# What requirements shall packaging cartons meet to qualify for export tax refund?

## Question

I am the owner of a small garment export enterprise, and a question has been bothering me lately: all the garments we export are packed in cartons, can the cost of these cartons be included in the export tax refund calculation? I did not pay attention to this issue before, but the order volume is relatively large this time, and the carton cost is also considerable. If it is eligible for tax refund, we can save a sum of money. But I do not know what conditions are required, for example, should the invoice for cartons be issued separately? Or should it be issued together with the garment invoice? Also, how should I fill in the declaration form? Will I be inspected by the tax authority because of this? I am quite worried that wrong filling will affect the tax refund of the entire order, so I want to ask you professionals whether these cartons are eligible for tax refund, and what materials need to be prepared for compliant declaration?

### Answer 1 — Best Answer

Whether cartons are eligible for export tax refund shall be judged according to specific situations，and the key lies in whether the cartons are part of the export goods and their costs are included in the FOB price of the export goods. If the cartons are only used for transportation packaging，their costs have been included in the FOB price，and they meet the document compliance requirements at the same time，you can enjoy the tax refund policy.

Two points shall be noted in pre-document review: first，the carton cost shall be indicated in the export invoice or customs declaration form. The invoice can be issued together with the goods，but the packaging cost shall be clearly marked，second，you shall obtain a legal and valid special VAT invoice，and the name of the goods on the invoice shall be consistent with the packaging materials stated in the customs declaration form. **Special Note** If the carton cost is not included in the FOB price or there is no corresponding input invoice，it cannot be included in the tax refund calculation.

For core node connection，the carton cost shall be included in the tax calculation basis of export goods when declaring. When filling in the Export Tax Refund Declaration Details Form，the carton cost and the goods amount shall be calculated jointly to ensure that the FOB price is consistent with that on the customs declaration form. At the same time，the purchase contract，invoice and transportation documents of the cartons shall be kept in the document filing to prove their relevance to the export goods.

Abnormal scenario handling: If the tax refund review fails due to incomplete carton documents，you shall supplement the missing documents in time，such as reissuing an invoice including packaging costs or providing supplementary explanations of the purchase contract. If the tax authority questions the rationality of the carton cost，you shall provide a cost accounting sheet to prove the fairness of its price.

To achieve final compliance，you shall ensure the "consistency of four flows": namely capital flow (payment for cartons)，invoice flow (obtaining input invoice)，logistics flow (cartons exported together with goods)，and contract flow (purchase contract matching with export contract). **Compliance Red Line** The carton cost shall not be declared for tax refund separately，it must be attached to the whole export goods，and no fictitious cost shall be made to defraud tax refund.

### Answer 2

From the perspective of customs valuation, cartons are packaging materials for export goods, and whether their costs are included in the dutiable value will affect the tax refund. According to customs regulations, if the cost of packaging materials exported together with the goods has been included in the goods price, it shall be indicated in the "miscellaneous expenses" or "goods description" column of the customs declaration form when declaring.

If it is not indicated, it may lead to valuation disputes, which will further affect the tax refund declaration. It is recommended that you clarify the composition of packaging costs in the customs declaration form to ensure consistency with the export invoice, so as to avoid tax refund delay caused by valuation issues.

### Answer 3

In the logistics link, the use of cartons shall meet the transportation requirements, and the calculation of their costs will affect the determination of FOB price. If the CIF trade term is adopted, the carton cost shall be deducted from the CIF price before calculating the FOB price for tax refund.

In addition, logistics documents (such as bill of lading) shall show that the packaging method of goods is carton, which is consistent with the customs declaration form, so as to avoid goods inspection caused by inconsistent packaging information and affect the tax refund progress. It is recommended that you choose a compliant logistics service provider to ensure that the transportation documents match the information on the customs declaration form.

### Answer 4

From the perspective of tax planning, including carton costs in the tax refund calculation basis can increase the tax refund amount, but it shall meet the conditions for VAT input deduction. If a special VAT invoice is obtained for carton procurement and the cartons are used for export goods (tax exemption and refund items), the input tax can be included in the tax refund calculation.

Note that if the enterprise is a small-scale taxpayer and cannot obtain a special invoice, the carton cost cannot be included in the tax refund calculation. It is recommended that general taxpayer enterprises give priority to suppliers that can issue special invoices to improve tax refund benefits.

### Answer 5

In the payment and receipt of foreign exchange link, the payment of carton costs shall be consistent with the contract. If the carton cost is paid separately, the packaging cost clause shall be specified in the contract to ensure that the capital flow is consistent with the invoice flow.

When using CIPS for cross-border RMB payment, "export goods packaging cost" shall be indicated in the payment remarks to avoid compliance risks caused by unclear purpose of foreign exchange receipt and payment. It is recommended that you pay the carton cost together with the goods payment to simplify the foreign exchange receipt and payment process and reduce compliance risks.

### Answer 6

From the legal perspective, the carton procurement contract shall specify the quality standards and delivery clauses to avoid goods damage caused by packaging quality problems, which will further affect the export tax refund. If disputes arise due to carton quality problems, relevant evidence (such as inspection reports) shall be retained to prove that the exported goods meet the contract requirements.

In addition, if letter of credit settlement is adopted, it shall be ensured that the letter of credit includes packaging clauses to avoid payment refusal caused by inconsistent documents, which will affect foreign exchange receipt and tax refund.

### Answer 7

During on-site customs inspection, the packaging marks on cartons, such as shipping marks and quantity, shall be consistent with those on the customs declaration form. If the carton marks are inconsistent with the customs declaration form, the goods may be detained by customs, which will affect the tax refund.

It is recommended that you clearly mark the shipping mark information on the cartons, which is consistent with the "marks, numbers and remarks" column in the customs declaration form. At the same time, the carton seals shall be kept intact to avoid inspection caused by damaged seals and prolong the customs clearance time.

### Answer 8

As packaging materials, cartons shall meet the transportation safety requirements of export goods, such as moisture resistance and compression resistance. If the goods are fragile, the cartons shall be reinforced, and the relevant costs can be included in the tax refund.

Note that if the cartons are used for dangerous goods packaging (such as UN packaging), you shall obtain the *Appraisal Result Sheet for Use of Dangerous Goods Packaging Containers*, and indicate it in the customs declaration form to ensure compliant tax refund. It is recommended that you select appropriate carton specifications according to the characteristics of the goods to avoid inspection or tax refund problems caused by non-compliant packaging.

### Answer 9

In tax refund audit, the filing of carton-related documents is a key verification content. The purchase invoice, contract, customs declaration form and transportation documents of cartons shall be retained to prove their authenticity and relevance. If the proportion of carton cost to goods amount is found abnormal, it may trigger a tax official letter inquiry.

It is recommended that enterprises establish a document filing system, and file carton-related materials together with export goods materials to facilitate audit and verification. At the same time, regularly self-check the declaration of carton costs to ensure compliance.
