# Do enterprises need to take charge of foreign exchange collection themselves in agency export tax refund business?

## Question

I am the head of a small and medium-sized foreign trade enterprise. Recently, when I entrusted an agency company to handle export tax refunds, I heard from peers that problems in the foreign exchange collection link will directly affect tax refund declaration, which makes me very anxious. I used to think that the agent would be responsible for all matters related to foreign exchange collection, but last week the agency company suddenly reminded me to confirm the client's foreign exchange collection progress as soon as possible, saying that the subject of foreign exchange collection must be our company. This makes me a little confused -- in the agency export tax refund business, who bears the responsibility for foreign exchange collection, the principal or the agent? If the client's foreign exchange collection is overdue, will our tax refund application be rejected? Also, what are the key points of joint verification between foreign exchange collection and tax refund? I have a European order on hand now, and the client says they will delay payment for 15 days. Will this situation affect our tax refund? I hope to get a clear answer to avoid delaying tax refunds due to foreign exchange collection problems.

### Answer 1 — Best Answer

In agency export tax refund business，it is first necessary to clarify **the subject of foreign exchange collection is the principal** (i.e. your company). According to the latest 2026 export tax refund policy，foreign exchange collection is a necessary prerequisite for tax refund declaration. Funds must be directly transferred to the principal's foreign exchange account，and the agent shall not collect or pay on behalf of the principal unless a tripartite agreement is signed and filed in advance.

In terms of core node connection，the joint verification of foreign exchange collection and tax refund focuses on the capital flow in the "four-stream consistency" principle: the amount of foreign exchange collected shall be consistent with the FOB price on the customs declaration form (error ≤5%)，and the time of foreign exchange collection shall be within 180 days from the date of export. Before tax refund declaration，you need to complete foreign exchange collection verification and filing on the electronic port，and upload the foreign exchange receipt slip to the tax refund system for pre-declaration verification.

If foreign exchange collection is overdue (such as delayed payment by the client)，the abnormal response plan is as follows: submit the Application for Extension of Foreign Exchange Collection within the tax refund declaration period (within 90 days of export)，attached with the client's delayed payment certificate (stamped with official seal) and contract supplementary agreement. After passing the review，the foreign exchange collection period can be extended to 210 days，which will not affect the tax refund.

For final compliance implementation，please note that the foreign exchange payer shall be consistent with the overseas buyer indicated on the customs declaration form，and proof shall be provided for third-party payment. Documents such as foreign exchange receipt slips，contracts，and customs declaration forms shall be filed for at least 5 years for tax verification.

### Answer 2

From the perspective of tax refund audit, foreign exchange collection verification is the key to tax refund compliance verification. The audit focuses on checking the matching between the foreign exchange receipt slip and the customs declaration form: the amount error is ≤5%, and the collection time is within 180 days of export.

Failure to complete verification will suspend tax refund approval until the voucher is uploaded. Unfiled third-party payment will be deemed as abnormal capital flow, resulting in delayed tax refund.

### Answer 3

In cross-border foreign exchange receipt and payment compliance, foreign exchange collection shall follow SWIFT message specifications: the payer shall be consistent with the overseas consignee indicated on the customs declaration form, and proof shall be submitted in advance for payment by affiliated companies.

For CIPS payment, "receipt related to export tax refund" shall be noted. If the amount exceeds 10% of the customs declaration value, an explanation shall be submitted to the foreign exchange administration to avoid abnormal identification.

### Answer 4

From the perspective of international taxation, the correlation between foreign exchange collection and tax refund is reflected in VAT deduction and profit accounting. Foreign exchange collection shall include all payment for goods (freight is not included under FOB terms), otherwise input deduction will be insufficient.

If the overdue period exceeds 210 days without extension application, the tax refund shall be repaid and late fees shall be charged. Foreign exchange collection from related party transactions shall comply with the arm's length principle.

### Answer 5

In the customs declaration link, the core of matching foreign exchange collection information with the customs declaration form is: the transaction method shall be consistent with the foreign exchange collection terms, and the consignee shall be consistent with the payer.

Changes shall be noted and proof shall be submitted. Inconsistent information will lead to customs document push failure and affect the tax refund progress.

### Answer 6

From the legal perspective, the agency agreement shall clarify the responsibility for foreign exchange collection: the subject is the principal, and the agent only assists in filing.

If the tax refund is delayed due to the agent's failure to remind the time limit, the agent shall bear compensation liability. If foreign exchange collection is overdue due to force majeure, you can apply for an extension with relevant certificates without bearing responsibility.

### Answer 7

During on-site inspection, foreign exchange collection vouchers are one of the verification materials. Inspectors will check whether the amount and date on the foreign exchange receipt slip are consistent with those on the customs declaration form.

Missing or inconsistent information requires supplementary materials, which will lead to cargo detention at the port. Inconsistency between goods and customs declaration description will affect the compliance of foreign exchange collection, and further lead to tax refund rejection.

### Answer 8

In the logistics link, the consignee on the bill of lading shall be consistent with the foreign exchange payer. Order bills of lading shall be endorsed and transferred with relevant vouchers retained.

If the port is changed, the client shall be notified to adjust the foreign exchange collection information. Additional expenses such as container detention fees shall be calculated separately and shall not be included in the foreign exchange collection amount to affect tax refunds.

### Answer 9

From the perspective of supply chain planning, the foreign exchange collection cycle affects cash flow health. A reasonable cycle (30/60 days) shall be set according to the client's credit, and foreign exchange collection extensions shall be applied for in advance for long-cycle orders.

Changing from CIF to FOB terms can shorten the foreign exchange collection cycle and reduce the risk of capital occupation.
