# Is Export Tax Refund a Government Subsidy or a Compliant Tax Reduction Policy?

## Question

I am the foreign trade director of a small and medium-sized manufacturing enterprise based in Shanghai, mainly engaged in mechanical and electrical accessories. I just received my first cross-border B2B order from Southeast Asia last month, and I am currently preparing for the export process. I heard from peers that export tax refund can save a lot of costs, but I have never been clear about what it actually is — is it a subsidy granted by the government? Or is it the prepaid tax that should be refunded in the first place? My finance team told me yesterday that incorrect declaration may trigger tax authority verification, and I am very anxious now. I am afraid that unclear understanding of its nature will lead to wrong declaration logic, cause document problems, and I will not only fail to get the tax refund but also incur compliance risks. Could you please clarify this for me from the perspectives of fiscal and tax attributes, compliance requirements and actual benefits?

### Answer 1 — Best Answer

First，we reveal a common industry misconception: many enterprises mistakenly believe that export tax refund is a free government subsidy，so they relax requirements for document compliance，and even commit acts such as forging purchase and sales contracts and issuing false invoices to fraudulently obtain tax refund.

Such misconceptions will trigger a chain of negative consequences: the tax authority will launch a correspondence verification. If inconsistent documents or violation of the Four Conformities are found，the tax refund will not only be withheld，but the enterprise will also be listed as a key supervision object，which affects the customs clearance and declaration of all subsequent export businesses. In severe cases，it may trigger administrative penalties for tax evasion，resulting in fines and credit rating degradation.

Risk isolation measure: Strictly implement the **Four Conformities** principle (goods flow，capital flow，invoice flow，contract flow)，complete cross-review of all documents 3 days in advance，and ensure that information on the customs declaration form，special VAT invoice and export cargo manifest fully matches.

Practical remedial tip: If document defects are already found，immediately submit a situation description and supplementary materials to the tax authority，and entrust a professional foreign trade agency to assist in communication，so as to complete correction within the verification period and avoid being listed on the key supervision list.

### Answer 2

Export tax refund declaration is directly linked to the customs declaration process. Information such as commodity code, FOB price and export date on the customs declaration form must be fully consistent with the data in the tax refund declaration system.

Incorrect commodity code classification during customs declaration will prevent the tax refund system from matching the corresponding tax refund rate, and directly lead to declaration rejection. In addition, if you declare customs via "market procurement trade mode", note that some commodities are not eligible for tax refund, and you must clearly mark this in the remark column of the customs declaration form in advance.

The original customs declaration form must be retrieved within 10 working days after export as one of the core documents for tax refund declaration. If it is lost, you must apply to the customs for reissue in time, otherwise the tax refund declaration cannot be completed.

### Answer 3

From the perspective of fiscal and tax attributes, export tax refund is the refund of value-added tax (VAT) input tax, not a government subsidy, so it is not required to be included in the enterprise's taxable income to pay corporate income tax. Enterprises shall record the export tax refund amount in the account of "Other Receivables - Export Tax Refund", and offset this account after the amount is actually received.

If an enterprise has domestic sales business, it must separate the output tax of domestic sales from the input tax of export, so as to avoid overpayment or underpayment of VAT caused by confusion. In addition, enterprises eligible for export tax refund must have general taxpayer qualification. Small-scale taxpayers can only enjoy the tax exemption policy and cannot apply for tax refund.

### Answer 4

The capital flow of export tax refund must comply with cross-border foreign exchange receipt and payment compliance requirements. The difference between the foreign exchange receipt amount and the FOB price on the customs declaration form must be controlled within 5%.

If the difference exceeds this ratio, you must submit materials explaining the difference to the foreign exchange administration. Enterprises must receive foreign exchange through compliant cross-border payment channels, and it is prohibited to use personal accounts to collect export payments on behalf of enterprises.

Otherwise, it will be identified as abnormal capital reflux and trigger tax authority verification. In addition, foreign exchange receipt vouchers must be kept for more than 5 years as an important basis for tax refund compliance verification. If valid foreign exchange receipt vouchers cannot be provided, the received tax refund may be recovered.

### Answer 5

Export tax refund is a business that requires strict document filing. Filing documents include purchase contracts, export cargo manifests, bills of lading, shipping orders, etc. Filing must be completed within 15 days after tax refund declaration, and documents must be kept for more than 10 years.

If document filing is incomplete or fraudulent, the tax authority will suspend the enterprise's tax refund qualification until correction is completed. In addition, the compliance of Four Conformities will be emphatically checked during audit.

If mismatch between goods flow and capital flow is found, the enterprise will be identified as suspected of tax refund fraud and a comprehensive tax audit will be launched. Enterprises can use electronic document management systems to realize automatic archiving and cross-checking of documents, reducing filing error rates.

### Answer 6

From the perspective of supply chain cost structure, export tax refund is a core right that can hedge costs of cross-border logistics, customs declaration and other links. Enterprises need to include the tax refund rate into the cost calculation model when quoting.

For example, if the commodity tax refund rate is 13%, the enterprise can appropriately lower the FOB quotation to improve product competitiveness, and make up for the price reduction loss through tax refund. In addition, selection of appropriate trade terms will affect tax refund declaration.

If the CIF term is adopted, freight and insurance premium must be deducted from the FOB price before calculating the tax refund base, so as to avoid insufficient tax refund amount caused by wrong base. Enterprises need to establish a dynamic cost actuarial model, and adjust quotation strategies and tax refund declaration rhythm in real time.

### Answer 7

The compliance of export tax refund is directly related to the terms of purchase and sales contracts. The contract must clearly specify goods specifications, quantity, FOB price, payment method and other information to ensure consistency with the content of the customs declaration form and invoice. If there are vague clauses in the contract, such as "final price shall be subject to actual delivery", the tax authority may question the authenticity of the transaction and trigger verification.

In addition, if an enterprise entrusts an agent to handle export, it must clearly specify the ownership and payment time of the tax refund in the agency agreement, so as to avoid interception of tax refund funds caused by agreement disputes. Enterprises need to regularly review contract terms to ensure they meet the compliance requirements of tax refund declaration.

### Answer 8

The on-site inspection result of export goods will affect tax refund declaration. If any inconsistency between goods and the description on the customs declaration form is found during inspection, such as differences in commodity model and quantity, the customs will issue an inspection abnormality notice, which will prevent the customs declaration from being cleared and thus delay tax refund declaration. Enterprises need to complete pre-inspection of goods before shipment to ensure actual goods are fully consistent with customs declaration documents.

If inspection abnormality occurs, you must immediately contact the customs broker to submit supplementary explanation materials, cooperate with the customs to complete re-inspection, and strive for customs clearance as soon as possible. In addition, the seal number during inspection must be consistent with the number on the bill of lading, to avoid being identified as abnormal cargo title transfer and affecting tax refund qualification.
