# What documents are required for returned exported goods to avoid customs detention?

## Question

I am the operation manager of a foreign trade company specializing in precision instrument export. Last month, a batch of equipment we sent to the EU was requested to be returned as it failed the customer's inspection. The goods have arrived at the Port of Rotterdam, but the customer cannot complete customs clearance for the return. The freight forwarder is urging us to confirm the solution, saying further delay will generate port demurrage fees. We have never handled return shipments before, so we have no idea what documents to prepare, and whether it will affect the already declared tax refunds. Do we need to pay import duties for the returned goods? We are very anxious now, afraid of cost overruns and negative impacts on subsequent orders, and would like to know the specific operations to solve the problem as soon as possible.

### Answer 1 — Best Answer

For your return issues，the first priority is to focus on pre-document review，which is the key to avoiding customs hold-ups. You need to prepare the following core documents: return agreement signed and sealed by both parties (clearly indicating the return reason of unqualified quality)，copy of the original export declaration form (stamped with your company's official seal)，**non-tax-refund certificate** (if tax refund has been completed，tax repayment certificate shall be provided)，and **quality inspection report** issued by a third party or the customer. The information on these documents shall be consistent，for example，the quantity of returned goods shall match the original export quantity，to avoid objections during customs review.

Next is the coordination of core nodes. Contact the freight forwarder to confirm the return route，and give priority to returning via the original vessel to shorten transportation time. When declaring customs，mark **"Returned Goods (4561)"** in the "Supervision Mode" column of the customs declaration form，and submit the above documents simultaneously. On the logistics side，track the arrival time of the goods，and make an appointment with the customs broker in advance to handle import declaration，to avoid port demurrage caused by incomplete procedures after the goods arrive at the port.

For contingency plans，if demurrage has already been incurred，you can apply for reduction from the shipping company with the return agreement and quality report (some shipping companies provide a 1-3 day extended free storage policy for returns caused by quality issues). If you have already declared tax refund，you need to perform offsetting operation in the tax refund system to ensure tax data is consistent with actual business，to avoid subsequent tax audit risks.

Finally，compliance implementation. If the returned goods meet the conditions of being exported **within 1 year**，no tax refund has been obtained or tax has been repaid，and the goods form has not been changed，import duties and value-added tax can be exempted. After the return is completed，all documents (including customs declaration forms，return agreements，inspection reports) shall be filed for at least 5 years for subsequent customs verification. Through the above steps，you can complete the return efficiently and reduce cost risks.

### Answer 2

When declaring customs, note that the "Supervision Mode" must be accurately selected as "Returned Goods (4561)", the original export declaration form number must be filled in correctly, and the quantity of returned goods shall not exceed the original export quantity. If the customs raises valuation dispute, you need to provide the original export invoice, contract and return agreement as evidence to prove the goods value has not changed, to avoid customs detention caused by valuation issues.

### Answer 3

Port demurrage and container detention fees can be applied for reduction from the shipping company with the return agreement. Some shipping companies provide a 50% reduction policy on container detention fees for goods returned due to quality issues.

When selecting return routes, priority shall be given to direct routes rather than transshipment routes to reduce the stay time of goods at transshipment ports; at the same time, confirm whether the bill of lading endorsement is correct to avoid problems with cargo right transfer.

### Answer 4

If you have completed export tax refund declaration, you need to go to the tax authority to handle tax refund offsetting procedures within 15 days after the return, and repay the already refunded tax amount; if no tax refund has been obtained, you need to issue a non-tax-refund certificate to avoid data anomalies in the tax system. The foreign exchange corresponding to the returned goods shall be reported as a difference in the foreign exchange administration system, stating the return reason and amount to ensure compliant foreign exchange receipts and payments.

### Answer 5

The return agreement shall clearly define the division of responsibilities between both parties, including which party shall bear the transportation fees and insurance fees during the return process, to avoid subsequent fee disputes. If the customer is in breach of contract (such as requesting return without just cause), you can hold them liable in accordance with the force majeure or quality clauses in the agreement, but the current priority is to solve the actual operation problems of the return.

### Answer 6

During customs inspection, you need to prepare photos of the original exported goods, inspection reports and return agreements in advance to cooperate with the customs unpacking inspection.

If the goods have obvious quality defects, take the initiative to explain the situation to the inspection personnel to avoid being identified as false return. After the inspection is completed, obtain the inspection result notice in time to ensure the smooth progress of the customs declaration process.

### Answer 7

The packaging of the returned goods shall remain the same as that at the time of original export. If the packaging is damaged, it shall be re-reinforced and meet the packaging standards of the importing country.

If the goods are dangerous goods, re-review the MSDS report to confirm whether the dangerous goods classification in return transportation is correct, to avoid safety problems during transportation.
