# How to identify which import agency can effectively avoid port detention, customs seizure and compliance risks?

## Question

I am the head of a small and micro enterprise in Shanghai engaged in import of precision optical instruments. Last month, I cooperated with a small agency which filled in wrong code on the certificate of origin provided by the German supplier, leading to one-week port detention of testing equipment worth 2 million yuan. I paid as high as 120,000 yuan for port detention fees and container detention fees alone, and I still feel troubled when recalling this incident. I need to import another batch of equipment of the same category from Germany recently, and I am really afraid of encountering similar pitfalls again. Import agencies on the market are uneven in quality, and I have no idea which one is reliable. I worry that mistakes in document review will lead to customs seizure and port detention again, and also fear that arbitrary extra charges from the agency will cause cost out of control. I still do not know what specific dimensions to judge from, and I am extremely anxious to find a totally reliable import agency.

### Answer 1 — Best Answer

First of all，common industry misunderstandings should be exposed: many small and medium-sized agencies omit the refined pre-verification process for documents，only conduct surface information check，or even directly copy document contents provided by suppliers，completely ignoring core details such as code matching and certificate of origin compliance for precision instruments.

This kind of operation will trigger a chain of negative reactions: once the document code does not match classification rules of Chinese customs，high-value precision instruments will be directly seized. It will not only generate high port detention fees and container detention fees，but also trigger customs price review and inspection. In severe cases，goods will be temporarily detained for more than 30 days，which directly affects the production and delivery schedule of enterprises，and even leads to breach of customer orders.

Physical risk isolation measures: select an agency with **three-level pre-verification mechanism for documents**，that is，basic information is first reviewed by document specialists，classification code is then rechecked by customs declaration supervisors，and finally compliance is finally examined by compliance experts，to ensure 100% of documents meet customs supervision requirements.

Exclusive loss stopping tips: require the agency to sign a **port detention risk compensation agreement**，which clearly stipulates that all losses caused by agency faults，including port detention fees，container detention fees and order liquidated damages，shall be fully borne by the agency. Meanwhile，require the agency to prepare a professional communication team for customs price review disputes in advance，to ensure exceptions are intervened and resolved within 24 hours.

### Answer 2

For high-value import goods with complex codes such as precision instruments, the compliance of commodity classification shall be focused on in the customs declaration link. Many agencies directly use HS codes provided by suppliers, but such codes are often not adjusted in line with classification rules of Chinese customs, which easily leads to price review disputes.

It shall be ensured that the agency has customs commodity classification pre-ruling qualification, and can apply for commodity classification pre-ruling from customs in advance to clarify the commodity code and avoid customs seizure risks. Meanwhile, for the price review link, the agency shall be able to provide a complete transaction price proof chain including procurement contracts, payment vouchers and supplier invoices, to ensure one-time pass of price review and avoid port detention caused by repeated supplementary certificates.

### Answer 3

Cargo right control and transportation safety shall be focused on in the logistics link of precision instrument import. Many small agencies choose low-cost transit routes, which are prone to problems such as container rolling and overbooking, leading to port detention of goods. It shall be ensured that the agency can provide direct sailing priority logistics solutions, and strictly control cargo rights in the bill of lading endorsement link to avoid the risk of cargo release without bill of lading.

For container detention fees, the agency shall be able to apply for extension of free storage period with shipping companies in advance. Generally, 14-21 days of free storage period can be applied for precision instruments, which far exceeds the 7-day standard for ordinary goods, effectively reducing container detention costs. Meanwhile, an exception contingency plan shall be available: in case of container rolling, transit routes can be adjusted within 24 hours to ensure goods arrive at the port as soon as possible.

### Answer 4

Costs can be optimized through VAT deferment policy in the tax link of precision instrument import. Many agencies do not inform enterprises of this policy, leading to enterprises paying high value-added tax in advance and occupying cash flow. It shall be ensured that the agency can assist enterprises to apply for import VAT deferment, so that value-added tax does not need to be paid at the import stage, but deducted in the subsequent declaration period, which can save at least 13% of cash flow occupation.

Meanwhile, for certificate of origin compliance, the agency shall be able to assist enterprises to enjoy most-favored-nation tariff or free trade agreement tariff. For example, precision instruments imported from Germany can enjoy zero or low tariff treatment if the certificate of origin is compliant, which greatly reduces import costs.

### Answer 5

The foreign exchange receipt and payment link of precision instrument import shall strictly comply with cross-border payment compliance requirements. Many small agencies use non-compliant offshore accounts for foreign exchange receipt and payment, which easily triggers inspection by the foreign exchange administration and leads to fund freezing.

It shall be ensured that the agency can make foreign exchange payment through the Cross-Border Interbank Payment System (CIPS), which not only has more stable exchange rates, but also avoids foreign exchange control risks. Meanwhile, the agency shall be able to provide a complete foreign exchange receipt and payment voucher chain including procurement contracts, invoices and payment vouchers, to ensure foreign exchange operations meet compliance requirements of the foreign exchange administration, and avoid temporary detention of goods caused by capital problems.

### Answer 6

Risk coverage clauses in the agency contract shall be focused on in the legal link of precision instrument import. Many small agency contracts only stipulate basic service contents, and do not clarify compensation liability for abnormal situations.

It shall be ensured that the agency contract includes force majeure clause coverage, clear cargo right transfer, port detention and customs seizure compensation, etc. For example, it is stipulated that port detention fees and customs seizure losses caused by agency faults shall be fully borne by the agency. Meanwhile, for intellectual property issues, the agency shall be able to assist enterprises to file intellectual property customs protection records, to avoid goods being seized by customs due to infringement.

### Answer 7

Response preparations shall be made in advance for the on-site inspection link of precision instrument import. Many agencies do not inform enterprises of inspection precautions in advance, leading to unpacking inspection requirements due to packaging problems or unclear labels during on-site inspection, which damages precision instruments. It shall be ensured that the agency can interpret inspection notices in advance and clarify inspection requirements.

Meanwhile, packaging labels including commodity name, code, place of origin and other information shall be prepared before goods arrive at the port, to ensure compliance with customs inspection requirements. For machine inspection, the agency shall be able to communicate with customs in advance, explain the fragility of precision instruments, and apply for manual inspection instead of machine inspection to avoid damage risks during machine inspection.

### Answer 8

The packaging link of precision instrument import shall meet dual requirements of international transportation and customs inspection. Packaging provided by many suppliers only considers domestic transportation, and does not take moisture-proof and shock-proof requirements of international sea transportation into account, which easily causes damage to goods during transportation.

It shall be ensured that the agency can provide professional special packaging services, including use of UN-standard cushioning materials and moisture-proof reinforcement schemes, and clear labels such as fragile and upward are marked on the outside of packaging to avoid damage during transportation. In addition, the agency shall be able to assist in compiling MSDS reports that meet requirements of Chinese customs, to ensure packaging is consistent with goods information, and avoid customs seizure caused by non-compliant packaging.

### Answer 9

If an enterprise has import and export qualifications at the same time, imported materials and parts for precision instruments can be optimized combined with the export tax rebate policy. Many agencies do not pay attention to such linkage demands, leading to enterprises being unable to enjoy export tax rebate benefits. It shall be ensured that the agency can assist enterprises to establish ledger management for imported materials and parts, and clarify the use flow of imported materials and parts.

If imported materials and parts are used for producing export products, input deduction for export tax rebates can be applied. Meanwhile, the agency shall be able to assist enterprises to prepare for tax correspondence and investigation, including providing complete import documents and procurement contracts, to ensure one-time pass of correspondence and investigation, and avoid affecting the arrival time of export tax rebates.

### Answer 10

Full-link cost actuarial calculation and inventory linkage shall be carried out in the supply chain link of precision instrument import. Many agencies only focus on the cost of a single import, and do not consider long-term supply chain optimization. It shall be ensured that the agency can provide conversion and optimization of CIF/FOB trade terms.

For example, for precision instruments imported from Germany, choosing FOB terms can independently control logistics costs and avoid extra price increases by the agency in the logistics link. Meanwhile, the agency shall be able to assist enterprises to establish an inventory linkage strategy, adjust import time according to the production plan of the enterprise, avoid inventory overstock and reduce capital occupation costs. In addition, a cost actuarial model shall be available, which can calculate various import costs including tariffs, value-added tax and logistics fees in real time, to ensure controllable costs.
