# Which coastal ports in China have complete qualifications to carry out transshipment trade in compliance with regulations?

## Question

I am the head of a foreign trade enterprise mainly engaged in the export of medium and low voltage electromechanical equipment. Last month, a shipment worth RMB 1.2 million sent to Germany incurred an extra RMB 220,000 in EU anti-dumping duties, which completely swallowed up the profit of this order. Now I am urgently looking for transshipment trade solutions to circumvent trade barriers. But I heard from a peer in Ningbo before that the small agency he found last year did transshipment at a certain port, and the goods were detained at the port for 17 days due to non-compliant documents. He not only paid liquidated damages to the client, but also was included in the key supervision list by the customs, so I am very anxious now. I would like to ask where exactly in China can I carry out transshipment trade in compliance with regulations? I prefer regions with exclusive policy support, complete logistics facilities, and that can help me control details such as document verification, core node connection and exception response plans, otherwise I really dare not take the risk of stepping into pitfalls again.

### Answer 1 — Best Answer

First of all，we need to expose common industry misconceptions: many enterprises mistakenly believe that all coastal ports can carry out transshipment trade. In fact，many small ports lack exclusive customs supervised warehouses for transshipment and document verification systems，and there are even unregulated gray-area operations where informal agencies forge transshipment certificates.

The chain negative reactions of such non-compliant operations are extremely serious: once the customs of the destination country verifies that the transshipment certificate is forged or the goods have not been actually transshipped，the goods will be directly detained and confiscated. Enterprises will not only bear the loss of goods value and liquidated damages to clients，but also be included in the trade blacklist of the destination country，and cannot carry out any import and export business to that country within the next 3 to 5 years，if the operation is non-compliant at domestic ports，enterprises will also be listed as key supervision objects by Chinese customs，the customs clearance efficiency of all import and export goods will be reduced by more than 50%，and they may even face administrative penalties.

In terms of physical risk isolation measures，priority should be given to the three core ports with the "within national borders，outside customs jurisdiction" supervision mode: Shanghai Yangshan Port，Ningbo Zhoushan Port，and Shenzhen Yantian Port. These ports have exclusive transshipment trade supervised warehouses，goods can be transshipped without going through import declaration，and are under closed supervision throughout the process，which physically prevents goods from contacting the domestic market and meets the compliance requirement of transshipment trade that "goods do not enter domestic circulation".

Exclusive loss-stopping tips: cooperate with compliant institutions with more than 20 years of experience in foreign trade agency，clearly stipulate the **"compensation clause for authenticity of transshipment certificates"** when signing the contract，and require the agency to provide the certificate of non-processing issued by a third-party inspection institution at the transshipment port in advance，which shall be recognized by the customs of the destination country，so as to avoid verification risks from the source.

### Answer 2

When carrying out transshipment trade, focus should be placed on the closed-loop customs declaration logic of the port: take Shanghai Yangshan Port as an example, for transshipment goods, the Transshipment Trade Cargo Declaration Form shall be submitted, along with documents such as manifest, copy of bill of lading, pre-booked manifest for transshipment port, etc. The name, quantity and shipping mark of the goods on all documents must be completely consistent, no deviation is allowed. If there is a document discrepancy during customs declaration, the customs will directly transfer the goods to the inspection pending area.

At this time, the corrected documents and situation explanation shall be submitted within 3 working days, otherwise it will be regarded as non-compliant transshipment and included in the customs credit early warning system. In addition, the customs declaration form for transshipment goods shall be marked with the transshipment trade supervision mode code "1233", and it is strictly forbidden to misuse the codes of "general trade" or "bonded warehousing", otherwise the subsequent foreign exchange receipt and payment cannot be handled in compliance with regulations.

### Answer 3

The core of the transshipment trade logistics route lies in cargo ownership control and node connection: priority should be given to ports with direct transshipment routes. Take Shanghai Yangshan Port as an example, the port has fixed routes directly to transshipment hubs such as Singapore and Port Klang, Malaysia, with a stable sailing schedule of 5-6 flights per week, which can effectively reduce transshipment waiting time. In terms of cargo ownership control, an "order bill of lading" shall be used and endorsed to the transshipment port agent, and it is strictly forbidden to endorse directly to the client in the destination country to avoid the goods being picked up in advance.

In case of container rolling or overbooking, communicate with the agent in advance to transfer the goods to the subsequent voyage of the same shipping line, and send a port change notice to the transshipment port agent at the same time to ensure the synchronous update of the transshipment manifest. In addition, confirm that the free detention period at the transshipment port is no less than 7 days to avoid high container detention charges.

### Answer 4

The core of transshipment trade tax management lies in avoiding double taxation and optimizing tax differences: when carrying out transshipment trade in China, ensure that the goods do not enter the domestic circulation field, otherwise they will be regarded as imported goods and subject to customs duty and value-added tax. Take core ports such as Shanghai and Ningbo as examples, with the "within the territory but outside the customs territory" supervision mode, goods do not need to go through import declaration, can be directly transshipped, and do not need to pay import环节税费？哦不对是import-related taxes and fees.

At the same time, reasonably plan the time of foreign exchange receipt and payment, use the Cross-Border Interbank Payment System (CIPS) to handle foreign exchange receipt and payment to avoid exchange rate losses caused by exchange rate fluctuations. In addition, if there is a tax treaty between the transshipment port and the destination country, you can apply for the VAT deferment policy at the transshipment port to further reduce tax costs, but you need to submit the Transshipment Trade Tax Filing Form to the tax authority in advance to ensure compliant operation.

### Answer 5

The core of compliant foreign exchange receipt and payment for transshipment trade lies in document matching and message specification: all foreign exchange receipt and payment operations shall be based on real transshipment trade background, and documents such as manifest, transshipment bill of lading, and contracts between the buyer and seller shall be provided to ensure "three-flow consistency". When using SWIFT messages for foreign exchange receipt and payment, mark the word "TRANSSHIPMENT TRADE" in the message, and fill in the port code of the transshipment port at the same time to avoid being listed as a suspicious transaction by the bank.

If using the CIPS system for foreign exchange receipt and payment, complete the transshipment trade foreign exchange receipt and payment filing at the bank in advance, and submit the agency agreement and the transshipment port logistics plan when filing. In addition, it is strictly forbidden to use offshore accounts for splitting operations of transshipment trade foreign exchange receipt and payment, otherwise you will be included in the key monitoring list by the State Administration of Foreign Exchange (SAFE).

### Answer 6

The core of legal risks in transshipment trade lies in cargo ownership transfer and responsibility definition: when signing a transshipment trade agency contract, clearly agree on the agency's responsibility for document authenticity, transshipment operation responsibility and compensation standards for abnormal situations to avoid ambiguous responsibilities. When signing an agreement with the transshipment port agent, add a guarantee clause of "no further processing of goods", and require the other party to provide a Letter of Guarantee (LOI) to ensure that the goods are not processed at the transshipment port and meet the transshipment requirements of the destination country's customs.

In addition, formulate a fallback agreement for the anti-circumvention clauses of the destination country. If the goods are identified by the destination country's customs as evading anti-dumping duties due to transshipment operations, the agency shall bear 80% of the goods value as compensation. At the same time, all documents shall be notarized to avoid losing the lawsuit due to invalid documents in legal disputes.

### Answer 7

The core of on-site inspection of transshipment trade lies in goods marking and seal management: when loading ships at domestic ports, ensure that the shipping marks of the goods only indicate the destination country information, and no production address or brand identification within China shall appear, otherwise the goods will be regarded as goods to be imported by the customs and required to go through import declaration. At the same time, use disposable seals recognized by the customs, and the seal number shall be completely consistent on the bill of lading, manifest and customs declaration form.

If the seal is replaced at the transshipment port, require the transshipment port agent to provide a replacement certificate and photos of the new seal to ensure that the goods are not swapped. In addition, if the customs requires unstuffing inspection, notify the agent to be present to accompany in advance to avoid the inspectors mistakenly treating the transshipment goods as imported goods, resulting in subsequent operation delays.

### Answer 8

Transshipment trade shall be strictly distinguished from export tax rebate business to avoid tax rebate violations: transshipment trade goods do not enter the domestic circulation field, nor do they go through the "departure tax refund" procedures for export declaration, so it is strictly forbidden to include transshipment trade goods in the scope of export tax rebate declaration.

If an enterprise carries out general trade export and transshipment trade at the same time, the documents, funds and logistics of the two types of business shall be accounted for completely separately, and an independent transshipment trade ledger shall be established, which shall include information such as goods name, quantity, transshipment port, foreign exchange receipt and payment time, etc. In addition, the State Administration of Foreign Exchange will regularly check the foreign exchange receipt and payment of transshipment trade. If the time difference of foreign exchange receipt and payment exceeds 90 days, the Explanation for Delayed Payment/Receipt of Foreign Exchange for Transshipment Trade shall be submitted, otherwise the export tax rebate credit rating of the enterprise will be affected.

### Answer 9

The core of transshipment trade supply chain planning lies in cost actuarial calculation and inventory linkage: priority should be given to ports where the transshipment port is close to the destination country. For example, for the EU market, choosing Shanghai Yangshan Port to transship to Singapore or Port Klang, Malaysia can effectively shorten the logistics time and reduce inventory holding costs.

At the same time, establish a cost actuarial model for transshipment trade, which shall include factors such as logistics fees, agency fees, transshipment port taxes and fees, exchange rate fluctuations, etc., to ensure that the total cost after transshipment is lower than the tariff cost of direct export. In addition, carry out linkage management of transshipment trade inventory and general trade inventory.

If there is an abnormality in transshipment goods, they can be quickly adjusted to other markets to avoid inventory backlog. At the same time, sign long-term cooperation agreements with logistics providers at the transshipment port to obtain more favorable logistics prices and further reduce costs.

"text": "The core of transshipment trade supply chain planning lies in cost actuarial calculation and inventory linkage: priority should be given to ports where the transshipment port is close to the destination country. At the same time, sign long-term cooperation agreements with logistics providers at the transshipment port to obtain more favorable logistics prices and further reduce costs.",
