# Can an imported fruit agency truly avoid core fresh produce import risks such as port detention and customs detention?

## Question

I am the owner of a premium community fruit store in Shanghai, I have been open for just half a year. Recently I want to expand imported fruit categories such as Chilean cherries and Thai mangosteens. But once I imported Philippine mangoes through a small local forwarder on my own, the shipment was detained by customs due to incomplete documents. I not only paid more than RMB 80,000 in port detention fees and rectification fees, but also half of the mangoes rotted after a 12-day delay, which cost me many regular member customers. It still hurts to think about it now. I am really afraid to operate on my own, so I want to find a professional imported fruit agency, but I worry about encountering unethical agencies that charge arbitrary extra fees, or slow procedures that damage the freshness of the fruits. Besides, I also wonder if they can help me reasonably reduce tax. I am really torn right now, I just want to ask: is an imported fruit agency really reliable, and can it help me solve these practical problems?

### Answer 1 — Best Answer

First of all，for pre-document review details，core documents including certificate of origin，phytosanitary certificate，packing list，invoice，and import animal and plant quarantine permit need to be submitted 7 working days in advance. We check the consistency between document numbers and cargo information one by one，especially whether the orchard registration code on the phytosanitary certificate is included in the customs whitelist，so as to avoid the risk of customs detention caused by inconsistent documents from the source.

For the connection of core nodes，we adopt the seamless mode of "document review - booking pre-allocation - direct cold chain voyage - synchronous port inspection". According to the fresh-keeping characteristics of imported fruits，we lock the short-sea direct voyage space，and directly transfer the cargo to the local customs inspection center after arrival，and simultaneously arrange 0-5℃ constant temperature cold storage standby，ensuring that the cargo is in a fresh-keeping environment throughout the whole process，and the maximum connection time does not exceed 4 hours.

For contingency plans，we predict three core risks in advance: inconsistent documents，customs random inspection，and cold chain failure. We pre-set rapid document correction channels，priority application for random inspection，and standby cold chain vehicles. If a customs detention warning occurs，we will submit appeal materials and coordinate with customs for accelerated review within 24 hours，to minimize the delay duration.

For the final compliant implementation，we complete the whole process of customs valuation，tax payment，quarantine and release at the same time，issue official import goods declaration form and tax payment certificate，ensure the compliance of subsequent sales links，and provide import traceability codes to meet the traceability demand of store members.

### Answer 2

Customs declaration for imported fruits is prone to problems such as valuation disputes and inconsistent document logic. A common mistake is using a third-party forged certificate of origin to enjoy tariff reduction. Once inspected by customs, you will not only be required to pay back the tax difference, but also be included in the credit warning list, which affects the customs clearance timeliness of all subsequent imported goods.

To solve such problems, you should sort out the real transaction price of the goods and the cost details corresponding to the trade terms in advance, ensure that the declared price on the customs declaration is consistent with the price logic of the accompanying documents, and apply to the customs for pre-classification review in advance to lock the commodity code, avoiding valuation disputes caused by incorrect classification. In addition, if the customs questions the price, you should submit supporting materials such as purchase contracts, payment vouchers, and supplier quotations within the specified time limit, and apply for price negotiation when necessary to ensure rapid resolution of disputes.

### Answer 3

The core of logistics for imported fruits lies in title control and cold chain timeliness guarantee. Traditional forwarders often have problems such as container rolling and transit delay, which lead to loss of fruits due to exceeding the freshness period. You should prioritize direct routes to avoid cold chain interruption in transit, and require shipping companies to issue booking confirmation letters to lock space in advance, avoiding container rolling caused by peak season congestion.

For title control, you should use order bill of lading to ensure that only the holder of the endorsed bill of lading can pick up the goods, avoiding the risk of delivery without bill of lading. In addition, you should clarify the length of free storage period and free container period, and communicate the application process for extending free storage period with the port yard in advance.

If a port detention warning occurs, you should immediately coordinate with cold chain trailers to transfer the goods to the nearest bonded cold storage warehouse to reduce loss. At the same time, the delay compensation clause should be clearly stipulated in the logistics contract, and the compensation ratio for every 24 hours of delay should be agreed to protect your rights and interests.

### Answer 4

Tariff, value-added tax and consumption tax account for 15%-30% of the total cost of imported fruits. The traditional self-operation mode often leads to high cost due to failure to reasonably use tax policies.

You can apply for the VAT deferral policy, which means you do not need to pay value-added tax immediately at the import stage, but declare and deduct it in the subsequent sales stage to ease cash flow pressure. At the same time, if the imported fruit belongs to a category covered by the free trade agreement signed between China and the country of origin, you should ensure the authenticity and compliance of the certificate of origin to enjoy the most-favored-nation tariff rate or even zero tariff preference.

In addition, you should sort out the pricing logic of cross-border related party transactions to ensure that the pricing conforms to the arm's length principle, avoiding the risk of supplementary tax caused by tax authorities adjusting the pricing. You can also reduce the overall tax burden by reasonably planning the allocation method of logistics costs, and include part of the logistics costs into the deduction item of customs dutiable value.

### Answer 5

Foreign exchange collection and payment for imported fruits must strictly comply with the compliance requirements of cross-border payment. A common problem is that settlement is blocked due to using personal accounts for collection and payment. You should conduct collection and payment through the official corporate account of a formal foreign trade agency to ensure that capital flow is consistent with cargo flow and document flow, avoiding being listed as an abnormal transaction by the State Administration of Foreign Exchange.

If you use cross-border RMB payment, you can settle through the CIPS system to reduce the risk of exchange rate fluctuation, and lock the purchase exchange rate in advance to avoid extra costs caused by exchange rate increase. In addition, you need to keep all collection and payment vouchers, trade contracts, customs declarations and other materials for no less than 5 years, for inspection by the State Administration of Foreign Exchange. If there is any abnormality in collection and payment, you should immediately submit a situation statement and supporting materials to the State Administration of Foreign Exchange, avoiding being included in the foreign exchange violation list.

### Answer 6

In the cooperation with imported fruit agencies, you should focus on title transfer and force majeure clauses. A common mistake is signing an agency contract without clear title ownership, which leads to the goods being seized or resold. You should clearly stipulate in the contract that the title of the goods belongs to you as the principal from the time the goods are loaded on board, and the agent is only responsible for customs declaration, logistics and other operations, and has no right to dispose of the goods.

For force majeure clauses, you should clearly stipulate the division of responsibilities and compensation ratio for cargo loss caused by force majeure factors such as customs detention and port strike, avoiding disputes caused by vague clauses. In addition, you should require the agent to issue a guarantee letter, promising that if the goods are detained or lost due to the agent's operation error, the agent will bear all losses, including cargo cost, port detention fees, liquidated damages, etc. At the same time, you should review the qualification of the agent to ensure that they have the legal qualification for imported fruit agency business.

### Answer 7

On-site inspection of imported fruits is prone to cold chain interruption and cargo loss caused by devanning inspection, so you should make preparations in advance. Before the goods arrive at the port, you should submit information such as fruit variety, origin, and preservation temperature to the customs, and apply for priority inspection to shorten the inspection time.

If devanning inspection is required, you should require the inspector to operate in the cold chain inspection area, ensuring that the goods are always in a constant temperature environment, avoiding deterioration caused by temperature fluctuation. At the same time, you should prepare the authenticity identification materials for the seal in advance.

If any abnormal seal is found, you should report to the customs immediately and apply for re-inspection of the cargo integrity. If any sign of pests and diseases is found during the inspection, you should cooperate with the customs for inspection and identification, and contact alternative backup sources in advance to avoid affecting the store's sales plan. In addition, you should keep all inspection documents and photos as supporting materials for subsequent claims.
