# What are the core steps and key details to focus on for the entire return import customs declaration process? What exclusive documents are required for return import customs declaration? What are the core audit points?

## Question

I'm the head of an outdoor goods export company based in Shanghai. Last month, we shipped a batch of camping tents worth 800,000 USD to Germany. Our customer found that 15% of the tent brackets had welding cracks during acceptance, and required the entire batch to be returned for rework. This is my first time handling return import matters. The goods are already on the container ship bound for Shanghai, and will arrive at the port in 5 days. I'm so anxious that I can't even eat, fearing that incomplete documents or procedural errors will lead to port detention and customs detention, resulting in high port detention fees and warehouse rent, delaying the rework schedule and missing the delivery date of the next order. I want to ask, for this return situation due to quality problems, how exactly should we operate the return import customs declaration? What exclusive documents do we need to prepare in advance? Are there any ways to achieve fast customs clearance and compliantly reduce costs?

### Answer 1 — Best Answer

The first is the pre-document review details. We need to focus on preparing three core documents: First，the **original export customs declaration form and export tax refund certificate** (if tax refund has been processed，a tax repayment certificate must be provided). Ensure that the goods name，quantity and specifications on the documents are completely consistent with the returned goods，without any deviations，Second，the **quality problem inspection report issued by the overseas customer**，which must clearly indicate the unqualified proportion，specific problems and return requirements，and must have the customer's official seal or authorized signature，Third，the return application report，which needs to elaborate on the return reason，original export situation and follow-up treatment plan，and be stamped with the company's official seal.

For core step connection，submit the full set of documents to a professional customs broker for pre-review 3 days before the ship arrives at the port. After confirmation，complete the electronic declaration on the day of arrival. If customs inspection is triggered within 1-2 days after declaration，arrange personnel familiar with the goods in advance to assist with unpacking and explain the problem. Pay relevant taxes and fees (if any) promptly after inspection is passed，and pick up the goods with the release notice.

Formulate contingency plans in advance: If customs valuation objections are encountered，immediately provide original export contracts，invoices and cost accounting details for proof，If there are minor document discrepancies，issue a statement under the guidance of the customs broker to avoid direct return of the declaration，If there is a risk of port detention，apply to extend the free storage period by 1-3 days in advance.

After final compliant implementation，organize and archive the full set of materials including return customs declaration forms and original export documents，and keep them for at least 5 years to ensure complete vouchers can be provided for subsequent tax and customs verification.

### Answer 2

When handling return import customs declaration, if the original exported goods have already gone through tax refund procedures, you must first go to the tax authority to handle tax repayment procedures and obtain the *Export Goods Tax Repayment Certificate* before submitting to the customs for review. Otherwise, the declaration will be returned for re-submission due to missing documents, leading to port detention risks. If the original export customs declaration form has expired for more than 3 years, additional documents such as proof of goods ownership and original export foreign exchange receipt vouchers must be provided to prove that the returned goods are from the original export batch.

When customs conducts price assessment, it will calculate the dutiable price based on the transaction price on the original export customs declaration form, combined with factors such as exchange rate and transportation cost at the time of return. If the enterprise has objections to the price assessment result, it can submit original export contracts, invoices and cost details and other materials to apply for review, avoiding overpayment of taxes.

### Answer 3

Before the returned goods arrive at the port, you must confirm the manifest information with the shipping company in advance to ensure that the goods name, quantity and bill of lading number on the manifest are completely consistent with the customs declaration documents, avoiding customs detention due to inconsistent manifest data. If the goods need to be stored at the port, you need to understand the port's free storage period policy in advance. Generally, the free storage period of Shanghai Port is 7-10 days.

If it exceeds the free storage period, high port detention fees will be incurred. You can apply to the shipping company in advance for an extension of 1-3 days of free storage period. When picking up the goods, you must choose a yard with qualified storage for returned goods. If you need to transport the goods directly to the factory for rework, you need to arrange closed-loop transportation vehicles in advance to avoid secondary damage to the goods during transportation.

### Answer 4

If the return import is due to reasonable reasons such as quality problems or non-conforming specifications, and the original exported goods have not gone through tax refund procedures, you can apply for exemption from import tariffs and value-added tax. If tax refund has been processed, you need to repay the refunded VAT, and the import link can be exempt from tariffs, but you must provide the tax repayment certificate issued by the tax authority.

Enterprises can use the VAT deferral policy to temporarily not pay import VAT when returning imported goods, and apply for deduction or refund after the goods are reworked and re-exported, to ease financial pressure. It should be noted that if the returned goods are finally sold domestically, you need to repay import tariffs and VAT, and handle tax declaration according to the domestic sales process, to avoid triggering tax risks.

### Answer 5

The receipt and payment of foreign exchange for return import must comply with cross-border receipt and payment compliance requirements. If the original export has received foreign exchange, you need to provide the return customs declaration form, original export foreign exchange receipt voucher and customer's return certificate to the bank to handle the foreign exchange receipt offset procedure, avoiding unbalanced foreign exchange receipts and payments.

If the original export has not received foreign exchange, you need to file a return record in the foreign exchange monitoring system, explaining the return reason and follow-up foreign exchange collection plan, to avoid being included in the foreign exchange abnormal list. When using RMB cross-border payment, you must go through the CIPS system, ensuring that the transaction code and remarks of the payment message are consistent with the information on the return customs declaration form, avoiding payment failure due to inconsistent messages.

### Answer 6

Before returning the goods, sign a return agreement with the overseas customer, clarifying terms such as return reason, goods responsibility division and transportation cost bearing, to avoid subsequent legal disputes. If the goods are returned due to quality problems, ensure that the inspection report issued by the customer meets international standards, and has the customer's official seal or authorized signature, to avoid the customs not recognizing the inspection report due to its lack of legal validity.

If the original export contract includes a force majeure clause, confirm whether the return falls within the scope of the clause. If so, you can request the customer to bear part of the transportation costs according to the contract terms, reducing enterprise losses.

### Answer 7

When customs inspection is triggered for returned goods, prepare materials such as original export contracts, invoices and quality inspection reports in advance. The personnel present must be familiar with the original export situation and return reason of the goods, and can accurately answer the customs officers' questions. Cooperate with customs to unpack the goods during inspection, and avoid moving the goods without authorization.

If there are obvious quality problems with the goods, you can directly point them out to the customs officers to speed up the inspection progress. If the customs needs to send the goods for inspection, cooperate with the inspection procedures and provide relevant technical materials of the goods (MSDS report if it is a dangerous goods), ensuring smooth inspection process and avoiding port detention due to long inspection time.
