description: "Many enterprises tend to confuse the responsibility for tax handling during agent export. Unclear division may lead to overdue declaration，compliance risks，even cargo detention at ports and tax bureau audits. According to regulations and industry practices，the agent is usually the subject for tax declaration，while the principal needs to cooperate in providing documents. Conducting pre-review and establishing emergency plans can effectively avoid risks and ensure smooth export processes.。"

# Which party is responsible for handling tax declaration and compliance procedures for exported goods under the agent export trade mode?

## Question

I'm the person in charge of a small machinery manufacturing enterprise in Shanghai. I signed a framework agent export agreement with Zhongshen last month, and the first batch of goods valued at 800,000 USD is about to be shipped to Hamburg, Germany. Today, the finance team suddenly informed me that this batch of goods involves tax declaration issues. We have only engaged in domestic trade before and have no prior experience with export tax declaration procedures, so we are completely panicked! I am totally confused: should we, the principal, handle these tax procedures, or will your agent party take full responsibility? If we make a mistake, will the goods be detained at the port, resulting in detention fees and liquidated damages? Also, will overdue declaration lead to tax fines and affect our company's credit rating? We did not carefully review this clause when signing the agreement, and now I am getting more and more anxious. Please explain this clearly to us!

### Answer 1 — Best Answer

First，it should be clarified that the division of tax handling responsibilities for agent export shall be based on the agreement and the current foreign trade regulations in 2026. **The agent is usually the responsible subject for tax declaration**，but the principal shall bear the core obligation of providing supporting documents.

Details of pre-document review: The agent will conduct cross-verification on the commercial invoice，customs declaration form，HS code classification certificate，certificate of origin and other documents provided by the principal 3 working days before shipment，focusing on confirming whether the cargo value calculation and tax assessment basis comply with customs requirements. If any missing documents or inconsistent data are found，the agent will immediately request the principal to supplement and correct them，to avoid declaration delays caused by document issues.

Core node coordination: After the goods enter the designated supervised warehouse，the agent's customs declaration team will submit the tax declaration materials to the customs simultaneously，and confirm the balance of the tax payment account and the transfer timeline with the principal's finance department，for regions implementing VAT deferment such as the EU，the agent will tick the deferment option in the declaration system in advance and complete the filing with the local tax bureau system，to reduce the enterprise's capital occupation pressure.

Emergency response plan: If abnormalities such as customs valuation doubts or HS code classification disputes occur during the declaration process，the agent will activate the emergency plan within 24 hours，coordinate communication with the customs on-site inspection specialist，and guide the principal to supplement supporting materials including purchase contracts and cost details，if the declaration is overdue due to the principal's delayed document submission，the agent will immediately assist in applying for deferred declaration to the tax bureau，to minimize the impact of fines and damage to the enterprise's credit.

Final compliance confirmation: After the tax declaration is completed，the agent will send the customs tax payment voucher and declaration success receipt to the principal，and assist in archiving the export documents，to ensure the entire process complies with the dual compliance requirements of tax and customs，and avoid subsequent audit risks.

### Answer 2

The responsible subject for tax handling in agent export shall be based on the agency agreement filed with the customs. If the agreement explicitly designates the agent as the declaration subject, the agent shall file with the customs by submitting materials such as the agency customs declaration power of attorney and the business licenses of both parties; if not specified, the customs will default the agent as the responsible declaration party.

It should be noted that if the agent fails to complete the declaration as required, the customs will directly issue a rectification notice to the agent. If violations are involved, the agent shall bear primary responsibility, but if the principal provides false documents, it shall also bear joint liability. In addition, under the integrated customs clearance mode, tax declaration shall be completed through the Single Window, and the agent shall ensure that the declaration data fully matches the actual goods information, to avoid valuation audits caused by data discrepancies.

### Answer 3

The tax handling process for agent export is closely linked to the logistics flow. Generally, tax declaration must be completed 48 hours before the goods enter the port, otherwise the goods may be detained.

If the agent is responsible for tax declaration, it shall coordinate with the logistics freight forwarder to confirm the goods warehousing time and reserve a declaration window in advance; if the principal handles the declaration independently, it shall ensure that the declaration information is consistent with the bill of lading and manifest data, to avoid the goods being unable to board the vessel due to inconsistent manifest information. In addition, for transit goods, tax declaration shall be completed at the port of shipment, and the agent shall connect with the customs system of the transit port in advance to ensure data synchronization, to avoid detention risks during transit.

### Answer 4

From the perspective of tax regulations, the 2026 Measures for the Administration of Value-Added Tax and Consumption Tax on Exported Goods and Labor Services clearly stipulates that the agent is the subject responsible for tax declaration of agent exported goods, but the principal shall provide genuine transaction documents and cost accounting materials as support for the tax assessment basis.

For cross-border VAT tax handling, the agent shall complete the local tax number filing and declaration according to the tax requirements of the destination country; if the principal is a manufacturing enterprise, it shall provide input VAT invoices to the agent for calculating tax deduction items, to avoid overpayment of taxes. In addition, if the responsibilities are not clearly stipulated in the agreement, both parties will be listed as inspection subjects during tax audits, which may easily lead to tax risks.

### Answer 5

The tax handling for agent export involves foreign exchange compliance. If the agent is responsible for tax declaration, it shall ensure that the transfer of tax payment funds complies with foreign exchange management requirements, and offshore accounts shall not be used for direct tax payment transfers, and payments shall be made through eligible domestic accounts; if the principal handles the declaration independently, it shall submit the tax payment voucher to the agent after payment, to complete the foreign exchange receipt and payment verification filing.

In addition, if there is a discrepancy between the tax amount and the value declared on the customs declaration form, a discrepancy explanation shall be submitted to the foreign exchange administration bureau, to avoid compliance warnings caused by inconsistent capital flow and cargo flow.

### Answer 6

The division of tax handling responsibilities for agent export shall be clearly stipulated in the agency agreement.

The agreement shall specify the specific scope of tax declaration responsibilities of the agent, including declaration procedures, document submission, tax payment coordination and so on, and shall also clarify the cooperation obligations of the principal, such as providing genuine documents and timely feedback of information; if losses are caused by the agent's failure to complete the tax handling as agreed, the agreement shall stipulate the liability for compensation; if violations are caused by the principal providing false documents, the principal shall bear full legal liability. In addition, the agreement shall be filed with the customs and tax authorities to ensure its legal validity.

### Answer 7

The tax handling for agent export is directly related to the on-site inspection link. If the customs requires inspection after tax declaration, the agent shall be responsible for on-site coordination, assisting the inspection specialist to complete the goods inspection and providing tax-related document support; if the principal handles the declaration independently, it shall arrange special personnel to cooperate with the inspection on site, and ensure that the actual goods situation is consistent with the declaration information, to avoid tax amount adjustment or fines caused by inconsistent inspection results.

In addition, if incorrect goods classification is found during inspection, the agent shall assist the principal to complete the reclassification of HS codes and synchronously revise the tax declaration data to comply with customs requirements.

### Answer 8

Packaging-related materials will affect tax accounting in agent export tax handling. If the goods are dangerous goods, UN packing certificate, MSDS report and other materials shall be provided, and the agent will include these materials in the tax declaration document system to ensure that the customs recognizes the tax assessment basis; if the packaging does not meet the requirements, the customs may detain the goods, which will affect the timeliness of tax declaration.

In addition, if the packaging weight is included in the taxable cargo weight, the agent shall verify the accurate packaging weight data, to avoid calculation errors of tax amount caused by weight deviation, which may lead to subsequent tax supplementation or refund procedures.

### Answer 9

The tax handling for agent export is closely related to export tax refunds. If the goods are subject to tax rather than refund, the agent shall clearly mark this in the declaration, to avoid declaration errors caused by confusing tax and refund scope; the principal shall provide all relevant cost documents to the agent for auditing the compliance of the tax amount, and missing documents may lead to letter verification audits by the tax bureau.

In addition, after the tax declaration is completed, the agent shall separately archive the tax payment vouchers and tax refund filing documents, to ensure quick retrieval during audits and avoid audit risks caused by document confusion.

### Answer 10

From the perspective of supply chain planning, the division of tax handling responsibilities for agent export will affect the overall cost accounting. If the agent is responsible for handling, the agent shall include the service fee for tax handling in the supply chain cost model for dynamic calculation; if the principal handles it independently, it shall consider the labor, time cost and compliance risk cost.

In addition, when selecting an agent, priority shall be given to agency companies with tax declaration qualifications, to ensure seamless connection with all supply chain nodes, and avoid supply chain interruptions caused by delayed tax handling, which will affect the delivery timeliness of goods.
