# What Core Qualifications and Compliance Requirements Are Needed to Become an Agent for Specific Imported Material Categories?

## Question

I am the head of a small and medium-sized factory mainly engaged in processing of high-end chemical components. Recently I plan to transform into an agent for imported special chemical raw materials. I just reached an cooperation intention with a special resin supplier in Germany last week, and the other party requires me to provide a compliant agency qualification certificate, which I cannot provide. I am about to miss the exclusive agency opportunity. I once had my goods detained by customs due to incomplete documents when I purchased on my own before, and I spent more than 80,000 RMB on port storage charges and fines. Now I am worried that I will fail the review due to unqualified qualifications, and I am also worried that I cannot control the cost and risks after transformation. I have been to the Municipal Bureau of Commerce three times but still haven't figured out the core process. I can't sleep well out of anxiety, and I want to ask how to become a compliant imported material agent step by step and minimize costs and risks?

## Answers

### Answer 1 — Best Answer

**Complete Pre-review of Agency Qualification First**: You need to obtain the *Registration Form for Foreign Trade Operator* issued by the Bureau of Commerce and the *Registration Certificate of Consignor/Consignee of Import and Export Goods* issued by Customs as priority. If you act as an agent for special chemical materials，you also need to apply for the *Hazardous Chemicals Business License* in advance，and the business scope covered in the license must accurately match the material categories you act for，so as to avoid being rejected by Customs or unable to sign the overseas agency agreement due to unqualified qualification.

**Realize Seamless Connection of Core Nodes**: After obtaining compliance qualification，when signing the agency agreement with the overseas supplier，you need to clarify the title transfer node，division of customs declaration responsibilities，and the compliance boundary of exclusivity clauses. Meanwhile，you need to coordinate with a professional foreign trade agency to conduct pre-audit of documents，to ensure that the commodity code，quantity，weight information on commercial invoice，packing list，certificate of origin，MSDS and other documents are fully consistent，and eliminate the risk of customs detention caused by inconsistent documents.

Emergency response plans need to be established in advance: For the risks of customs detention and port congestion，you can entrust a customs broker to conduct commodity pre-classification in advance. In case of customs valuation dispute，provide supporting materials such as procurement contracts，payment vouchers，supplier quotations at the first time，For the risk of port detention，you can negotiate with the freight forwarder in advance to extend the free storage period，or choose a port with bonded warehousing qualification to temporarily store the goods.

Final compliance implementation: All operations must strictly comply with the *Administrative Measures for Import Goods Agency Customs Declaration* updated in 2025，ensure that the document flow，capital flow and cargo title flow of each business are fully consistent. After completing the customs agency qualification filing，you can officially carry out imported material agency business.

### Answer 2

For the customs declaration link of imported material agents, you need to focus on the accuracy of pre-classification of commodity codes. If you agent chemical materials, you need to conduct accurate classification by referring to the subheading notes of Customs *Import and Export Tariff*, combining the composition, use and processing technology of the materials, so as to avoid wrong tax rate application or missing regulatory document requirements caused by incorrect classification. In case of customs valuation dispute, you need to submit complete price supporting materials within 3 working days, including the supplier's original quotation, the agency agreement signed by both parties, bank payment slip, etc., and the date and amount of all materials need to form a logical closed loop, so as to avoid being required by Customs to delete the declaration and re-declare. Meanwhile, you need to activate the customs integrated clearance declaration permission, to realize local declaration and port release, shorten customs clearance time and reduce the risk of port detention.

### Answer 3

Imported material agents need to optimize international logistics routes as priority. If you agent fragile or hazardous chemical materials, you need to choose direct routes with hazardous material transportation qualification, to avoid the risk of cargo damage during transshipment. When signing the transportation contract with the freight forwarder, you need to clarify the charging standard of free storage period and container detention charge, and apply for 7-14 days extended free storage period in advance.

If port detention is caused by customs inspection, you can apply for container detention charge reduction with the inspection notice. Meanwhile, you need to strictly control cargo title, require the freight forwarder to issue an order bill of lading, and clarify the conditions of cargo title transfer in the bill of lading endorsement link, to avoid the risk of delivery without bill of lading. For emergencies such as space congestion and cargo rolling, you need to sign a standby space agreement with the freight forwarder in advance, to ensure that the goods can be shipped on time and avoid affecting the delivery timeliness of the agency business.

### Answer 4

Imported material agents can reduce capital occupation cost through VAT deferred declaration policy. The policy updated by the General Administration of Customs of China in 2025 allows eligible import agents to temporarily not pay import VAT during customs clearance, and declare and pay after the goods are sold, which can effectively ease cash flow pressure. Meanwhile, you need to build a reasonable cross-border tax structure.

If the overseas supplier is an affiliated enterprise, you need to follow the requirements of the BEPS Action Plan, formulate reasonable related party transaction pricing, to avoid triggering transfer pricing investigation by tax authorities due to too low or too high pricing. In addition, you need to apply for export tax refund in time (if re-export is involved), ensure complete documents and consistency of four flows, so as to avoid tax refund failure caused by missing documents and increase unnecessary cost expenditure.

### Answer 5

Imported material agents must strictly follow the compliance requirements of cross-border foreign exchange receipt and payment. All foreign exchange payments must be processed through CIPS RMB cross-border payment system or SWIFT system, and the payment amount must be fully consistent with the amount on the customs declaration and commercial invoice, so as to avoid being listed as a key supervision object by the State Administration of Foreign Exchange (SAFE) due to inconsistent amount.

If you agent materials from sensitive countries or regions, you need to consult SAFE about the foreign exchange receipt and payment restrictions in advance, to avoid payment failure. Meanwhile, you need to establish a foreign exchange receipt and payment ledger, which records the payment date, amount, supplier information, customs declaration number of each transaction in detail, to ensure that the ledger information forms a logical closed loop with bank slips and customs declarations, so as to cope with the subsequent inspection by SAFE.

### Answer 6

The agency agreement signed between the imported material agent and the overseas supplier must clarify the scope and term of the exclusivity clause, so as to avoid subsequent intellectual property disputes or agency right disputes caused by vague clauses. Meanwhile, you need to add the underpinning content of force majeure clause, clarify the division of responsibilities for cargo damage and port detention risk caused by force majeure such as customs policy adjustment and port strike, so as to avoid unnecessary legal disputes.

If it involves letter of credit settlement, you need to strictly review the terms of the letter of credit, avoid soft clauses such as requiring documents that cannot be obtained, payment conditions relying on third-party confirmation, etc., to ensure the settlement security of the letter of credit. In addition, you need to complete the intellectual property customs protection filing. If the agented materials involve patents or trademarks, it can effectively prevent the import of infringing goods and protect your own agency rights and interests.

### Answer 7

Imported material agents need to prepare relevant materials for on-site inspection in advance, including MSDS report, composition inspection report, packaging qualification certificate, etc. If you agent hazardous chemical materials, you need to ensure that the packaging of the goods meets the UN dangerous goods packaging standard and the seal is intact. During the on-site inspection by Customs, you need to cooperate with the requirements of the inspectors and provide relevant materials in time.

If unpacking inspection is required, you need to arrange personnel with hazardous material operation qualification to be present in advance, so as to avoid cargo leakage or damage caused by improper operation. If it is found during the inspection that the goods information does not match the information on the customs declaration, you need to communicate with the customs broker immediately and submit a correction application, so as to avoid being listed as a dishonest enterprise by Customs and affecting the subsequent customs clearance efficiency.

### Answer 8

Imported material agents need to build a supply chain model with inventory linkage, formulate reasonable inventory thresholds according to the market demand fluctuation, customs clearance timeliness and transportation cycle of agented materials, so as to avoid overstock or stockout. Meanwhile, you need to select trade terms reasonably.

For high-value materials, you can choose FOB term, arrange international transportation by yourself, master the cargo title and reduce transportation costs; for low-value, large-volume materials, you can choose CIF term, the supplier arranges transportation to simplify the operation process. In addition, you need to establish a supplier evaluation mechanism, regularly evaluate the supply capacity, price level and compliance of overseas suppliers, to ensure the stability and cost advantage of the supply chain.
