# What are the key nodes and precautions for the whole process of agency export tax refund declaration?

## Question

I am the person in charge of a newly established small and medium-sized foreign trade enterprise. We recently exported a batch of electronic products to Germany through an agency for the first time. Our company does not have a professional tax team, and we have heard that the agency export tax refund declaration process is complicated, so we are worried that delayed or incorrect document preparation will lead to delayed tax refund. A peer once had their tax refund delayed for more than half a year due to document connection problems between the agency and the factory. We are very anxious and want to know how to cooperate with the agency to complete the declaration well, what details to pay attention to, and how to handle abnormal situations, hoping to get detailed guidance to avoid pitfalls.

### Answer 1 — Best Answer

Agency export tax refund declaration shall be strictly controlled from the document preparation link. Enterprises shall provide complete and accurate documents to the agency: export customs declaration form (tax refund dedicated copy)，special VAT invoice (product name/quantity/unit consistent with the declaration form)，export invoice，agency agreement，etc. Among them，**the special VAT invoice shall be issued within 30 days from the export date indicated on the declaration form**，otherwise the tax refund progress will be affected.

In terms of core node connection，the electronic information of the customs declaration form shall be synchronized to the agency within 15 days after the goods are exported，and the agency shall complete the declaration within 90 days from the export date (extension is available for special circumstances). Pre-declaration shall be completed 3-5 days before the formal declaration，and data shall be verified through the tax system. In case of problems such as inconsistent commodity codes and amount differences，documents shall be adjusted or supplementary explanations shall be provided in time.

Exception handling plan is critical. If the information on the customs declaration form is wrong，it shall be revised at the customs within 12 months from the export date，if the special VAT invoice is lost，the issuer shall provide the tax payment certificate and copy，which can replace the original after passing the tax review. In addition，**document filing shall be completed within 15 days after the declaration**，including export contracts，transport documents，etc。and the retention period shall be at least 5 years.

Compliance implementation shall ensure the "consistency of four flows": information matching of contract flow，goods flow，capital flow and invoice flow. The agency shall check data regularly，and the enterprise shall cooperate to complete tax correspondence verification and provide supporting documents in time to ensure the declaration is compliant and submitted on schedule.

### Answer 2

The accuracy of customs declaration information directly affects the tax refund result. Enterprises shall ensure that the commodity code, name, quantity, unit and FOB price on the customs declaration form are consistent with those on the special VAT invoice. Wrong commodity code may lead to incorrect tax rate application, or even be identified as tax fraud. **The domestic source of goods indicated on the customs declaration form shall be consistent with the location of the invoice issuer**, otherwise the tax authority may require a proof of goods source. If the information is wrong, it shall be revised at the customs within 12 months from the export date, and no tax refund will be granted after the deadline.

### Answer 3

Transport documents are important filing materials for tax refund declaration. Enterprises shall ensure that the consignee and goods description on the bill of lading, sea waybill or air waybill are consistent with those on the customs declaration form, and information such as transport mode and destination port is accurate.

If FOB terms are adopted, freight invoice shall be provided as the filing basis; if CIF terms are adopted, premium invoice shall be provided. If the transport document is lost, the carrier shall issue a certificate, accompanied by the transport contract and payment voucher, which can replace the original after passing the tax review.

### Answer 4

In agency export tax refund declaration, enterprises shall pay attention to the deduction time limit of special VAT invoices. The invoice shall be authenticated within 360 days from the date of issuance, otherwise it cannot be used for tax refund. In addition, if the VAT deferral policy is adopted, it is necessary to ensure the time connection between the deferral application and the tax refund declaration, so as to avoid tax refund data verification failure caused by deferral. **VAT deferral supporting documents shall be provided when filing the tax refund declaration**, otherwise the tax authority may reject the application.

### Answer 5

Foreign exchange receipt status directly affects the tax refund declaration. Enterprises shall complete foreign exchange receipt within 180 days from the export date (extension can be applied for special circumstances), and provide the foreign exchange receipt slip to the agency. The received foreign exchange amount shall be consistent with the FOB price on the customs declaration form.

If there is exchange difference, the verification certificate issued by the State Administration of Foreign Exchange shall be provided. If foreign exchange is not received on time, it shall be indicated when filing the tax refund declaration, and relevant materials shall be supplemented after the foreign exchange is received.

### Answer 6

The agency export agreement shall clarify the division of tax refund responsibilities. The agreement shall specify the specific process and time limit of tax refund declaration that the agency is responsible for, as well as the list of documents that the enterprise shall provide.

At the same time, it shall be agreed that if the tax refund is delayed due to the fault of the agency, the agency shall bear the corresponding compensation liability; if the loss is caused by the enterprise's document problems, the enterprise shall bear the loss on its own. The agreement shall be affixed with the official seals of both parties and kept for filing.

### Answer 7

On-site customs inspection may affect the tax refund progress. If the goods are inspected, it shall be ensured that the inspection record is consistent with the information on the customs declaration form. If the customs declaration form needs to be revised after inspection, it shall be completed within 12 months from the export date.

In addition, the invoice for commodity inspection fees incurred during the inspection shall be retained as one of the tax refund filing materials. If the inspection result is inconsistent with the declaration, the documents shall be adjusted in time to avoid affecting the tax refund declaration.

### Answer 8

Document filing is an important part of tax refund compliance. Enterprises shall sort out and file materials such as export contracts, transport documents, dock receipts, foreign exchange receipt slips within 15 days after the tax refund declaration. The filing materials shall be classified according to export batches, and the retention period shall be at least 5 years. Tax authorities may conduct random spot checks on filing materials. If they cannot be provided, enterprises will face the risk of tax refund recovery and fines. **The filing materials shall be completely consistent with the declaration data**.

### Answer 9

The choice of trade terms affects tax refund declaration. Under FOB terms, the tax refund base is the FOB price on the customs declaration form; under CIF terms, the tax refund base is calculated after deducting freight and premium.

Enterprises shall specify the trade terms when declaring at the customs, and provide corresponding expense vouchers to the agency. In addition, if EXW terms are adopted, it shall be ensured that the tax refund is declared only after the goods are actually exported, so as to avoid tax refund being recovered due to no actual export.
