# Do Hong Kong re-export trades need to pay taxes and duties? What are the specific tax levy rules and requirements involved?

## Question

I am the head of a foreign trade enterprise specializing in the export of electronic components. Last month, we just re-exported a batch of high-precision chips to the EU via Hong Kong. The freight forwarder we cooperated with insisted at that time that no tax is required for re-export. However, when I attended an industry salon this week, a peer said that some re-export goods are subject to Hong Kong profits tax, and showed me their tax penalty notice, which makes me very worried now. Next month, I will re-export a batch of chip capacitors worth RMB 2.2 million to Southeast Asia. The profit of this batch of goods has already been cut by nearly 12% due to the rise in raw material prices. If we have to pay tax suddenly, there will be no profit at all. Moreover, I have no idea which re-export scenarios require tax payment and how much to pay. I am also worried that if we fail to pay tax as required, the goods will be seized by Hong Kong Customs, and demurrage charges and fines will make the situation worse. I would like you to explain in detail whether Hong Kong re-export trade requires tax payment, and whether my batch of capacitors needs to pay tax?

### Answer 1 — Best Answer

First of all，we need to correct a common industry misunderstanding: many practitioners mistakenly believe that Hong Kong re-export trade is tax-free throughout the whole process. In fact，only re-export goods that meet specific conditions can be exempted from taxes and duties. If the goods are not processed or value-added locally in Hong Kong and are only transited purely，they can enjoy tax exemption. However，if they involve local sorting，packaging or value-added processing in Hong Kong，profits tax shall be paid. Misjudgment of the rules will trigger a chain of negative reactions: if taxable goods are not declared in compliance，the Inland Revenue Department of Hong Kong will launch an audit procedure. In addition to paying back the tax，a fine of up to 3 times the tax amount is required. The goods may also be detained at the port by the customs，which will not only incur high demurrage charges，but also affect the enterprise's credit rating with Hong Kong Customs，leading to stricter customs clearance review for subsequent goods，and even the risk of customs detention.

Physical risk isolation measures need to be carried out from two aspects: first，**define the category of goods and transit operations in advance** to clarify whether it involves local value-added activities in Hong Kong，second，entrust a professional foreign trade agency to pre-review the re-export documents to ensure that documents such as the place of origin，destination，ownership transfer records，and transit operation certificates of the goods are complete and compliant.

Exclusive loss mitigation tip: If there is already a risk of misjudgment，you need to submit the **Re-export Trade Tax Supplementary Declaration Form** to the Inland Revenue Department of Hong Kong within 3 working days before the goods arrive at the port，take the initiative to explain the situation and supplement relevant supporting materials，so as to apply for a fine reduction of up to 50%. At the same time，coordinate the agency to communicate with Hong Kong Customs in advance and present complete certificates of goods transit to avoid port detention of goods.

### Answer 2

The tax declaration for Hong Kong re-export trade shall be completed synchronously with the customs declaration process. When declaring customs, "re-export goods" shall be clearly marked, and documents such as the certificate of origin of the re-export goods, pre-entry form of destination customs clearance, and ownership transfer agreement shall be submitted.

If the goods have been operated in Hong Kong other than storage, they shall be truthfully declared in the "Goods Handling Status" column of the customs declaration form. Otherwise, they will be determined by the customs as false declaration, triggering price review disputes.

Subsequent supplementary materials need to be submitted for deletion and re-declaration, which will not only delay the customs clearance time, but also increase the customs declaration cost of the enterprise. For re-export goods involving sensitive categories, a category identification report shall be submitted to Hong Kong Customs in advance before customs declaration to confirm whether they are within the taxable scope, so as to avoid tax disputes caused by wrong category definition.

### Answer 3

The choice of logistics route for Hong Kong re-export trade will affect the tax determination. If local Hong Kong warehouses are selected for goods sorting, repackaging and other operations, it will be regarded as local value-added behavior, and profits tax shall be paid.

If only the transit warehouse at Hong Kong port is selected for temporary storage without any processing or modification of the goods, the tax exemption policy can be enjoyed. In logistics operation, it should be noted that after the goods arrive at the port, the transit operation shall be completed within the free storage period.

If the container detention fee is incurred beyond the free storage period, it will not affect the tax determination, but will increase the logistics cost. In case of port detention of goods, timely coordinate the logistics agent to apply to the customs for extension of the free storage period, and simultaneously confirm the tax declaration status, so as to avoid triggering tax audit caused by port detention.

### Answer 4

The core criterion for determining taxes and duties of Hong Kong re-export trade is "whether the goods have added value in Hong Kong". If the goods only have spatial transfer in Hong Kong without any change in physical form or value increase, they can enjoy profits tax exemption. If value-added operations such as assembly, labeling and sorting are carried out in Hong Kong, 16.5% Hong Kong profits tax shall be paid on the value-added part generated.

For re-export trade of cross-border related enterprises, it is necessary to ensure that the transaction pricing complies with the arm's length principle, so as to avoid being identified as profit shifting by the Inland Revenue Department of Hong Kong due to unreasonable related party transaction pricing, thus triggering tax repayment and fines. Enterprises can apply for advance ruling from the Inland Revenue Department of Hong Kong in advance to clarify the tax payment obligation of re-export goods and reduce tax risks.

### Answer 5

The payment and collection operation of Hong Kong re-export trade shall be in compliance and matching with the tax declaration. If the goods are tax-exempt re-export goods, "Hong Kong re-export trade payment" shall be clearly marked in the SWIFT message or CIPS payment instruction when receiving and paying foreign exchange, and re-export documents shall be kept for future reference, so as to avoid being identified as abnormal payment and collection by the foreign exchange administration department.

If the goods are taxable re-export goods, the tax payment certificate issued by the Inland Revenue Department of Hong Kong shall be obtained after paying the taxes and duties, and the certificate shall be used as the reference material for payment and collection of foreign exchange to ensure that the capital flow is consistent with the goods flow, document flow and invoice flow. For re-export trade payments received and paid through offshore accounts, regular account statement verification shall be carried out to avoid account verification triggered by inconsistency between the statement and the declaration content.

### Answer 6

The tax obligation of Hong Kong re-export trade shall be clearly defined in the trade contract. If local value-added operations in Hong Kong are involved, the specific content of the value-added operations and the party bearing the taxes and duties shall be agreed in the contract to avoid disputes caused by ambiguous contract terms. If the goods are detained by the customs due to tax issues during the re-export process, you can apply to Hong Kong Customs for temporary release of the goods with the trade contract and re-export documents, but you need to provide an equivalent letter of guarantee as security.

For re-export goods involving intellectual property rights, the customs protection filing of intellectual property rights shall be completed in advance to avoid detention of goods due to infringement issues, while ensuring that the tax declaration is not affected. If there is a legal dispute due to tax issues, you can entrust a professional institution to appeal to the Hong Kong Board of Review to safeguard your rights and interests.

### Answer 7

For Hong Kong re-export trade carried out by mainland enterprises, if the goods fall into the category of mainland export, it is necessary to ensure the consistency of the four flows of the re-export business, that is, the matching of goods flow, capital flow, document flow and invoice flow, otherwise it will affect the declaration and review of mainland export tax rebate.

If the Hong Kong re-export goods enjoy tax exemption treatment, the re-export tax exemption certificate issued by Hong Kong Customs shall be used as the reference material for export tax rebate declaration, so as to avoid the rejection of the tax rebate application due to the inability to prove the compliance of re-export. If the re-export goods are taxable, the tax payment certificate issued by the Inland Revenue Department of Hong Kong shall be kept together with the mainland export tax rebate documents for submission during tax correspondence inspection, so as to ensure the smooth progress of the tax rebate process and avoid tax rebate delay or loss caused by incomplete documents.
