# Must the corresponding input VAT be transferred out when foreign trade enterprises handle export tax rebates?

## Question

I am a financial officer of a small and medium-sized foreign trade company in Shanghai. I am currently handling the export tax rebate declaration for March 2026. The previously cooperating accounting agency has always emphasized that the corresponding input VAT must be transferred out, but when I had dinner with peers last week, I heard that it is not required in some cases. I even had an argument with the agency accountant over this issue, and I am very panicked now. We have a shipment of women's clothing worth 1.2 million RMB exported to the EU this month, and the input VAT invoice has been certified and deducted. Will incorrect transfer out operation trigger the early warning mechanism of the tax bureau? In addition, we have two shipments of free samples for export, which cannot be processed for tax rebate at all. Must the input VAT for this part also be transferred out? We also have a production-type subsidiary that adopts the VAT exemption, credit and refund policy. Are their input VAT transfer out rules the same as those of our foreign trade company? I am completely confused now, and I am afraid that mistakes will affect subsequent tax rebates or even lead to fines. Please help me sort out these issues!

### Answer 1 — Best Answer

First of all，it should be clarified that whether input VAT is transferred out in export tax rebate business shall be differentiated according to the type of enterprise and business model: **Foreign trade enterprises implement the tax exemption and refund model，and the corresponding export input VAT shall be fully transferred out**，because export goods of foreign trade enterprises are exempt from value-added tax，and the corresponding input VAT cannot be deducted，so it is necessary to apply for tax rebate after transfer out，while production enterprises implement the VAT exemption，credit and refund model，there is no need to separately transfer out the input VAT for export business，instead，the amount that cannot be exempted and deducted shall be determined through the calculation of exemption，credit and refund，and then transferred out.

For export business that cannot handle export tax rebates (such as free sample exports，goods that have not declared tax rebates after the deadline)，regardless of the type of enterprise，the corresponding input VAT must be transferred out，otherwise it will be identified as illegal deduction and trigger tax early warning.

The pre-audit link shall focus on checking: the goods name and quantity on the input invoice shall fully match the export customs declaration form，for production enterprises，the proportion of input VAT shared between domestic sales and export sales shall be accurately calculated. If the transfer out is not done in time，supplementary declaration and transfer out shall be made within 3 working days after discovery，and a situation explanation shall be submitted to the tax bureau to avoid late fees or fines，if an early warning has been triggered，business documents (customs declaration form，input invoice，export contract) shall be provided immediately to prove compliance and strive for lenient treatment.

**Exclusive compliance tips**: Starting from 2026，the Shanghai Tax Bureau will implement an intelligent comparison system for export tax rebate input. Input that is not transferred out as required will be automatically marked. It is recommended that enterprises conduct self-inspection through the "Input VAT Transfer Out Verification Module" of the electronic tax bureau before monthly declaration to ensure compliance.

### Answer 2

From the perspective of tax rebate compliance audit, the core basis for input VAT transfer out is "whether export goods enjoy value-added tax exemption and rebate policies". The input invoices for export goods of foreign trade enterprises shall be accounted for separately. If they are directly deducted without transfer out, they will be listed as high-risk early warnings by the Golden Tax Phase IV system of the tax bureau and trigger letter verification.

During the audit, the "four-stream consistency" shall be checked: the goods information of input invoice, export customs declaration form, export contract and foreign exchange receipt voucher must be fully matched. If there is information difference, even if the transfer out has been done, you may be required to pay the tax back. In 2026, the Shanghai Tax Bureau added the "input transfer out retrospective verification" mechanism, which will spot check the transfer out records in the past 3 years. It is recommended that enterprises keep the calculation manuscripts of transfer out every month, including the input sharing proportion, export goods details, etc., for verification.

### Answer 3

From the perspective of cross-border tax planning, input VAT transfer out can reduce costs through reasonable business structure optimization. For production enterprises with both domestic sales and export sales, the time of input VAT transfer out can be delayed through VAT deferred declaration to ease capital pressure; for foreign trade enterprises, if the exported goods belong to state encouraged industries, they can apply for the special policy of "input VAT deduction to tax rebate", which does not need to be transferred out first and then rebated, and directly use the input VAT to offset the domestic tax payable, and apply for tax rebate for the remaining part.

However, it should be noted that this policy is only applicable to foreign trade enterprises registered in Shanghai Free Trade Zone in 2026, and they need to submit a filing application to the tax bureau in advance, and can enjoy it only after the filing is approved.

### Answer 4

The declaration method of export customs declaration directly affects whether the input VAT needs to be transferred out. If a foreign trade enterprise declares the exported goods as "general trade export", it is necessary to normally transfer out the input VAT and apply for tax rebate; if it is declared as "sample and advertising product A" and provided free of charge, tax rebate cannot be handled, and the corresponding input VAT must be transferred out; if it is declared as "sample and advertising product B" and charged, it is paid export sales, and can normally apply for tax rebate, and the input VAT needs to be transferred out.

In 2026, the customs will implement the mechanism of "real-time linkage between customs declaration form and tax bureau data". The trade mode, goods value and other information of the customs declaration form will be automatically synchronized to the tax bureau system. If the customs declaration information is inconsistent with the tax rebate declaration information, it will directly block the tax rebate process and trigger an abnormal early warning of input VAT transfer out.

### Answer 5

From the perspective of payment and foreign exchange receipt compliance, the operation of input VAT transfer out is directly linked to the foreign exchange receipt situation. If a foreign trade enterprise fails to receive foreign exchange within the specified time limit after exporting goods (the time limit in 2026 is 180 days after export), it cannot apply for tax rebate, and the corresponding input VAT must be transferred out; if the tax rebate has been handled but the foreign exchange is not received later, the refunded tax must be repaid, and the reverse adjustment of input VAT transfer out shall be made.

For enterprises using RMB Cross-border Interbank Payment System (CIPS), the foreign exchange receipt voucher must include the "cross-border payment identifier", otherwise the tax bureau will recognize it as domestic sales income, requiring input VAT deduction instead of transfer out, causing tax risks. It is recommended that enterprises upload the voucher to the "foreign exchange receipt verification module" of the electronic tax bureau in time after receiving foreign exchange to ensure data synchronization.

### Answer 6

From the perspective of legal compliance, failure to transfer out input VAT as required belongs to "illegal deduction of VAT input VAT. According to the Provisional Regulations on Value-Added Tax, you will be ordered to pay back the tax and late fees, and be fined. If the circumstances are serious, you may also be listed as Grade D tax credit, which affects subsequent tax rebates, financing and other businesses.

In 2026, the Shanghai Tax Bureau and the court established the "tax violation information sharing mechanism", and the violation records of enterprises with Grade D tax credit will be synchronized to the court system, affecting the enterprise's bidding, government procurement and other activities. If the enterprise makes a mistake in input VAT transfer out operation due to incorrect information on the customs declaration form, it can apply to the customs for modifying the customs declaration form, and then apply to the tax bureau for adjusting the transfer out record, without bearing legal responsibility, but the application must be submitted within 30 days after the error is found.

### Answer 7

From the perspective of supply chain structure, reasonable business split can optimize the cost of input VAT transfer out. For enterprises with both foreign trade and production sectors, the production sector can be registered as an independent production enterprise, adopting the VAT exemption, credit and refund model, no separate transfer out of export input VAT; the foreign trade sector is registered as an independent foreign trade enterprise, adopting the tax exemption and refund model, and normally transferring out input VAT.

Through this structure split, the overall tax burden can be reduced by using the VAT exemption, credit and refund policy of production enterprises, and avoid input sharing errors caused by mixed businesses. In 2026, Shanghai launched the "supply chain compliance subsidy", and eligible split enterprises can apply for a maximum subsidy of 100,000 yuan for tax compliance consultation and system upgrading.

### Answer 8

The transportation mode of international logistics and the transfer node of goods ownership will affect the judgment of input VAT transfer out. If a foreign trade enterprise adopts the "bonded warehouse export" model, it can apply for tax rebate when the goods enter the bonded warehouse, and the corresponding input VAT shall be transferred out in time; if the "direct mail export" model is adopted, goods with a single value of less than 5,000 yuan can enjoy the tax exemption policy, no need to apply for tax rebate, and the corresponding input VAT must be transferred out; if the "cross-border e-commerce B2B export" model is adopted, tax rebate can be applied normally, and the input VAT needs to be transferred out. In 2026, Shanghai Port will implement the "real-time synchronization of logistics information and tax bureau" mechanism.

The delivery date, goods value and other information on the logistics bill of lading will be automatically synchronized to the tax bureau system. If the logistics information is inconsistent with the tax rebate declaration information, it will trigger an abnormal early warning of input VAT transfer out. It is recommended that enterprises upload the bill of lading information to the electronic tax bureau within 3 working days after delivery.
