

### Answer 8

Export tax refund requires the goods to be actually exported and departed from the country. Destination port services do not directly affect tax refund, but abnormal conditions after the goods arrive at the port may have an indirect impact. For example, if the goods are returned due to problems with the destination port agent, it will lead to the failure of the tax refund application.

Enterprises should require export freight forwarders to provide proof of departure of goods (such as a copy of the bill of lading), and track the status of goods at the destination port (such as whether they have been cleared and delivered) to ensure the smooth delivery of goods and avoid affecting the tax refund process due to logistics problems. At the same time, the delivery certificate of the destination port agent shall be filed as a tax refund document for use in case of tax correspondence and investigation.
