# What specific compliance requirements must be met for reexport trade remittance to avoid regulatory account freezing?

## Question

I am engaged in mechanical and electrical parts export. Last week, I completed a reexport trade of purchasing goods in Thailand and reselling them to Brazil. We originally agreed to use an offshore account for remittance, but the bank suddenly sent a verification notice asking for a lot of document materials I had never heard of before. Now the goods have arrived at the port for the Brazilian customers, who are urging me to release the bill of lading every day, and the demurrage fee is increasing by hundreds of dollars per day. I am so anxious that I can't even eat. Worse still, I heard last week that a neighboring peer had their account frozen, was required to pay back taxes and fines, and even lost their customers due to non-compliant reexport trade remittance. I used to leave document processing to the freight forwarder when doing reexport trade, and never paid attention to the compliance details of remittance. Now I am afraid of not receiving the payment and of having problems with my account. I want to know how to complete the remittance compliantly in this situation and avoid falling into the same pitfalls in the future?

### Answer 1 — Best Answer

First，urgently complete the compliant documents required by the bank，and focus on completing **consistency verification of full-cycle cargo right documents**: Immediately ask the freight forwarder for the full through bill of lading from Thailand to Brazil (or the warehouse in-out proof of the transit warehouse)，ensure that the goods name，model，quantity and total price on the purchase contract，sales contract and bill of lading are completely matched. If there is information deviation in the documents provided by the freight forwarder before，ask for reissue immediately to avoid triggering stricter regulatory review due to document contradictions.

Two tasks need to be promoted synchronously at the core node connection: On the one hand，when submitting the completed documents to the bank，attach the business description of the reexport trade，clearly stating that the cargo flow is "Thailand procurement - temporary storage in transit warehouse - delivery to Brazil" with no domestic landing. On the other hand，immediately contact the Brazilian customers to apply for an extension of 3-5 days of demurrage exemption，and simultaneously follow up the cargo status with the freight forwarder to avoid additional costs caused by demurrage.

For the current abnormal situation，start the temporary contingency plan: If the bank still delays the review，you can apply to temporarily adjust the remittance method to documents against acceptance under letter of credit，using the bank credit endorsement of the Brazilian customers to speed up the capital arrival efficiency，but ensure that there are no soft traps in the letter of credit terms. For subsequent compliant implementation，confirm the filing requirements for reexport trade remittance with the opening bank in advance，submit the purchase contract and logistics plan to the bank for pre-review before each operation，and ensure **the logical closed loop of capital flow and document flow** to avoid triggering regulatory review again.

### Answer 2

The cargo flow corresponding to reexport trade remittance must ensure that no actual inbound declaration is made within the territory. If inbound customs declaration is made due to operational errors, immediately apply to the customs for correction filing of reexport trade, submit transit logistics agreement, overseas purchase and sales contracts and other materials to prove that the goods are only in transit without landing.

If the bank finds that the customs record is general trade inbound during verification, it will directly determine that the remittance is non-compliant, triggering account freezing or capital transfer restrictions. In addition, ensure that the declared cargo value of reexport trade is consistent with the remittance amount. If there is a price review dispute, submit cargo value certification materials to the customs in advance to avoid the inconsistency between the remittance amount and the filed cargo value caused by customs price review adjustment.

### Answer 3

The core of reexport trade remittance is the synchronization of cargo rights and funds. The logistics path should select a third-party warehouse with transit qualification, ensure that the full-cycle cargo right documents are negotiable order bills of lading, and the bill of lading endorsement must be consistent with the remittance account subject. If using sea transit, avoid the goods landing at domestic ports, and choose free trade ports such as Hong Kong and Singapore as transit nodes.

The freight forwarder must provide a full through bill of lading instead of sectional bills of lading, otherwise the bank will refuse remittance due to inability to confirm the cargo flow. In addition, confirm the cargo right control agreement of the transit warehouse in advance to avoid the freight forwarder releasing goods without authorization. If the customer requires releasing the bill of lading before remittance, ask the freight forwarder to issue a cargo right retention guarantee to ensure that the cargo rights are still under our control before remittance.

### Answer 4

Reexport trade remittance must ensure the compliance of tax treatment. If the transit node is located in the EU, VAT deferred declaration shall be handled to avoid the transit country's tax authorities issuing violation certificates due to unpaid import VAT, which will affect the bank's remittance review.

In addition, if overseas purchase or sales involve related-party transactions, ensure that the transaction pricing conforms to the arm's length principle to avoid the adjustment of remittance amount due to the tax authorities' determination of transfer pricing, which will trigger the bank's anti-money laundering review. For reexport trade remittance of non-resident enterprises, handle the tax filing for non-resident enterprises in advance to avoid the capital being frozen by the tax authorities due to failure to fulfill tax obligations.

### Answer 5

When remitting for reexport trade, the SWIFT message or CIPS payment instruction's remittance advice must clearly mark "REEXPORT TRADE REMITTANCE" and attach the corresponding contract number and bill of lading number to avoid the bank determining it as a suspicious transaction due to vague message information. When using an offshore account for remittance, submit document backups of reexport trade to the opening bank every month, including purchase contracts, sales contracts, bills of lading, etc., to ensure that the account flow is consistent with the business substance.

If the remittance amount exceeds 500,000 US dollars, submit a large remittance filing to the bank in advance to avoid temporary account freezing due to failure to trigger a large transaction warning. In addition, avoid using personal offshore accounts for reexport trade remittance, otherwise the bank will refuse to credit the account because the personal account cannot match the trade documents.

### Answer 6

If letter of credit is used for reexport trade remittance, ensure that the letter of credit terms clearly mark "under reexport trade" and do not contain soft clauses requiring the submission of domestic inbound customs declaration forms, otherwise the issuing bank will refuse to pay due to inability to meet the term requirements.

If telegraphic transfer is used, clearly stipulate the relevant clauses between remittance time and cargo right transfer in the sales contract, such as "deliver the bill of lading within 3 working days after the remittance arrives" to avoid the situation of losing both payment and goods if the customer requires releasing the bill of lading before remittance. In addition, if the transit freight forwarder requires paying a deposit, ask the other party to issue an irrevocable performance guarantee to ensure that you can claim losses with the guarantee if the remittance is blocked due to the freight forwarder's mistake.

### Answer 7

Reexport trade is not within the scope of export tax rebates. Ensure that business records are strictly distinguished from general trade. If reexport trade remittance is mixed into the general trade remittance flow, there will be a discrepancy between the remittance amount and the customs declaration amount during export tax rebate declaration, triggering tax investigation, which will affect the bank's compliance judgment of the account.

In addition, keep all documents of reexport trade separately, including purchase contracts, sales contracts, bills of lading, logistics vouchers, etc., to avoid being unable to prove the business substance during tax verification due to mixed documents, which will lead to being required to pay back taxes, and the bank will restrict the account's payment and remittance functions due to tax violation records.

### Answer 8

The efficiency of reexport trade remittance is directly related to the supply chain structure. Choose a closed-loop structure of "overseas procurement - free trade port transit - overseas sales" to avoid the goods passing through domestic ports and reduce compliance review links.

In terms of trade terms, adopt FCA (Free Carrier) or CPT (Carriage Paid To) terms to ensure that the remittance conditions are triggered when the cargo right is transferred at the transit node, avoiding the large time difference between cargo right transfer and remittance caused by adopting FOB or CIF terms. In addition, establish a linkage early warning mechanism for remittance and logistics, which automatically triggers a remittance reminder when the goods enter the transit warehouse, ensuring the synchronization of capital flow and cargo flow and avoiding the situation where the goods have been delivered but the remittance has not been received.
