# Do foreign trade companies need to file tax returns on their own when entrusting export agents?

## Question

I am the owner of a small and micro enterprise that has just started export business. Recently, I entrusted an agency to export a batch of textiles to Europe. Last week, the agent suddenly asked me to provide the value-added tax declaration form, saying that part of the tax needs to be declared by myself. I thought the agent would take full charge of all tax declaration matters before, and I am very worried now - will I be fined for missing declaration? The tax refund for this batch of goods has not been approved yet, and it will be troublesome if the tax declaration problem affects the tax refund. I heard that the export tax declaration process will change in 2026. I don't know what the agent is responsible for and what I should handle by myself. Is there a clear division standard? I hope to get professional answers to avoid pitfalls.

### Answer 1 — Best Answer

When a foreign trade enterprise entrusts an export agent，the tax declaration responsibility shall be clearly divided according to the agreement，and the core principle is the combination of "whoever exports shall declare" and "whoever receives foreign exchange shall get the tax refund". Export agents are usually responsible for customs declaration form submission and document sorting，while core tax matters such as value-added tax declaration and export tax refund declaration shall be completed by the entrusting enterprise or the authorized agent within the compliance framework.

In the pre-document review link，the enterprise shall provide the agent with complete materials such as special value-added tax invoices，export declaration forms，and foreign exchange receipt certificates. The agent shall assist in checking the consistency of documents to ensure that the product names on the invoices match those on the customs declaration form，and the amounts are consistent with the foreign exchange received. For core node connection，the "real-time synchronization of tax and customs data" mechanism is newly added in 2026. The agent shall synchronize the customs declaration information to the enterprise within 3 working days after customs declaration，so that the enterprise can complete the value-added tax declaration (including tax exemption or tax refund declaration) in time.

For the exception response plan，if the documents are inconsistent (for example，the difference between the invoice amount and the customs declaration amount exceeds 5%)，an application for modifying the customs declaration form or adjusting the invoice shall be submitted within 5 working days to avoid tax refund delay caused by inconsistent data. For final compliance implementation，the enterprise shall ensure that the tax refund declaration is completed within 90 days from the date of export. The agent can assist in preparing materials，but the enterprise shall submit the declaration through the electronic tax bureau.

**Key reminder:** Starting from 2026，export agency tax declaration shall complete data docking through the "Single Window". The enterprise shall authorize the agent to operate with its tax account，and keep all original documents for at least 5 years for inspection.

### Answer 2

From the perspective of customs declaration, the link related to export agency tax declaration is mainly the accuracy of customs declaration submission. In 2026, the customs will implement the "intelligent document review + manual recheck" mode. The "transaction method" and "trade terms" on the customs declaration form directly affect the subsequent tax declaration.

If the agent declares the transaction method as FOB but the enterprise actually settles accounts under CIF terms, an application for modification shall be submitted within 10 days after customs declaration, otherwise it will lead to wrong calculation of sales amount in value-added tax declaration. In addition, the "export date" on the customs declaration form is a key node for tax refund declaration. The agent shall ensure that this date is consistent with the actual departure date to avoid overdue tax refund.

### Answer 3

In cross-border tax planning, export agency tax declaration can use the VAT deferral policy to reduce capital occupation. In 2026, some European countries (such as Germany and France) allow non-resident enterprises to apply for import VAT deferral through agents, that is, no VAT is required to be paid at the time of import, and the tax shall be declared and paid after the goods are sold.

When an enterprise entrusts an agent to export to Europe, it can require the agent to assist in handling VAT deferral registration. The enterprise shall provide its VAT number and agency agreement, and ensure that the words "VAT deferral" are indicated on the import declaration form. This policy can reduce cash flow pressure, but the deferral period shall not exceed 90 days, otherwise late fee will be incurred.

### Answer 4

Payment and foreign exchange receipt compliance is closely related to tax declaration. After the upgrade of the CIPS system in 2026, cross-border foreign exchange receipt declaration shall be completed within 3 working days. The agent shall assist the enterprise to synchronize the foreign exchange receipt information to the tax system to ensure that the foreign exchange receipt amount is consistent with that on the customs declaration form.

If there is a difference in foreign exchange receipt (such as discount, commission), relevant supporting materials (such as commission agreement) shall be provided within 5 days after receiving the foreign exchange, otherwise it will be regarded as abnormal foreign exchange receipt and affect the tax refund. In addition, when an enterprise receives foreign exchange through the agent's offshore account, it shall ensure that the account information is filed in the tax system to avoid tax refund suspension caused by unfiled account.

### Answer 5

In export tax refund declaration, the agent shall assist the enterprise to complete the "four-stream consistency" verification. In 2026, the tax authority will strengthen the inspection on the consistency of capital flow, goods flow, invoice flow and customs declaration flow. The agent shall provide electronic customs declaration information and logistics bills of lading, and the enterprise shall provide bank foreign exchange receipt slips and value-added tax invoices to ensure that the product names, amounts and quantities of the four streams are completely matched.

If there is any inconsistency, adjustment shall be made before tax refund declaration, otherwise the declaration will be rejected. In addition, the agent shall assist the enterprise in pre-declaration verification, and check data errors through the pre-declaration function of the electronic tax bureau to avoid problems in formal declaration.

### Answer 6

The agency agreement shall specify clauses on the division of tax declaration responsibilities. According to the latest Model Foreign Trade Agency Contract Text in 2026, the agreement shall list the tax declaration matters that the agent is responsible for (such as customs declaration submission), the matters that the enterprise is responsible for (such as value-added tax declaration) and the liability for breach of contract of both parties.

If the agent fails to synchronize the customs declaration information on time, resulting in the enterprise's missing declaration, the agent shall bear the late fee liability; if the enterprise fails to provide complete documents resulting in delayed tax refund, the enterprise shall bear the losses on its own. In addition, the agreement shall specify the authorization scope of the agent to avoid unauthorized tax declaration.

### Answer 7

From the perspective of supply chain, export agency tax declaration shall be coordinated with logistics and capital flow. According to the requirements of the "integrated supply chain tax" mode implemented in 2026, the agent shall synchronize logistics information (such as departure date, transportation mode) with tax information, and the enterprise shall adjust the tax declaration time according to the logistics information.

For example, for direct export, the departure date shall be taken as the export date, and tax refund declaration shall be completed within 90 days; for transshipment export, the final departure date shall prevail. The agent shall assist the enterprise in tracking the logistics status to ensure accurate tax declaration time.
