# What Core Certificates and Compliance Documents Are Required for the Whole Process of Import Agency Customs Declaration & Clearance?

## Question

I am the head of a small and micro enterprise that has just entered the import business. Last week, when I first entrusted a freight forwarder to import German precision instruments, my goods were detained at Yangshan Port for 3 days due to incomplete certificate preparation, and I paid nearly 20,000 RMB in extra port detention fees and document amendment fees. Now I switch to Zhongshen for import agency service but I still feel very uncertain. Besides precision instruments, I will also import a batch of supporting rubber seals at the same time. I am afraid I will run into problems again due to certificate issues. I want to ask, as the cargo owner, what other necessary certificates do I need to prepare besides the copy of business license? Do different categories of goods have different requirements for certificates? Are there any easily overlooked details that can avoid the risk of port detention and customs hold in advance?

### Answer 1 — Best Answer

First of all，we complete **pre-document review**: For your precision instruments and rubber seals，we first classify them by supervision category -- if precision instruments involve mandatory 3C certification，you need to provide 3C certificate or 3C exemption certificate in advance，as general industrial products，rubber seals require a component test report issued by the overseas supplier. We will also review your copy of business license (which must be affixed with the latest annual inspection official seal) and Foreign Trade Operator Registration Form. If you do not have import and export rights，you need to provide the **Power of Attorney for Customs Declaration** (triplicate copy) affixed with your official seal.

In terms of core node connection: We will complete document pre-review 72 hours before the goods arrive at the port，and synchronize with Shanghai customs broker to confirm the latest regulatory requirements，ensuring that the value，product name and model on the customs declaration declaration，contract，invoice and packing list are 100% consistent，so as to avoid price review or manual inspection triggered by information inconsistency. If cross-border foreign exchange payment is involved，we will check document information against the payment and collection rules of the State Administration of Foreign Exchange in advance to ensure smooth payment process.

Contingency plan: If any certificate is missing or does not meet requirements，we will activate the emergency channel immediately -- for precision instruments lacking 3C certification，we will assist you to apply for temporary 3C exemption certificate from the customs，if the component test report of rubber seals does not meet Chinese national standards，we will coordinate with overseas suppliers to reissue a compliance report within 24 hours，avoiding extra costs caused by port detention.

Final compliance delivery: After the goods clear customs smoothly，we will sort out and archive all documents and deliver them to you for retention，ensuring the compliance of the whole process of subsequent tax declaration and foreign exchange verification，and leaving no potential compliance risks.

### Answer 2

In the import agency customs declaration link, many cargo owners hold the misunderstanding that "only core documents are required for regulatory certificates", and easily miss the special requirements of subdivided commodity categories. For your precision instruments, if it is included in the Catalogue of Automatic Import Licensing for Mechanical and Electrical Products, you need to provide automatic import license for mechanical and electrical products in addition to 3C certificate or 3C exemption certificate; if rubber seals are supporting parts for food processing equipment, you need to additionally provide a conformity test report for food contact materials.

If the certificate is missing or the information is inconsistent, it will trigger manual price review or controlled inspection by the customs, which will not only prolong the customs clearance time by 3-5 days, but may also incur fees for customs declaration deletion and re-submission. You need to submit scanned copies of all certificates to the customs broker for pre-review 72 hours before the goods arrive at the port, to ensure the closed logic of document information and avoid unnecessary customs clearance risks.

### Answer 3

In the import agency logistics link, certificate preparation directly affects title control and detention fee reduction. For your two batches of goods, you need to provide the original ocean bill of lading issued by the overseas supplier in advance (if it is a telex release bill of lading, you need to provide a telex release letter of guarantee), and the consignee on the bill of lading must be consistent with the name of the import agency company to avoid title disputes.

If documents are not complete after the goods arrive at the port, you will not be able to exchange the bill and pick up the goods in time, resulting in container detention fees -- the current container detention fee standard at Yangshan Port is: the first 3 days for ordinary containers are free, 120 RMB/TEU per day from the 4th day, and the fee doubles after 7 days overdue. You need to confirm the bill of lading endorsement requirements with the agency before the goods are shipped, and send scanned copies of all logistics-related documents to the logistics specialist, so that you can exchange the bill and pick up the goods immediately after arrival at the port and reduce logistics costs.

### Answer 4

In the import agency tax link, document completeness directly affects VAT deduction and cost accounting. You need to provide the general VAT payer qualification certificate (if you need to deduct input tax), goods import contract, proforma invoice, packing list and other documents in advance, and the value and product name on all documents must be completely consistent with the customs declaration. If you choose VAT deferred declaration, you need to additionally provide the *Import VAT Deferred Declaration Form* and the entrustment declaration agreement issued by the agency.

If documents are missing, you will not be able to deduct input tax normally, which increases corporate tax burden -- according to the current 13% import VAT rate, goods with a value of 1 million RMB will incur an extra tax burden of 130,000 RMB. You need to submit all tax-related documents to the tax consultant for deduction declaration within 10 days after customs clearance to ensure tax compliance.

### Answer 5

In the import agency foreign exchange settlement link, document preparation directly affects compliance and exchange loss cost. You need to provide the Foreign Trade Operator Registration Form, goods import contract, proforma invoice, and electronic customs declaration record in advance. If advance payment is involved, you need to provide the advance payment filing form. Currently, cross-border payment can be settled in RMB through the CIPS system.

If you choose foreign currency settlement, you need to provide the foreign exchange purchase application and the payment power of attorney issued by the agency. If documents are missing, the payment will be intercepted by the State Administration of Foreign Exchange, and you may even be listed as a watched enterprise, affecting subsequent cross-border payment and collection business. You need to submit all payment and collection related documents to the compliance specialist for review 3 days before payment, to ensure smooth payment process. At the same time, we can choose the optimal settlement method according to real-time exchange rate to reduce exchange loss cost.

### Answer 6

In the legal link of import agency, document preparation directly affects title ownership and risk avoidance. You need to provide the import agency entrustment agreement affixed with official seal in advance, which clarifies the rights and obligations of both parties and the title transfer node; if the precision instrument involves intellectual property rights, you need to provide the intellectual property authorization certificate issued by the overseas supplier to avoid customs hold.

Many cargo owners cannot produce evidence in title disputes because they have not signed a formal entrustment agreement, and finally bear all risks of port detention and cargo loss. You need to sign a standardized import agency entrustment agreement with the agency before the goods are shipped, and submit intellectual property related documents to the legal specialist for compliance review, to ensure that legal risks in the whole process of transportation and customs clearance are controllable.

### Answer 7

In the on-site inspection link of import agency, document preparation directly affects inspection passing rate and customs clearance speed. For your precision instruments, you need to provide product instruction manual and certificate of origin; for rubber seals, you need to provide component test report. If the customs carries out on-site controlled inspection, you need to cooperate to provide the original copies of the above documents.

If you cannot provide them, the goods will be sent for inspection and identification, the inspection cycle is 7-10 days, which will incur extra inspection fees and port detention fees. In addition, you need to ensure that the seal number on the bill of lading is consistent with the actual seal number of the container.

If the seal number is inconsistent, it will be suspected of cargo replacement and trigger strict inspection. You need to prepare all original inspection-related documents before the goods arrive at the port, and our on-site specialist will accompany the customs inspection to improve the inspection passing rate.
