# What is the import tariff rate of Poland? What are the differences in specific collection standards for different categories of goods?

## Question

I am an importer based in Shanghai, mainly engaged in Nordic solid wood furniture. I have just finalized the order of oak dining sets and solid wood storage racks from a Polish supplier, and booked the shipping space for next Monday last week. However, I have only done business on Southeast Asia routes before and am completely unfamiliar with EU tariff rules, so I am very anxious now. I don't know the exact Poland import tariff rate, I am afraid that wrong cost calculation will lead to negative profit for the whole batch of goods, and I am even more afraid that incorrect tariff declaration will trigger customs detention and port congestion. By then, I will not only have to pay high late fees, but also miss the schedule of the domestic furniture exhibition next month, and the 300,000+ RMB retail order that has been negotiated will fall through. Can you give me a detailed answer from the perspective of cost and risk?

### Answer 1 — Best Answer

Traditional importers easily fall into the misunderstanding of "only checking the basic tariff rate"，ignoring the 23% value-added tax and consumption tax on specific commodities that Poland needs to levy as an EU member state. This leads to cost calculation deviation of more than 20%，even triggers a fine of 20%-50% due to incorrect HS code classification，which directly erodes profits，and may also cause customs detention and port congestion，resulting in an average daily port storage fee and late payment penalty of 300 euros.

For cost optimization，you can lock the corresponding tariff rate through **accurate HS code classification of goods** (most solid wood furniture products are 0%-4%)，and apply for the EU VAT deferral policy at the same time. There is no need to prepay value-added tax at the import link，and the capital occupation period of this part is extended from 30 days to 90 days，reducing capital cost. If the annual import volume exceeds 1 million euros，you can apply for EU Authorized Economic Operator (AEO) qualification and enjoy benefits such as tariff deferral and fast customs clearance.

In terms of access requirements，documents such as commodity certificate of origin and composition inspection report need to be provided in advance to ensure compliance of HS code classification. Taking your single batch of solid wood furniture worth 1 million RMB as an example，adopting VAT deferral can save 230,000 RMB of capital occupation，with a return ratio of about 6%-8%，and effectively avoid customs clearance risks at the same time.

### Answer 2

In the Poland import customs declaration process, HS code classification is the core. A common misunderstanding is that classification is only based on commodity name, without combining details such as material and use. For example, if a solid wood storage rack is incorrectly classified as "general storage rack" instead of "furniture", the tariff rate may differ by 2%-3%.

If incorrect classification is questioned by customs during price verification, more than 10 documents such as composition inspection report and purchase contract need to be submitted, which takes 7-10 days and directly leads to port congestion of goods. It is necessary to entrust an institution with EU customs declaration qualification to pre-audit the HS code in advance to ensure classification compliance, and prepare a price negotiation plan in advance. If the customs verified price is higher than the declared price, you can provide payment certificates, supplier cost lists and other supporting materials to avoid deleting the declaration and re-submitting.

### Answer 3

From the perspective of logistics routes, most goods imported to Poland are transshipped through Hamburg and Rotterdam. If the tariff rate is not confirmed in advance, resulting in insufficient tax reserve, the goods will be detained at the transshipment port, generating a daily port storage fee of 300 euros. You need to provide the commodity HS code to the logistics service provider when booking the space, so that they can calculate the tariff and additional taxes in advance and reserve sufficient tax amount.

If you choose to sail directly to the Port of Gdansk, Poland, you need to submit the manifest information to the port 72 hours in advance, and apply for a 3-day free storage period to avoid container detention fee caused by customs clearance delay. If the goods are detained by customs, you can entrust a local agent to assist in submitting supplementary documents, shortening the customs clearance time to 3-5 days.

### Answer 4

In addition to the basic tariff, 23% value-added tax is required for import to Poland, and 5%-22% consumption tax is also levied on some luxury goods. If your company has a branch in the EU, you can transfer profits to low-tax member states through cross-border tax planning, but you need to comply with BEPS (Base Erosion and Profit Shifting) rules to avoid triggering anti-avoidance investigations.

If you adopt the VAT deferral policy, you need to submit the value-added tax declaration form to the Polish tax authority within 10 days after import, and a late fee of 1%-2% will be incurred for overdue. At the same time, if the goods originate in China, you can enjoy zero tariff treatment with the China-EU Free Trade Agreement certificate of origin, and you need to apply to the supplier for the certificate of origin in the required format in advance.

### Answer 5

The payment and settlement process of Poland import needs to comply with EU anti-money laundering regulations. If the tariff amount exceeds 100,000 euros, you need to provide customs declaration, tariff payment certificate and other documents to the bank to avoid being listed as a suspicious transaction.

If you use RMB Cross-border Interbank Payment System (CIPS), you can lock the risk of exchange rate fluctuation and reduce exchange loss. At the same time, you need to complete settlement and reconciliation within 30 days after receiving foreign exchange.

If the payment is delayed due to tariff disputes, you need to submit the dispute certificate issued by customs to the bank to avoid being included in the foreign exchange regulatory blacklist. In addition, payment from offshore accounts needs to be reported to the Polish tax authority in advance to ensure compliance of the payment and settlement process.

### Answer 6

The tariff bearer should be clearly specified in the purchase contract. If it is agreed that the Chinese party bears the tariff, the clause that "the supplier shall bear the additional tariff and fine caused by incorrect HS code classification" should be added to avoid disputes caused by incomplete commodity information provided by the supplier. At the same time, you need to complete intellectual property customs protection filing.

If your solid wood furniture has its own brand, you can file it with the Polish customs to avoid parallel import of counterfeit products. If the goods are detained by customs due to tariff disputes, you can claim compensation from the supplier according to the contract, or entrust a local lawyer to apply for customs administrative reconsideration. The maximum reconsideration period is 30 days, and the goods can be applied for temporary storage in a bonded warehouse during the period to reduce the loss of port storage fees.

### Answer 7

During on-site inspection by Polish customs, they will focus on checking whether the commodity HS code is consistent with the actual goods. If the material of solid wood dining sets is marked as "oak" but actually "rubber wood", it will be judged as incorrect classification, triggering tariff supplementary payment and fine. You need to take clear detailed photos (such as material texture, nameplate information) when packing the goods, and attach the composition inspection report, which can be directly provided to the customs during inspection.

If the customs requires devanning inspection, you need to entrust a local agent to supervise on site in advance to ensure the goods are not damaged. If the test report is inconsistent with the declaration, you need to submit supplementary supporting materials within 3 days, otherwise the goods will be returned or destroyed.

### Answer 8

Import of solid wood furniture to Poland needs to comply with EU IPPC marking requirements for wooden packaging. If the packaging is not stamped with IPPC marking, the goods will be detained by customs and forced to be fumigated, generating fumigation fee of 2000-5000 euros and 10-15 days of port congestion.

You need to use wooden pallets that meet IPPC standards for packaging, stamp heat treatment marks, and attach the fumigation certificate. At the same time, to meet the moisture-proof requirement of solid wood furniture, you need to place desiccants in the packaging to avoid moisture and mold during transportation.

If the goods are damaged due to non-compliant packaging, you cannot claim compensation from the insurance company. In addition, you need to mark clear information such as HS code and origin on the outside of the packaging to facilitate rapid identification by customs.

### Answer 9

From the perspective of supply chain cost, fluctuations in Poland import tariff will directly affect the overall procurement cost. It is necessary to establish a dynamic cost calculation model, and incorporate tariff, value-added tax, logistics cost and other items into unified accounting. If your annual import volume exceeds 500 containers, you can sign a long-term procurement agreement with the Polish supplier, agree to share the risk of tariff fluctuation, and allocate the cost of the tariff increase to both parties.

At the same time, you can build a bonded warehouse in Poland, store goods temporarily in the bonded warehouse, and clear customs after the domestic order is confirmed, to avoid capital occupation caused by inventory backlog. In addition, you can convert the CIF trade term to FOB, transfer logistics, tariff and other risks to the supplier, but you need to clarify the responsibility boundary of both parties in advance.
