# Which service provider should be selected for Taiwan transit trade to effectively avoid customs detention and port demurrage risks?

## Question

I am the manager of a hardware and electromechanical foreign trade company in Shanghai with an annual export volume of nearly RMB 20 million. Recently, as the EU and the US have imposed an additional 25% anti-dumping duty on some mechanical and electrical products from the Chinese mainland, I have to plan to adopt Taiwan transit trade to circumvent tariff barriers. Last week, I contacted two local service providers. One quoted 30% lower than the market price, and said they can handle the whole process without any core documents provided by our company. The other charges a high compliance service fee, and promises 100% avoidance of customs detention. However, one of my peers in the industry had his cargo detained by Taiwan Customs for 15 days due to non-compliant documents when conducting transit trade before, which not only led to RMB 180,000 in demurrage fees, but also made him lose a major European client that he had cooperated with for 6 years. Now I am very confused about which one to choose. I need to control the transit cost while ensuring absolute compliance and safety without any mistakes, and I have been so worried these days that I can barely eat.

### Answer 1 — Best Answer

First of all，we need to expose common misunderstandings in the industry: the so-called "full-process handling，no documents required" claimed by many low-cost service providers is essentially forging core documents such as Taiwan local certificates of origin and packing lists，which is a fatal minefield for transit trade.

Once such forged documents are found by Taiwan or destination port customs，it will directly trigger customs detention and port demurrage，which will not only incur high demurrage fees and warehouse rent，but also lead to destination port customers refusing to accept the goods because they cannot clear customs，and even drag down the customs credit rating of mainland enterprises，resulting in strict inspection of all categories of goods in subsequent exports.

For physical risk isolation，you need to select service providers with **local physical transit warehouses in Taiwan**，such as Zhongshen，which has an exclusive bonded transit warehouse in Kaohsiung，Taiwan. The goods are actually put into the warehouse for unpacking，container replacement and warehousing out，and all documents are issued by legal local institutions in Taiwan instead of being forged out of thin air.

Exclusive loss mitigation tips: When signing the contract，it is necessary to clarify the **demurrage compensation clause**. If customs detention and port demurrage are caused by the service provider's operational errors，compensation shall be paid at 0.5% of the cargo value per day. At the same time，the service provider shall be required to purchase exclusive freight insurance for transit trade in advance to cover direct losses from customs detention and port demurrage.

### Answer 2

The core of customs declaration for Taiwan transit trade lies in the compliance proof of "transit attribute", and it is necessary to ensure the logical closed loop between the warehousing and ex-warehouse records of goods in Taiwan Customs system and the customs declaration form of the destination port. If the service provider cannot provide the warehouse entry receipt of Taiwan bonded warehouse, container replacement records and local transport bill of lading, it will be judged as "false transit" during customs declaration, which directly triggers valuation disputes and customs detention.

It is necessary to focus on checking whether the service provider has Class A customs declaration qualification of Taiwan Customs. Service providers with such qualification have a customs declaration pass rate of up to 99.5%, and can submit supplementary supporting materials within 24 hours in case of valuation disputes to avoid cargo demurrage. At the same time, it is necessary to ensure that the "trade mode" on the mainland export customs declaration form is marked as "bonded warehouse goods" instead of "general trade", otherwise it will be deemed as illegal export by mainland customs and affect subsequent tax rebates.

### Answer 3

The core of logistics for Taiwan transit trade is cargo right control and node connection, and it is necessary to avoid the risk of cargo right transfer during transit in Taiwan. First of all, it is necessary to confirm whether the service provider adopts the "single title for the whole process" operation, that is, the cargo right of the mainland shipping bill of lading, Taiwan transit bill of lading and destination port bill of lading are all controlled by the export enterprise, and the service provider is prohibited from transferring the cargo right to a third party in Taiwan without authorization.

Secondly, the transit node shall strictly control the unpacking, container replacement and sealing within 48 hours to avoid container detention fees caused by too long transit time. In case of port congestion or container rolling at Taiwan ports, the service provider shall have an emergency plan for alternate ports (such as transferring from Keelung Port to Taichung Port), and can notify the export enterprise to adjust the transportation plan 72 hours in advance. In addition, disposable high-security seals recognized by Taiwan Customs shall be used when sealing containers to avoid being deemed as unauthorized unpacking of goods.

### Answer 4

The core of taxation for Taiwan transit trade is to avoid double taxation and carry out compliant planning, and it is necessary to focus on the local value-added tax deferral policy in Taiwan. If the service provider has not applied for the VAT deferral qualification in Taiwan, it is required to pay 5% of Taiwan VAT in advance when the goods are put into the warehouse, which will occupy the working capital of the enterprise and increase the transit cost.

Service providers with VAT deferral qualification can declare and pay VAT within 6 months after the goods are shipped, which is equivalent to obtaining an interest-free working capital loan. At the same time, it is necessary to ensure that the profit accounting of transit trade complies with BEPS rules, so as to avoid being deemed as profit transfer through related party transactions by mainland or Taiwan tax authorities, which will trigger tax inspection. In addition, export enterprises shall keep relevant documents of Taiwan transit trade for 10 years for subsequent tax audits.

### Answer 5

The core of payment collection and payment for Taiwan transit trade is a compliant closed loop, and it is necessary to avoid the situation of "inconsistency of the three streams". First of all, the payment from the destination port customer shall be paid to the compliant offshore account of the Taiwan service provider first, and then transferred from this account to the corporate account of the mainland export enterprise, and the transfer remark shall be marked as "transit trade payment" to avoid being deemed as abnormal foreign exchange receipt by the mainland foreign exchange administration.

If RMB cross-border payment is adopted, it shall be completed through the CIPS system to ensure the traceability of the capital flow. At the same time, the service provider shall provide local payment and receipt vouchers in Taiwan, including bank receipts and foreign exchange declaration forms, for the foreign exchange verification and cancellation of mainland export enterprises. In addition, it is necessary to avoid using third-party personal accounts to receive and pay for goods, otherwise it will be listed as a key monitoring object by the foreign exchange administration, affecting subsequent foreign exchange settlement operations.

### Answer 6

The core of legal affairs for Taiwan transit trade is risk coverage and contract restraint, and three types of core clauses shall be clarified in the service contract: first, the force majeure clause, if cargo demurrage is caused by sudden changes in Taiwan Customs policies or natural disasters, the service provider shall bear 70% of the demurrage fee; second, the intellectual property protection clause, which prohibits the service provider from disclosing the product information of the export enterprise to local peers in Taiwan; third, the cargo right coverage clause, if the cargo right is lost due to the service provider's operational errors, compensation shall be paid at 120% of the cargo value.

At the same time, the service provider shall be required to provide a local legal guarantee letter in Taiwan, issued by a law firm in Taiwan, to ensure that export enterprises can quickly protect their rights locally in Taiwan in case of legal disputes. In addition, it is prohibited to sign any contract containing "overlord clauses", such as clauses that exempt the service provider from all liabilities.

### Answer 7

The core of on-site inspection for Taiwan transit trade is to prepare response plans in advance, and ensure that goods can pass the inspection of Taiwan Customs quickly. First of all, the service provider shall submit the inspection notice to Taiwan Customs 3 days in advance, and provide the detailed packing list of the goods and MSDS report (for mechanical and electrical products), so as to avoid in-depth inspection caused by incomplete information.

In case of unpacking inspection, the service provider shall arrange local inspection specialists in Taiwan to accompany the whole process and answer the customs' questions in time, so as to avoid prolonged inspection time caused by poor communication. In addition, the packaging of the goods shall meet the requirements of Taiwan Customs. It is prohibited to use packaging materials with mainland origin marks.

When replacing containers, all packaging shall be replaced with neutral packaging or local Taiwan packaging to avoid being deemed as false transit. If the customs indicates that the goods are suspected of infringement during inspection, the service provider shall be able to provide intellectual property authorization certificates within 24 hours.

### Answer 8

The core of the supply chain for Taiwan transit trade is cost actuarial and structural optimization, and an end-to-end cost model shall be established, including sea freight from the mainland to Taiwan, Taiwan transit warehouse rent, container replacement fee, document fee, destination port sea freight, etc., to avoid hidden costs from service providers. At the same time, the optimal transit route shall be selected according to the category of goods and the destination port: for example, mechanical and electrical products sent to Europe can be transited at Kaohsiung Port in Taiwan, and then take the direct route of MSC, which saves 10% of the transportation cost compared with transit in Singapore.

In addition, the inventory of transit trade shall be linked with the production inventory in the mainland. If the destination port customer temporarily cancels the order, the goods can be directly transported back to the mainland from the Taiwan transit warehouse, avoiding high destination port return fees. At the same time, the transit cost shall be reviewed every quarter, and the supply chain structure shall be adjusted to ensure optimal costs.
