# What compliance procedures and supporting documents are required for the export of general mechanical and electrical industrial products?

## Question

I am the head of a factory producing small mechanical and electrical equipment in Shanghai. Last month, my first batch of goods exported to Germany was detained at Hamburg Port due to incomplete documents, costing me nearly RMB 40,000 in port detention fees and document amendment fees alone. Now the second batch of 12 units of equipment will be loaded next month, and I am so anxious that I cannot even sleep well. Previously, the freight forwarder only asked me for packing list, commercial invoice and customs declaration form, and did not mention the FORM A certificate of origin and commodity inspection for mechanical and electrical products export at all. As a result, the goods were detained by the customs for 10 full days after arriving at the port. Now I am completely confused about what procedures need to be handled for the whole process of product export? From pre-approval, commodity inspection, to documents for customs declaration and customs clearance, are there any details that are easy to miss? I am just afraid of making mistakes again, which will not only lead to losses but also ruin the reputation of the new client.

### Answer 1 — Best Answer

First，the pre-document review details: for the export of small mechanical and electrical equipment，the preparation and review of two types of core documents need to be completed 7-10 days in advance. The first is **statutory commodity inspection documents**. You need to log in to the Single Window to submit the product manual and the confirmation form of supervision conditions corresponding to the HS code，to ensure that the electronic commodity inspection voucher is synchronized to the customs declaration system. The second is **preferential certificate of origin FORM A**，which needs to be applied to the CCPIT or the customs 3 days before the shipment of the goods，to confirm that the information on the certificate is completely consistent with the goods description，HS code on the customs declaration form，packing list and invoice.

Core node connection: For the customs declaration process，you need to entrust an agent with the qualification of customs declaration for mechanical and electrical products，complete the pre-entry 24 hours before container loading，and simultaneously push the electronic data of commodity inspection voucher and certificate of origin to the customs system. Within 10 days after shipment，the paper certificate of origin needs to be sent to the overseas customer for customs clearance at the destination country，and the pre-declaration of export tax refund shall be completed through the Single Window at the same time.

Abnormal response plan: If there is an early warning of inconsistent document information，you need to contact the customs broker to submit a document amendment application within 12 hours，and apply to the CCPIT for reissuance of the certificate of origin at the same time. If the customs of the destination country detains the goods due to document problems，you need to immediately provide the product compliance certificate issued by the domestic commodity inspection authority，and entrust the local customs broker to apply for the fast verification channel.

Final compliance implementation: Within 30 days after the shipment of the goods，all documents (customs declaration stub，copy of certificate of origin，commodity inspection voucher) shall be archived for subsequent tax refund verification and customs retrospective audit，to ensure a closed loop of full-link compliance.

### Answer 2

For the customs declaration of small mechanical and electrical equipment export, the accuracy of the HS code needs to be confirmed with priority. If the supervision conditions corresponding to the code include "A" (Entry Goods Clearance Form) or "B" (Exit Goods Clearance Form), the commodity inspection procedures must be completed in advance.

The electronic data submitted during customs declaration must fully match the paper documents, especially the brand, model and specification in the goods description. If there is a brand export, the customs brand filing needs to be completed in advance.

If there is a valuation dispute, supporting materials such as procurement contracts, raw material invoices, and export customs declaration records of similar products need to be provided within 3 working days to avoid port detention caused by delayed valuation. In addition, under the integrated customs clearance mode, it is necessary to confirm that the place of departure and place of exit on the customs declaration form are consistent with the actual transportation route, otherwise it will trigger a customs risk warning.

### Answer 3

In the booking stage, a complete list of documents needs to be provided to the freight forwarder in advance, including the commodity inspection voucher and pre-entry information of the certificate of origin, to avoid the freight forwarder omitting key compliance items due to incomplete information. When loading the container, photos of the goods placement inside the container and photos of the seal number need to be taken and uploaded to the logistics tracking system simultaneously to ensure the controllability of cargo rights. If there is a risk of port detention at the destination port, you need to apply to the shipping company for an extension of the free storage period in advance.

For small mechanical and electrical equipment, an additional 2-3 days of free storage period can generally be applied for, and the application needs to be submitted 72 hours before the goods arrive at the port. In addition, the bill of lading endorsement must be operated in strict accordance with the requirements of the letter of credit. If it is a telex release bill of lading, it is necessary to ensure that the overseas customer has paid the full payment to avoid the loss of cargo rights.

### Answer 4

For small mechanical and electrical equipment exported to the EU, the EU VAT deferment policy can be applied for, there is no need to pay import VAT in the importing country, and it can be deducted directly during the declaration period. You need to submit the VAT deferment application form when declaring customs, and ensure that the export tax refund filing has been completed in the domestic tax system.

The export tax refund declaration needs to be completed within 90 days after the goods are declared for export. If the declaration cannot be made on time due to document delay, you need to apply to the tax authority for an extension in advance, which can be extended for up to 3 months. In addition, if there is a cross-border related transaction, it is necessary to ensure that the transaction pricing conforms to the arm's length principle, so as to avoid affecting the tax refund qualification due to tax adjustment.

### Answer 5

Export foreign exchange receipt needs to be registered in the Goods Trade Foreign Exchange Monitoring System. Enterprises exporting for the first time need to complete the directory registration procedures in advance to avoid being unable to receive foreign exchange. When receiving foreign exchange, it is necessary to ensure that the difference between the amount on the customs declaration form and the received foreign exchange amount is within a reasonable range, generally no more than 5%.

If the difference is too large, a difference explanation needs to be submitted to the State Administration of Foreign Exchange. If RMB cross-border payment (CIPS) is adopted, the customs declaration number, goods name and other information need to be indicated in the payment instruction to ensure that the foreign exchange receipt and payment information matches the information on the customs declaration form. In addition, for foreign exchange receipt through offshore accounts, supporting materials such as export contracts and customs declaration forms need to be submitted to the bank in advance to avoid fund freezing caused by compliance review.

### Answer 6

The export contract should clearly stipulate the time node and responsibility division for document provision. If the documents are missing due to the freight forwarder's failure to remind in time, a breach of contract compensation clause should be set in the contract. For the brand export of small mechanical and electrical equipment, the customs intellectual property filing needs to be completed in advance to avoid the goods being detained by the customs of the destination country due to suspected infringement.

If letter of credit settlement is adopted, the soft clauses in the letter of credit need to be reviewed, such as clauses like "payment can be made only after the buyer confirms the sample", to avoid being unable to receive foreign exchange in time. In addition, the force majeure clause should clearly specify whether the delay caused by customs detention and port detention falls within the scope of exemption, so as to avoid legal risks in advance.

### Answer 7

If the customs conducts on-site inspection of exported mechanical and electrical equipment, materials such as product manuals, qualification certificates and commodity inspection vouchers need to be prepared in advance to cooperate with the inspection personnel to complete the goods verification. During the inspection, it is necessary to ensure that the brand and model of the goods are consistent with the customs declaration form. If accessories are packaged separately, they need to be clearly marked in advance to avoid goods detention due to inconsistent goods description.

If there is an abnormal image in the machine inspection, a detailed description of the goods needs to be submitted within 24 hours to apply for manual inspection, so as to avoid the delay of shipment caused by the machine inspection result. In addition, if the seal is damaged during transportation, you need to take photos immediately, apply to the shipping company for seal replacement, and indicate the seal replacement in the customs declaration form.

### Answer 8

The export of small mechanical and electrical equipment needs to meet the packaging compliance requirements of the destination country. Goods exported to the EU need to use wooden packaging that meets the ISPM15 standard. If fumigation-free packaging is used, a fumigation-free certificate needs to be provided.

If the equipment contains accessories such as batteries, they need to be packaged separately, and an MSDS report needs to be submitted to ensure that the batteries meet the UN38.3 standard. Moisture-proof and shock-proof treatment should be done during packaging, especially for precision mechanical and electrical components.

Packaging materials and protective measures should be indicated in the packing list to avoid cargo damage or customs detention at the destination country due to non-conforming packaging. In addition, the shipping mark on the package must be completely consistent with the shipping mark on the customs declaration form and packing list, including information such as destination port, number of pieces, and gross weight.

### Answer 9

Export tax refund needs to ensure the consistency of four flows, that is, the contract flow, capital flow, goods flow and invoice flow are fully matched. Documents such as procurement contracts, sales contracts, customs declaration forms, foreign exchange receipt vouchers, and special VAT invoices need to be retained in advance. Document filing needs to be completed within 15 days after export, and copies of all documents should be bound into a book for future reference. If the tax authority conducts a letter verification, relevant supporting materials need to be submitted within 10 days.

If the tax refund review fails, you need to check the document information in time, especially key information such as HS code, goods description and amount. If the tax refund is delayed due to incorrect information, you need to submit a document amendment application immediately and explain the situation to the tax authority at the same time. In addition, the tax refund declaration needs to use the Single Window system to ensure that the electronic data is consistent with the paper documents.
