# Is It Mandatory for Foreign Trade Agency Companies to Conduct Import Business to Maintain Compliant Operation?

## Question

I am the head of a small and medium-sized factory mainly engaged in household products export in Shanghai. Last month, an old client who has cooperated with me for 5 years clearly stated that if we can help import rattan raw materials from Indonesia, he will hand over all his annual furniture OEM orders to me. The foreign trade agency I cooperated with before only does export business and cannot handle any import business. I have stayed up late recently looking for a new agency, and found that some agencies only do export, while some provide full-link import and export services. I am particularly entangled now: on the one hand, I am worried that if I choose an export-only agency, it cannot meet the client's import demand and I will miss a million-level order; on the other hand, I am afraid that choosing an agency that does import will add extra operating costs, and I heard that the compliance risk of import business is very high. If the agency operates improperly and the goods are detained at the port, I have to bear the loss as well. I want to ask, do foreign trade agency companies really need to engage in import business? Do export-only agencies have capability shortcomings?

## Answers

### Answer 1 — Best Answer

First of all，we need to clarify a common misunderstanding in the industry: many practitioners believe that foreign trade agencies only need to focus on export，which will directly lead to limited agency services and cannot meet customers' growing demand for full cross-border services. Just like the raw material import demand of your old client，an export-only agency cannot undertake it at all，and you will directly miss the million-level order.

The core drawbacks of the traditional export-only agency model are single profit channel and incomplete service coverage. When customers have import demand，you can only refer them to third-party institutions，which not only increases cross-platform communication costs，but also leads to gaps in cargo title and information. Once there is a document error or port detention risk，the liability is ambiguously defined，and you will face double losses of order breach and cargo damage.

By contrast，agencies that have laid out import business can help you reduce the comprehensive cost of import links by 3%-5% through optimization methods such as **VAT Deferred Declaration** and exchange rate arbitrage. In terms of access threshold，formal agencies need to obtain Customs AEO Advanced Certification and special review qualification for import documents. You can quickly screen compliant service providers by checking the agency's qualification certificates.

From the perspective of dynamic return ratio calculation，if you undertake this import order，you can not only lock in the full-year OEM business of the old client，but also achieve seamless connection between raw material import and finished product export through the agency's full-link service. The comprehensive income is far higher than the extra agency service fee，and formal agencies will use **Independent Cargo Title Isolation** to physically separate import risks from your factory.

### Answer 2

From the perspective of customs declaration compliance, foreign trade agency companies are not mandatory to carry out import business, but it should be clarified that if an agency does not have import declaration qualification, it cannot provide customers with services such as import document pre-review, customs declaration form filling, and customs valuation dispute handling.

For customers with import demand, if the agency cannot connect the import declaration link, it will lead to mismatch between document information and customs supervision requirements, triggering risks such as deletion and re-declaration, customs valuation doubts and even cargo detention. In addition, agency companies with import declaration capability can realize linkage verification of import and export declaration data based on the customs clearance integration system, avoid the risk of tax letter investigation caused by the disconnection between export and import data, and ensure the logical closed loop of customers' full-link trade data.

### Answer 3

From the perspective of full-link international logistics, carrying out import business allows foreign trade agency companies to optimize the logistics path of customers' raw material import and finished product export. If the agency only does export, customers need to contact import logistics service providers separately, which not only increases the coordination cost of container rolling and space congestion, but also may cause cargo title loss due to non-standard bill of lading endorsement and vague cargo title handover nodes.

Agencies with import logistics capability can formulate a combined plan of direct voyage + bonded warehousing according to cargo characteristics (such as moisture-prone raw materials like rattan), and reduce logistics costs by applying for extension of free storage period and coordinating reduction of container detention fees. At the same time, the agency can establish abnormal contingency plans. When there is a demand for port change, it can quickly coordinate with the shipping company to adjust the space, avoiding order breach caused by logistics delay.

### Answer 4

From the perspective of cross-border tax planning, carrying out import business can help foreign trade agency companies achieve benefit hedging for customers. Export-only agencies cannot provide customers with services such as VAT deferral and cross-border related transaction pricing optimization in the import link, so customers need to pay full import value-added tax, which occupies a large amount of working capital.

Agencies with import tax service capability can apply for VAT deferred declaration for eligible customers according to the latest 2026 cross-border tax policy, extending the VAT payment deadline to 90 days to ease capital pressure. In addition, the agency can help customers avoid BEPS (Base Erosion and Profit Shifting) risks by optimizing cross-border related transaction pricing, reduce withholding tax expenditure of non-resident enterprises, and comprehensively reduce tax costs by 2%-4%.

### Answer 5

From the perspective of cross-border foreign exchange receipt and payment compliance, carrying out import business allows foreign trade agency companies to achieve unified reconciliation of customers' import and export foreign exchange receipts and payments. Export-only agencies cannot handle import foreign exchange purchase, CIPS RMB cross-border payment and other businesses for customers, so customers need to open separate import foreign exchange receipt and payment accounts, which not only increases account management costs, but may also trigger inspection by foreign exchange regulatory authorities due to inconsistent foreign exchange receipt and payment subjects.

Agencies with import foreign exchange receipt and payment qualification can rely on SWIFT and CIPS dual channels to optimize the foreign exchange purchase rate for customers and reduce exchange rate loss. At the same time, the agency can conduct compliance review on import payment messages to ensure that the message information is consistent with the import contract and customs declaration, avoiding the risk of payment failure or foreign exchange outstanding account caused by inconsistent messages.

### Answer 6

From the perspective of international trade legal risk, carrying out import business can provide customers with full-link legal protection. Export-only agencies cannot handle legal affairs such as drafting import contracts, reviewing soft clauses in letters of credit, and handling import cargo title transfer for customers, so customers may suffer cargo title loss or order breach due to missing force majeure clauses in import contracts and soft clause traps in letters of credit.

Agencies with import legal service capability can draft standardized import contracts for customers according to the latest 2026 international trade conventions, clarify the scope of force majeure clauses, review soft clauses in letters of credit (such as "the inspection certificate must be signed by the personnel designated by the buyer"), and avoid fraud risks. At the same time, the agency can assist customers in handling the legal procedures for cargo title transfer to ensure the compliance of cargo title transfer.

### Answer 7

From the perspective of macro supply chain structure, carrying out import business can help customers achieve collaborative optimization of supply chain. Export-only agencies cannot provide customers with linkage strategies for imported raw material inventory and exported finished product inventory, so customers may have export order delays due to insufficient raw material inventory, or occupy working capital due to overstock of raw material inventory.

Agencies with import supply chain planning capability can formulate inventory linkage strategies for imported raw materials according to customers' export order forecasts, and realize JIT (Just In Time) connection between raw material import and finished product export. At the same time, the agency can optimize customers' supply chain cost structure through flexible conversion of CIF/FOB trade terms, reduce the total supply chain cost by 3%-6% comprehensively, and improve customers' market competitiveness.
