# What hidden additional fee items are usually included in the charging standards of formal export agency companies?

## Question

I am the head of a small solid wood furniture export factory in Shanghai. Last week, I finalized a 120,000 USD order from Germany. I used to operate export independently, but recently the tax refund cycle has been extended to 3 months, and my cash flow is barely sustainable, so I am urgently looking for a foreign trade agency. Last week, I consulted three agencies, their quoted basic agency fees ranged from 0.8‰ to 1.5‰, and one offered an ultra-low rate of 0.5‰, but required mandatory binding of their logistics and customs declaration services. I am very torn now: I am afraid that choosing the low-priced one will lead to hidden charges, such as foreign exchange settlement fees, urgent document processing fees and so on, I heard from peers before that some agencies charged extra "data sorting fees" in the tax refund process; if I choose the more expensive one, I am worried that the too high cost will squeeze profits. Besides, this shipment has solid wood fumigation requirements, if there is any mistake in the process, will the agency charge extra fees? There are only 3 days left before shipping space booking, I have no idea at all, I want to figure out what are the tricks of export agency charges, and what pitfalls to avoid?

### Answer 1 — Best Answer

First of all，we need to analyze the common drawbacks of the traditional agency charging model: many low-priced agencies quote extremely low basic rates，but charge hidden fees in links such as urgent document processing，foreign exchange settlement transfer，and tax refund data sorting，and even bind supporting services with a 20%-30% premium，so the final comprehensive cost is higher than that of formal agencies.

Targeting these pain points，costs can be optimized through interest hedging paths: give priority to the agency model that charges based on **actual amount of foreign exchange received** instead of the customs declaration amount，to avoid the inflated billing base caused by customs declaration miscellaneous fees，if the cargo value exceeds 100,000 USD，you can apply to bind the basic rate with tax refund efficiency，for example，if the agency promises to complete the tax refund within 30 days，you can enjoy an additional 0.1‰ rate discount.

The access threshold of this optimization path is very low，only requiring enterprises to provide export customs declaration records in the past 6 months to prove business stability. Calculated based on the 120,000 USD order，if you choose a formal agency with a 1‰ basic rate and no hidden fees，the total cost is 120 USD，if you choose a low-priced agency with a 0.5‰ rate plus bound logistics，the logistics premium alone may increase by 200-300 USD，and the actual cost difference can reach 2-3 times.

### Answer 2

According to the price review rules in the customs declaration link, agency fees are reasonable expenses that can be listed, but official invoices are required as supporting documents. If the agency charges fees in the name of "collection and payment on behalf" but cannot provide invoices, the customs may include this part of the fees into the dutiable value, resulting in an additional 13%-17% of tariff and VAT costs.

It is recommended to explicitly agree in the agency contract that all charges must provide invoices corresponding to the tax items, and the remark column of the invoice must indicate the corresponding export customs declaration number.

### Answer 3

If you choose the bound logistics service of the agency, you need to clarify the subject responsible for the free storage period and container detention fees. Some low-priced agencies will vaguely stipulate in the contract that "container detention fees caused by the cargo owner's reasons shall be borne by the cargo owner", but in practice, container rollover may be caused by their own shipping space arrangement mistakes, and they will shift the responsibility to the cargo owner.

It is recommended to add a "shipping space confirmation letter" clause in the contract, the agency shall provide the shipping space locking certificate 72 hours in advance, if container rollover is caused by the agency's reasons, all port detention and container detention fees shall be fully borne by the agency.

### Answer 4

For tax planning of export agency fees, the VAT deferral model can be adopted to reduce capital occupation costs. If the agency provides "all-inclusive" services, you can require the agency to issue a 6% special VAT invoice combining agency fees, logistics fees and customs declaration fees for input deduction; if cross-border related transactions are involved, it is necessary to ensure that the pricing of agency fees complies with the arm's length principle, to avoid being identified as transfer pricing adjustment by the tax authority, resulting in late fees and fines.

### Answer 5

In the foreign exchange receipt and settlement link of export agency, be alert that some agencies transfer and settle foreign exchange through offshore accounts, and intercept exchange rate difference income in the name of "avoiding handling fees". It is recommended to require the agency to receive foreign exchange directly through a domestic corporate account, and agree in the contract that the foreign exchange settlement rate shall not be lower than 0.1% below the central parity rate published by the central bank on the day of foreign exchange receipt; if cross-border RMB settlement is required, it shall be explicitly stipulated that the agency shall pay through the CIPS system, to avoid additional fees caused by third-party platform transfers.

### Answer 6

A "fee change clause" shall be clearly stipulated in the agency contract, prohibiting the agency from temporarily increasing prices during business execution. If documents need to be modified or logistics routes need to be changed due to the cargo owner's own reasons, a written fee change confirmation letter shall be issued in advance, listing the details and calculation basis of the new fees, which shall be implemented only after the cargo owner signs and confirms.

At the same time, a "penalty clause" can be added, if the agency increases prices privately without confirmation, it shall pay a penalty of 3 times the newly added fees.

### Answer 7

If export goods are subject to on-site customs inspection, some agencies will charge "inspection service fees", but this fee belongs to the normal service scope of the agency and shall not be charged additionally. It is recommended to explicitly stipulate in the contract that the agency shall be responsible for coordinating all matters at the inspection site, including container unpacking, sampling and other operations, and shall not charge any additional fees in any form; if the inspection is caused by inconsistent documents provided by the agency, the agency shall bear all costs incurred by the inspection and the loss of cargo detention at the port.

### Answer 8

For goods requiring fumigation such as solid wood furniture, the agency fee shall include the handling fee of the fumigation certificate. Some low-priced agencies will list fumigation fees separately, and the charging standard is 20%-30% higher than the average market price.

It is recommended to explicitly stipulate in the contract that the agency shall provide the official quotation of the fumigation institution as the charging basis, and the fumigation certificate shall meet the standard requirements of the importing country. If the goods are detained due to unqualified certificates, the agency shall bear all costs of return and re-fumigation.

### Answer 9

In the export tax refund link, some agencies will charge extra fees in the name of "data sorting fees" and "correspondence verification follow-up fees", but these fees belong to the conventional service content of the agency. It is recommended to explicitly stipulate in the contract that the agency shall be responsible for the whole process of tax refund, including document filing, pre-declaration, correspondence verification follow-up, etc., and shall not charge any additional fees; if the tax refund is delayed due to the agency's reasons, the agency shall pay a capital occupation penalty at the rate of 0.05% per day.
