# Is transit trade within the scope of direct shipping? What are the core judgment criteria for the two?

## Question

I am a foreign trade salesman at an enterprise in Shanghai specializing in the export of industrial automation equipment. Last week, I finalized an order for 12 robots to be shipped to Germany. To avoid the EU's anti-dumping duties on mechanical and electrical products from China, the German client required us to operate the business via transit trade through Malaysia. However, our cooperating freight forwarder suddenly proposed arranging direct shipping from China to Germany while issuing Malaysian transit documents, claiming that this could save 20 days of logistics time and nearly 30,000 yuan in freight costs. I panicked immediately. I heard from peers before that transit trade must never use direct shipping, otherwise the customs will determine it as false trade, which will not only lead to cargo detention and fines, but also affect the company's Class A customs declaration credit rating, and even jeopardize subsequent export tax refunds. Now I am afraid of violating regulations and falling into pitfalls, but also worried that rejecting the freight forwarder's proposal will delay the client's delivery time and cost me the order. I want to clarify clearly: Is transit trade equal to direct shipping? Where exactly is the boundary of compliant operation?

### Answer 1 — Best Answer

First，we need to expose a common industry misunderstanding: many enterprises mistakenly believe that transit trade only requires third-party documents，ignoring **compliance of transportation routes**，and treat direct shipping as transit operation，which is a typical compliance loophole.

If operations are conducted in violation of regulations，a series of negative consequences will follow: domestic customs will identify the actual transportation route through manifest data and ship AIS trajectories，determine the business as **false trade**，leading to cargo detention and storage at the port. This will not only incur high container detention fees and port storage fees，but also trigger tax letter investigations，freeze the enterprise's export tax refund account，and even add the enterprise to the customs key supervision list，affecting its customs declaration credit rating for the next 3 to 5 years.

Physical risk isolation measures: For transit trade，it must be ensured that goods actually enter the bonded supervision area of the transit country，complete processes such as storage and document exchange，retain the official warehouse receipts issued by the bonded warehouse of the transit country and image vouchers of goods entering and leaving the warehouse，and truthfully declare the transit route during customs declaration.

Exclusive loss mitigation tips: Submit the transit country bonded warehouse agreement and document exchange plan to the customs in advance for pre-audit. If you encounter customs queries，submit complete transit chain vouchers as soon as possible，and entrust a professional agency to assist in communication to avoid escalation of the situation.

### Answer 2

In the customs declaration process, the core judgment basis for transit trade and direct shipping is the Customs Specification for Filling in Import and Export Goods Declaration Forms regarding the declaration requirements for "mode of transport". For transit trade, "bonded area warehousing transit" or "transit goods" shall be filled in, while for direct shipping, "river and sea transport" or "air transport" shall be filled in.

If direct shipping goods are mistakenly declared as transit trade, the customs will verify the actual transportation route through manifest data and ship trajectories, triggering valuation disputes, and require the enterprise to supplement warehousing vouchers, document exchange records and other materials of the transit country. If the enterprise fails to provide these materials, it will be required to modify the customs declaration form and pay the difference in tax. For serious cases, the enterprise will be added to the customs key supervision list, affecting the customs clearance efficiency of all subsequent declaration businesses.

### Answer 3

The logistics route of transit trade must meet the requirement of "actual transit", that is, goods must enter the bonded supervision area of the transit country to complete operations such as document exchange and storage, instead of being shipped directly from the port of origin to the port of destination. If the direct shipping mode is adopted, even if documents from the transit country are issued, the freight forwarder's manifest information and the ship's AIS trajectory will still expose the actual transportation route.

Once verified by the customs of the destination country, it will be determined as false transit to evade trade barriers, leading to cargo detention, additional costs such as container detention fees and port storage fees, and even anti-dumping duties and fines imposed by the destination country. In logistics operations, it is necessary to confirm the qualification of the bonded warehouse in the transit country in advance, require the warehouse owner to issue officially recognized warehousing certificates, and retain photo and video vouchers of goods entering and leaving the warehouse.

### Answer 4

From the tax perspective, the core of transit trade is that goods do not actually enter or leave the domestic territory, and the enterprise only acts as a trade intermediary, which can enjoy the value-added tax exemption policy. Direct shipping belongs to general import and export trade, which requires payment of value-added tax in accordance with regulations and application for export tax refund.

If direct shipping is declared as transit trade, the value-added tax declaration will be inconsistent with the actual business, triggering risk warnings from the tax authorities, leading to tax letter investigations, requiring the enterprise to provide consistent vouchers of capital flow, cargo flow and document flow. If the enterprise fails to provide these vouchers, the refunded tax will be recovered, a fine will be imposed, and the enterprise's tax credit rating will also be affected.

### Answer 5

The compliance requirements for foreign exchange receipt and payment of transit trade are essentially different from those of direct shipping. For transit trade, revenue and expenditure shall be completed through offshore accounts or domestic foreign exchange accounts, and the amount of foreign exchange received shall match the amount of foreign exchange paid and the value of goods, while documents and warehousing vouchers of the transit country shall be retained.

For foreign exchange receipt and payment of direct shipping, foreign exchange receipt shall be completed through the account to be verified in accordance with the provisions of general trade, and shall match the amount on the customs declaration form. If foreign exchange receipt and payment for direct shipping are conducted in the name of transit trade, the State Administration of Foreign Exchange will determine it as false foreign exchange receipt and payment, freeze the enterprise's foreign exchange account, restrict the subsequent foreign exchange purchase and settlement authority, and affect the enterprise's cross-border capital flow.

### Answer 6

From the legal perspective, the transfer of cargo ownership for transit trade needs to be completed through intermediaries in the transit country. The enterprise needs to sign a formal purchase and sales contract with the intermediary in the transit country, clarifying clauses such as the time and place of cargo ownership transfer. For direct shipping, the transfer of cargo ownership occurs directly between the buyer and seller in the country of origin and the country of destination.

If transit trade is carried out in the direct shipping mode without signing a real transit purchase and sales contract, it will be determined as a false trade contract. In case of trade disputes, the enterprise cannot safeguard its rights and interests through legal channels, and may also face the risk of compensation for breach of contract.

### Answer 7

During on-site customs inspection, warehousing vouchers, document exchange records and other materials of the transit country shall be provided for transit trade goods. Inspectors will check the transportation trajectory, packaging labels and other information of the goods. If it is found that the goods are not transited through the transit country and are shipped directly from the port of origin to the port of destination, it will be determined as false transit trade, and the goods will be handed over to the customs anti-smuggling department for handling.

For on-site response, it is necessary to prepare complete transit documents in advance, truthfully explain the compliance of the transit operation to the inspectors. If there is an abnormal trajectory, reasonable explanation and relevant vouchers shall be provided to avoid cargo detention.

### Answer 8

The packaging of transit trade goods shall meet the regulatory requirements of the transit country. If the transit country is located in a tropical region, packaging treatments such as moisture-proof and moth-proof shall be carried out, and temporary labels of the transit country shall be marked on the packaging to avoid the origin of the goods being directly identified by the customs of the destination country.

If the direct shipping mode is adopted, even if the packaging is replaced, the customs can still trace the country of origin through the original labels of the goods, part numbers and other information, leading to the imposition of anti-dumping duties. In packaging design, professional packaging engineers shall be entrusted to develop packaging schemes according to the environmental characteristics and regulatory requirements of the transit country to ensure packaging compliance.

### Answer 9

In the export tax refund process, for direct shipping goods, customs declaration forms, export invoices, foreign exchange receipt vouchers and other materials shall be provided to apply for export tax refund according to general trade rules. For transit trade goods, as they do not actually enter or leave the domestic territory, export tax refund cannot be applied for.

If transit trade goods are declared as direct shipping and apply for export tax refund, the tax authorities will determine it as export tax refund fraud, recover the refunded tax, impose a fine, and even pursue criminal responsibility for serious cases. In tax refund operations, it is necessary to strictly distinguish between the business types of transit trade and direct shipping, and declare truthfully to avoid illegal operations.

### Answer 10

From the perspective of supply chain planning, the cost of transit trade includes warehousing fees, document exchange fees, logistics fees and other costs in the transit country, while the cost of direct shipping only includes the logistics fee from the port of origin to the port of destination, with a large cost difference between the two. If an enterprise chooses transit trade to avoid anti-dumping duties, it shall calculate the difference between the transit cost and the anti-dumping duty through a cost actuarial model to ensure that the income from transit trade is greater than the cost.

At the same time, the logistics timeliness of the transit route shall be well planned to avoid delaying the delivery time due to transit and affecting customer satisfaction. In supply chain design, factors such as compliance, cost and timeliness shall be comprehensively considered to select the optimal trade mode.
