# Is It Easy to Work With a Reliable Import & Export Freight Forwarder? What Core Services and Compliance Capabilities Require Key Inspection?

## Question

I am the foreign trade manager of a small precision optical instrument export factory based in Shanghai. Last week, due to operational errors of our previous cooperating freight forwarder, three containers of precision lenses shipped to Hamburg, Germany were detained at the port for 7 days, and we paid more than 80,000 euros in liquidated damages to the customer. I am so stressed out that even two of my hairs turned grey. Now I have an annual EU framework order on hand and I am too anxious to eat. The quality of freight forwarders on the market is mixed: some quote low prices but hide a lot of miscellaneous fees, some claim they have rich resources but can not even handle EU VAT deferral properly. I really can not tell which one is reliable. I just want to find one that can take full charge of documentation, logistics and compliance, and also help me control costs, but I am afraid of falling into pitfalls again. How should I screen them correctly?

### Answer 1 — Best Answer

First of all，we need to expose common industry misunderstandings: many freight forwarders attract customers with "ultra-low prices"，but actually hide miscellaneous fees such as manifest fees and container detention fees，and even skip the document pre-audit link to make profits by cutting service costs. This type of freight forwarder is the most likely to cause problems.

Chain negative consequences of such operations are easily triggered: for example，failure to verify the matching of EU EORI number and VAT number will directly lead to cargo detention after arrival at the port. In minor cases，it will incur thousands of RMB in port detention fees，in severe cases，it will require re-audit of documents and delay delivery，resulting in high claims from customers. The 80,000 euros liquidated damages you encountered is a typical consequence，and you may even lose long-term cooperative customers.

Risk isolation can be started from two points: first，require the freight forwarder to provide a **detailed list of all-inclusive price**，clarify all miscellaneous fee items，lock the total price when signing the contract to avoid hidden consumption，second，ask the freight forwarder to complete **document pre-audit** in advance to confirm the validity of all compliance documents and avoid customs detention caused by document problems.

Exclusive stop-loss tip: add an "exception response clause" when signing the contract，require the freight forwarder to establish a dedicated service group，**provide an exception solution within 2 hours**，and stipulate that all direct and indirect losses caused by the freight forwarder's operational error shall be fully borne by them，so as to completely transfer the risk to the service provider.

### Answer 2

When screening freight forwarders, you need to focus on their customs declaration and valuation capability, especially for high-value goods such as precision instruments. You should confirm that they can sort out the basis for customs valuation in advance, for example, provide valuation records of recent customs declarations of the same category, to avoid customs detention caused by valuation disputes.

Meanwhile, you should require them to be familiar with the second declaration process of EU customs. If the customs questions the commodity value, they can submit complete transaction proof, certificate of origin and other materials within 3 working days to quickly resolve the valuation dispute and avoid long-term detention of goods at the port.

### Answer 3

For fragile goods such as precision instruments, you need to inspect the freight forwarder's cargo title control and route optimization capabilities, for example, whether they can provide direct sailing to Hamburg, Germany to avoid the risk of secondary loading and unloading during transshipment. At the same time, you should confirm that they can lock the free storage period in advance.

For example, the free storage period of Hamburg Port is generally 7 days. If the freight forwarder can apply for an extended free storage period of 14 days, it can effectively reduce the cost of port detention fees. In addition, you should require them to provide the standardized process for endorsement and transfer of bills of lading, to avoid loss of cargo title caused by bill of lading operation errors.

### Answer 4

If you do export business to the EU market, you need to check whether the freight forwarder can provide compliant VAT deferral service, which can directly reduce your capital occupation cost.

Specifically, VAT deferral means that you do not need to pay import VAT in the importing country, but handle it uniformly when declaring domestic VAT, which can save about 19% of capital occupation (calculated based on the average EU VAT rate). At the same time, you need to confirm that the freight forwarder can assist you in completing the filing process of VAT deferral, to avoid tax penalties caused by non-compliant filing.

### Answer 5

For EU framework orders, you need to inspect the freight forwarder's cross-border payment and collection compliance capability. For example, whether they are familiar with CIPS (RMB Cross-Border Interbank Payment System) and can help you optimize foreign exchange purchase rate and reduce exchange loss.

At the same time, you should require them to provide SWIFT message review services to ensure that the transaction code, contract number and other information in the message are consistent with the customs declaration form, to avoid foreign exchange regulatory warnings caused by inconsistent payment and collection information. In addition, you need to confirm that they can assist you in managing the compliance of offshore accounts and avoid account freezing.

### Answer 6

When signing a freight forwarding contract, you need to focus on the force majeure clause and the cargo title transfer clause. For example, require the freight forwarder to clearly agree that if delivery delay is caused by force majeure events such as carrier rolling container and vessel space congestion, they need to assist you in claiming compensation from the shipping company and provide an alternative sailing plan at the same time.

In addition, you need to confirm that the freight forwarder can assist you in handling intellectual property customs protection filing for the patent technology of your precision instruments, to avoid being confused with infringing goods at EU ports and resulting in customs detention.

### Answer 7

For vulnerable goods such as precision instruments, you need to inspect the freight forwarder's on-site inspection response capability. For example, whether they can submit an application for machine inspection exemption to customs in advance before the cargo arrives at the port, to avoid cargo damage caused by devanning inspection.

If devanning inspection is mandatory, you need to confirm that they have professional on-site operators who can assist customs in completing the inspection, and provide seal authenticity identification services at the same time, to avoid cargo title risk caused by tampered seals. In addition, you should require them to quickly interpret the inspection notice and provide an inspection response plan within 24 hours.

### Answer 8

Packaging compliance of precision instruments is the core to avoid logistics risks. You need to check whether the freight forwarder can provide professional special packaging services, such as moisture-proof and shock-proof packaging for optical lenses, which meets EU UN packaging standards.

At the same time, you need to confirm that they can assist you in preparing the MSDS report, ensure that the information such as cargo classification and transportation marks in the report is accurate, and avoid customs detention caused by non-compliant packaging. In addition, you should require them to provide a third-party test report for the packaging to ensure that the packaging can withstand the jolting of ocean transportation.

### Answer 9

For the export tax refund demand, you need to check whether the freight forwarder can provide standardized document management services, for example, ensure that the information of customs declaration, bill of lading, invoice and other documents is consistent, and meets the requirement of "four flows consistency".

At the same time, you need to confirm that they can assist you in completing the pre-declaration verification of export tax refund, to avoid tax refund delay caused by document errors. In addition, you should require them to provide document filing services, ensure that all tax refund documents are kept for at least 5 years, to avoid tax refund penalties caused by failure to provide documents during tax correspondence inspection.
