# Does International Entrepot Trade Require Inspection? Are Requirements Different for Different Cargo Categories?

## Question

I am the head of a foreign trade company based in Shanghai, mainly engaged in entrepot trade with Southeast Asia. Last week, I just finalized an order of photovoltaic modules shipped from China to the EU. Due to the EU's anti-dumping duties, we have to arrange transit via Malaysia. A peer of mine previously had their goods detained at the transit port because of improper inspection handling in transit, and they spent more than 100,000 just on port storage charges, almost losing their core client. I am very anxious now. I wonder whether entrepot trade requires inspection in the first place? Do we only need to complete inspection for domestic export, or do we have to go through the full inspection process at the transit port as well? Besides, photovoltaic modules are sensitive electromechanical products, will there be special inspection requirements? If I accidentally miss the inspection, will it lead to customs detention, high penalties, and even affect my company's subsequent foreign exchange settlement and compliance qualifications?

### Answer 1 — Best Answer

A common misconception in the industry is that entrepot trade only requires attention to customs clearance at the destination country，and no inspection is needed in the origin country or at the transit port. Many enterprises skip the inspection process to save trouble and arrange goods transit directly.

The cascading negative consequences of this practice will emerge quickly: if the goods fall into the category of legally required inspection，failure to declare for inspection will lead to goods detention at the domestic export stage，or interception by customs at the transit port，resulting in vessel delay，customs detention，high port storage charges and warehouse rent. In severe cases，the enterprise will also be fined 5%-10% of the cargo value by the regulatory authority of the transit port，and it will even affect the enterprise's credit rating at the transit port，and all subsequent transit goods will be subject to intensified inspection.

Risk prevention measures shall be clarified in advance: **First verify whether the goods are included in the legal inspection catalogue stipulated by the entry-exit inspection and quarantine authority of China**，and confirm the local regulatory requirements of the transit port at the same time. If the transit port requires inspection，the procedure must be completed as required.

Exclusive loss mitigation tip: Cooperate with a professional foreign trade agency，and submit documents such as cargo list and transit agreement for pre-audit 3-5 days in advance. Once the risk of missing inspection is found，complete the supplementary inspection procedures immediately，or adjust the transit port to a compliant port with more lenient regulatory requirements to avoid further losses.

### Answer 2

For the connection between customs declaration and inspection in entrepot trade, the regulatory attribute of transit goods shall be clarified first: if the goods are commodities within the legal inspection catalogue, inspection must be completed and the Exit Goods Customs Clearance Form obtained at the domestic export stage, otherwise export customs declaration cannot be completed. The inspection requirements of the transit port shall be subject to the regulations of the local customs.

Some transit ports such as Singapore and Malaysia require mandatory inspection for electromechanical and chemical goods, and official regulatory documents shall be obtained from the transit port agent in advance. If customs declaration is suspended due to incomplete inspection documents, the inspection documents shall be supplemented within 3 working days to avoid additional costs caused by deleting and re-declaring the form. At the same time, ensure that the "trade method" on the customs declaration is marked as "entrepot trade" to maintain logical consistency with the inspection form.

### Answer 3

The connection between inspection and logistics route in entrepot trade is very important: if the goods need to be inspected at the transit port, 2-3 days shall be reserved in advance for inspection operation, to avoid container rolling and space shortage caused by inspection delay. When selecting a transit port, priority shall be given to ports that have an inspection and quarantine mutual recognition agreement with China, such as Hong Kong and Singapore, which can simplify the inspection process and shorten the transit time.

If the goods are detained at the transit port due to failure to declare for inspection, the local logistics agent shall be contacted immediately to coordinate with the regulatory authority, submit documents such as entrepot trade certificate and destination country order to apply for release, and apply for extending the free storage period to reduce the cost of container detention charges. In addition, when endorsing the bill of lading, ensure that the cargo description is consistent with that on the inspection form to avoid disputes during the transfer of cargo title.

### Answer 4

Inspection operation and tax planning for entrepot trade shall be carried out in coordination: if the goods complete legal inspection, the enterprise can enjoy the VAT exemption policy for entrepot trade in subsequent tax treatment, but it shall ensure that the inspection form, customs declaration, bill of lading and payment voucher have consistent information, to avoid being recognized as domestic sales and required to make up tax by the tax authority due to inconsistent documents. For entrepot trade involving VAT deferral, inspection records are one of the core vouchers for tax authority verification.

Failure to declare inspection will lead to the rejection of the VAT deferral application, and the full amount of VAT shall be paid in advance, increasing the capital pressure of the enterprise. At the same time, if the transit port requires inspection, the corresponding inspection fee can be included in the trade cost and deducted before corporate income tax, and the inspection voucher shall be retained as the basis for tax deduction.

### Answer 5

The payment and collection compliance of entrepot trade is directly related to inspection operation: if the goods are not inspected as required, the enterprise cannot obtain compliant export documents, which will lead to bank verification during settlement, failure to complete cross-border payment via SWIFT or CIPS, and even attract the attention of foreign exchange regulatory authorities and be included in the compliance verification list. For enterprises that use offshore accounts to collect and pay entrepot trade funds, inspection records are important materials to prove the authenticity of trade.

Failure to declare inspection will lead to the freezing of the offshore account and affect subsequent capital turnover. In addition, during settlement, the inspection form shall be submitted to the bank for audit together with customs declaration, bill of lading and other documents to ensure that the payment and collection process complies with foreign exchange regulatory requirements.

### Answer 6

Failure to inspect goods as required in entrepot trade may lead to legal risks: if the goods are detained or delayed due to failure to inspect, it will violate the delivery clauses in the trade contract signed with the buyer, and the enterprise shall bear the liability for breach of contract, pay penalty or compensate the buyer for losses. For transit goods involving intellectual property rights, such as branded products, failure to declare inspection may lead to the risk of intellectual property infringement, be investigated and dealt with by the customs of the destination country, and require high infringement compensation.

In addition, if the transit port imposes a fine on the enterprise due to failure to declare inspection, the fine cannot be transferred to a third party through contract clauses and shall be borne by the enterprise itself. It is recommended to clearly define the division of inspection responsibilities in the entrepot trade contract to avoid subsequent disputes.

### Answer 7

On-site inspection of entrepot trade goods at the transit port is directly related to inspection declaration: if the goods have completed inspection declaration, the transit port customs will first check the consistency between the inspection form and the goods, such as cargo category, quantity, packaging, etc., and release the goods quickly if they are consistent; if not inspected, the goods will be included in the key inspection list, requiring devanning inspection, machine inspection, and even laboratory testing, which prolongs the inspection time.

For sensitive categories such as chemicals and food, uninspected goods will be directly detained, and supplementary inspection and submission of MSDS, component test reports and other materials are required. In addition, the authenticity verification of the container seal is an important part of on-site inspection. The seal number shall be marked on the inspection form and kept consistent with the bill of lading to avoid being recognized that the container has been opened.

### Answer 8

The packaging requirements for special category goods in entrepot trade shall match the inspection requirements: for special categories such as dangerous goods and fragile goods, qualified packaging inspection reports shall be submitted during inspection declaration, such as UN dangerous goods packaging certificate, cushioning packaging material test report, etc. If the packaging does not meet the inspection requirements, the enterprise cannot obtain the inspection qualification certificate, resulting in the failure of goods transit.

For example, in the entrepot trade of lithium batteries, packaging meeting UN38.3 standards shall be used, and the packaging test report shall be submitted during inspection, otherwise the transit port customs will detain the goods. In addition, the moisture-proof and reinforcement plan shall be determined before inspection, and the packaging method shall be marked on the inspection form to ensure consistency with the actual packaging, so as to avoid penalties due to inconsistent packaging during on-site inspection.

### Answer 9

Inspection operation of entrepot trade is not directly related to export tax refund, but document compliance shall be ensured: entrepot trade does not fall into the scope of export tax refund, but inspection records are important materials to prove the authenticity of trade. If an enterprise disguises entrepot trade as general trade to apply for export tax refund, the inconsistency of trade mode between the inspection form and customs declaration will be investigated and dealt with by the tax authority, and the enterprise shall repay the tax refund and pay a fine.

In addition, the inspection form shall be retained and filed together with other documents such as bill of lading and payment voucher as reference materials for tax audit, so as to avoid being listed as a key inspection object by the tax authority due to incomplete documents. If the transit port requires inspection, the corresponding inspection fee shall be included in the trade cost and shall not be used as a deduction certificate for export tax refund.

### Answer 10

Inspection requirements for entrepot trade shall be included in supply chain planning: when designing the entrepot trade route, the inspection time and cost shall be included in the supply chain cost actuarial model, and priority shall be given to transit ports with simplified inspection procedures to reduce trade costs. For example, as a transit port, Hong Kong has relatively lenient entrepot inspection requirements for most goods, which can reduce inspection time and costs.

At the same time, the inventory linkage strategy shall take inspection time into consideration. If the goods require inspection, production and packaging shall be arranged in advance, and operation time for inspection shall be reserved to avoid inventory backlog caused by inspection delay. In addition, when converting CIF/FOB trade terms, it shall be clearly defined whether the inspection responsibility is borne by the buyer or the seller, and included in the contract clauses to avoid supply chain interruption.
